  • 1. PURPOSE

    a) The Terms and Conditions herein shall be the contract or agreement that defines the rights, duties and responsibilities of GO SHOP and a Customer in relation to the registration and use of an Account and the order, sale and purchase of any Product from the Home Shopping Platform. By speaking to our Personal Go Shopper or going online to the Site to register an Account or placing an Order with GO SHOP or using any facilities made available by GO SHOP from the Home Shopping Platform, Customers are deemed to have read, accepted and agreed to be bound by these Terms and Conditions.

    b) Customers are advised to read these Terms and Conditions and GO SHOP Privacy Notice before registering an Account and/or placing an Order to purchase a Product. These Terms and Conditions and the GO SHOP Privacy Notice are available online on the Site. GO SHOP shall be entitled to also provide a copy of these Terms and Conditions and the GO SHOP Privacy Notice or such other relevant documents in relation to the registration of an Account and/or the sale and purchase of the Products to Customers together with the delivery of a Product.

    c) The Terms and Conditions herein shall be read with all the information made available to a Customer when placing and confirming an Order including without limitation: 1) The GO SHOP Privacy Notice on the use of personal information; and 2) The GO SHOP Terms and Conditions of Use; and 3) Such other information as may be provided to a Customer by GO SHOP, save that in the event of any conflict, these Terms and Conditions herein shall prevail.

    d) In relation to placing Orders and purchasing from the Home Shopping Platform, Customers may call in to GO SHOP’s hotline number (which can be found upon viewing GO SHOP TV and listed on the Site), to speak to a Personal Go Shopper OR browse the Site for further information including without limitation on how to order, payment methods, delivery, and/or returns/refunds.

    e) GO SHOP reserves the right to amend, change, modify, add, d elete or remove any part of these Terms and Conditions and the information provided to a Customer at any time it deems fit without notice. Changes will be effective after they are posted on the Site or notified by GO SHOP. The continued purchase of Products from GO SHOP and/or use of the Home Shopping Platform by a Customer following such amendments, changes, modifications, additions, deletions or removal to these Terms and Conditions constitutes the Customer’s acceptance of those changes and the Customer agrees to be bound by the same.

    f) Definitions:

    “Account” means a one-time registration account created for a Customer by GO SHOP for the purposes of transacting on the Home Shopping Platform including purchasing a Product and containing the information of the Customer including without limitation name, address, identification number (NRIC/Mykad), telephone number and/or such other information as may be required by GO SHOP for such registration;

    “Astro” means Astro Malaysia Group, and includes all its related companies including without limitation MEASAT Broadcast Network Systems Sdn Bhd (Company Number 240064-A), a satellite and cable TV service operator which provides data, high definition format services, recording services, pay-per-view, premium/special events, near video on demand, interactive and other special services (including paid packages of television and radio channels);

    “Business Day (s)” means a day (s) on which commercial banks are open for business in Selangor (other than Saturdays, Sundays and public holidays);

    “Business Partners” means the business partners of GO SHOP whose products and/or services are featured, advertised, promoted or offered for sale on the Home Shopping Platform including without limitation suppliers, vendors, sellers, merchants and other third parties;

    "Customer/Customers” means the person who has opened an Account and registered as a customer of GO SHOP in accordance with the terms herein;

    “GO SHOP” means the home shopping business operated by Astro GS Shop Sdn Bhd (Company Number 1081077-X) a company incorporated in Malaysia and having its registered address at 3rd Floor, All Asia Broadcast Centre, Technology Park Malaysia, Lebuhraya Puchong-Sungai Besi, Bukit Jalil, 57000 Kuala Lumpur, Malaysia, and which operates on the Home Shopping Platform to provide a venue for Customers to access, view, browse, and/or place an Order for any Product;

    “GO SHOP TV” means collectively the home shopping television channels and programs operated by GO SHOP which is currently available on Astro’s TV Channels via cable or satellite TV services including without limitation Astro Channels 118, 120 and 303 (subject to such changes from time to time) that features and offers Products for sale;

    “Home Shopping Platform” means collectively GO SHOP TV and the Site and/or such other home shopping platforms, on ground locations or stores where GO SHOP shall advertise or sell or offer for sale the Products;

    "Order" or “Orders” means any order submitted or placed by a Customer to GO SHOP to purchase a Product from either GO SHOP or a Business Partner (where applicable);

    "Product/Products" means any product/merchandise/offers/display items and shall include the Services that are uploaded /showcased/displayed/broadcasted and/or offered for sale on the Home Shopping Platform;

    “Personal Go Shopper” means GO SHOP’s call center agent or such agent appointed by GO SHOP;

    "Site" means collectively GO SHOP’s website at www.goshop.com.my, mobile application at m.goshop.com.my (mobile site/ mobile website) and/or any other mobile applications/mobile interfaces applications/ apps and the services provided GO SHOP and/or social media platforms (including without limitation Facebook, YouTube, Instagram) which provides a venue / platform to the users of the Site and/or a Customer to access, view, browse or purchase the Products featured, showcased/displayed and/or offered for sale on the Site;

    “Services” means the services provided by GO SHOP in relation to any Product and/or services featured or offered for sale on its Home Shopping Platform including those offered for sale by any of the Business Partners;

    "Terms and Conditions" means the terms and conditions as detailed herein applicable to GO SHOP’s Customers including all schedules, appendices, annexures, and will include the references as amended, negated, supplemented, varied or replaced from time to time;

    “Terms and Conditions of Use” means GO SHOP’s Terms and Conditions of Use in relation to the use of the Home Shopping Platform as posted on the Site and as amended, negated, supplemented, varied or replaced from time to time.

    2. ACCOUNT REGISTRATION, ORDER ACCEPTANCE AND PRICING

    a) ACCOUNT REGISTRATION
    i) Prior to placing the first Order from GO SHOP, a Customer must carry out a one-time registration and creation of a new Account by either: (1) calling the designated hotline number shown on GO SHOP TV or on the Site and speak to a Personal Go Shopper who is able to assist the Customer to register a new Account; OR (2) carry out a one-time registration and creation of a new Account online on the Site OR (3) via such other methods of registration which creates a new Account as shall be determined by GO SHOP at its absolute discretion from time to time. The Customer shall comply with these Terms and Conditions provided in relation to the registration of the Account and use of the Home Shopping Platform.

    ii) To register, a Customer must be aged eighteen (18) years and above at the time of registration and have a designated local address in Malaysia. A Customer must provide all relevant information required by GO SHOP for the purposes of registration of the Account. For registration on the Site, a Customer must provide the information required in the registration form on the Site, and a unique and valid e-mail address and password upon completing the Account registration process. Customers agree to: (1) provide true, accurate, current and complete information about themselves as prompted by the Account registration form, and (2) maintain and promptly u pdate such registration data to keep it accurate, current and complete. Upon registration as per the manner above, the Customer’s Account will be created. Customers only need to register an Account once. For subsequent Orders, Customers will only need to go through GO SHOP’s verification process.

    iii) Customers are responsible for maintaining the confidentiality of the password and e-mail address, and are fully responsible for all activities that occur under such password or e-mail address whether or not actually or expressly authorized and/or used by the Customer. Customers agree to immediately notify GO SHOP if any authorised third party has that password or if there is any unauthorized use of the Customer’s email address or any breach of security known to the Customer.

    iv) The Account is not transferable and may not be assigned to any third party. Customers agree to: (1) notify GO SHOP immediately of any unauthorized use or any other breach of security, and/or (2) ensure that Customers properly exit from the Account at the end of each session on the Site. GO SHOP cannot and will not be liable for any loss or damage arising from Customers’ failure to comply with this provision.

    v) Subject to the terms contained herein, GO SHOP reserves the right, in its sole discretion and without notice, to decline a new Account OR to suspend, cancel or terminate an existing Account at any time in any of the following circumstances:
    1) if any Customer provides any information that is untrue, false, inaccurate, not current or incomplete or if GO SHOP has reasons to believe that such information is untrue, false, inaccurate, not current or incomplete; and/or
    2) if any Customer’s Account is dormant and has not been used for a period of six (6) months or longer; and/or
    3) if a Customer breaches any of these Terms and Conditions, and/or the GO SHOP Terms and Conditions of Use and/or the GO SHOP Privacy Notice; and/or
    4) if any Customer commits or performs fraudulent activities or fraudulent activities are performed by third parties under the Customer’s Account or if GO SHOP suspects fraudulent use of the Customer’s Account (“fraudulent activities” or “fraudulent use” of an Account may include but is not limited to unauthorised access to or by third parties of a Customer’s e-mail address and password, entering invalid or apparently invalid user information for the Account, or attempting to register for free, trial, or promotional offers under several aliases or with different user information to circumvent any one-trial-per-user limitation or using another person’s banking account to pay for any Order or such other illegal activities that breach or infringe applicable laws); and/or
    5) if any Customer commits any act or if GO SHOP has reasons to believe that the Customer has committed any act that affects or damages the reputation of GO SHOP or Astro; and/or
    6) if any Customer is no longer wishes to be a customer of GO SHOP.

    vi) Upon any termination of an Account, the Customer shall immediately cease all access to and use of the Home Shopping Platform and GO SHOP may, in addition to any other legal or equitable remedies, immediately cancel the Account and deny access to and use of the Home Shopping Platform to the Customer in whole or in part. Any termination of an Account shall not affect the respective rights and obligations (including without limitation, payment obligations of the Customer) of the parties arising before the date of termination.

    vii) Customers may terminate and close the Account by e-mailing to GO SHOP at the email address specified on the GO SHOP’s website at www.goshop.com.my from the e-mail address provided by Customers at the time pf creation of the Account or as u pdated from time to time. Customers’ e-mail must specify Customers’ e-mail address, name and address and expressly state that Customers wish to terminate the Account. Alternatively, Customers may call GO SHOP’s hotline number and obtain the assistance of a Personal Go Shopper to terminate and close the Account.

    viii) Subject to the provisions of the Direct Sales and Anti-Pyramid Scheme Act 1993 (Act 500) (as amended or replaced from time to time), the Customer shall have the right to rescind the contract (including the Account) with GO SHOP before the expiry of the cooling off period of ten (10) Business Days from the date of successful registration of the Account. For the avoidance of doubt, should the Customer place an Order successfully with GO SHOP and requires for delivery of the Product ordered from GO SHOP before expiry of the said cooling off period, then such Order shall constitute the notice from the Customer to GO SHOP to waive his/her right to rescind the contract (including the Account).

    b) ORDER ACCEPTANCE AND PRICING

    i) To place an Order with GO SHOP, a Customer must complete the registration process stated in this Section 2 prior to the time of placing such Order, failing which GO SHOP has the right to accept, refuse, cancel or reject any Order placed.

    ii) Any Order placed by a Customer shall include the following information or as shall be required by GO SHOP:
    • Product name and specifics (color, size, etc.)
    • Payment method and details
    • Delivery address.

    iii) A Customer’s successful Order will be confirmed to the Customer via Short Messaging Service (SMS) notification and/or via electronic mail confirmation containing a summary of the Order details and/or such other method that GO SHOP shall decide from time to time without notice.

    iv) GO SHOP reserves the right to accept, refuse, cancel or reject any Order from any Customer or any person at any time or under any circumstances including where an Order cannot be processed for various reasons. Customers may be asked to provide additional verifications or information before an Order is accepted.

    v) Notwithstanding the aforesaid, non-acceptance of an Order by GO SHOP may be a result of, without limitation any one of the following:
    • The Product that Customers have ordered is unavailable or out of stock;
    • GO SHOP is unable to obtain authorization for Customers’ payment;
    • The identification of a pricing or product description error;
    • If there is false, omitted, erroneous information in customer registration of the Customer’s Account;
    • If a Customer is found to be under the age of 18 years;
    • If GO SHOP believes that it is not technically able to fulfill the Order (including delivery).

    vi) Any changes or cancellation by a Customer of any Order shall be notified to GO SHOP’s Personal Go Shopper provided that any Order that has been paid, delivered or pending delivery may not be cancelled but instead the Product must be returned in accordance with Section 6 on EXCHANGE/RETURNS/ REFUNDS/CANCELLATION herein.

    vii) All prices stated on the Home Shopping Platform shall be the price of Products and GO SHOP shall have the absolute discretion to determine the price of the Products at any time including without limitation any promotional prices. All prices, unless indicated otherwise are in Ringgit Malaysia and GO SHOP reserves the right to enhance the currency offerings or limit the currency offerings at any time without notice. Prices shall be subject to changes as may be determined by GO SHOP from time to time without notice.

    viii) The price for the Products includes relevant tax (if any) unless otherwise determined by GO SHOP. GO SHOP shall be entitled to charge delivery and installation charges. GO SHOP is determined to provide the most accurate pricing information but in some cases errors may occur, such as in cases when the price of an item is not displayed correctly. In the event that an item is mispriced, GO SHOP may, at its own discretion, either inform and contact Customers for instructions or cancel an Order.

    3. PRODUCTS DESCRIPTION AND AVAILABILITY

    a) Customers acknowledge that all images, photographs or videos of the Products presented, showcased, displayed, broadcasted and made available on the Home Shopping Platform are for illustrative purposes only subject to the provisions on warranties in Section 7 below. GO SHOP will attempt to ensure that all description of the Products shown are as accurate as possible. Although GO SHOP has taken reasonable care to present the description of the Products accurately, the actual Products delivered may vary slightly from those shown on the Home Shopping Platform due to reasons including without limitation any broadcast quality, packaging, redesign and improvements.

    b) The availability of the Products presented on the Home Shopping Platform depends on availability of stock and GO SHOP does not guarantee the availability of the Products. In order to ensure that Products are available to Customers, GO SHOP has the right to set maximum limits in advance for the purchase of individual items by a single Customer. If the Products requested by the Customer are unavailable or out of stock, GO SHOP shall make every effort to offer a substitute item which is closest in terms of price and type to the originally requested item and in this connection, GO SHOP shall not be held liable in any manner whatsoever to the Customer. GO SHOP shall also be entitled to carry out special promotions which offer free gifts or promotional items at its sole discretion from time to time subject to such terms as may be decided by GO SHOP. Where any Product is sold or provided by the Business Partners on the Home Shopping Platforms to Customers then Customers shall comply with the terms and conditions imposed by the Business Partners.

    4. TERMS OF PAYMENT

    a) GO SHOP reserves the right to set the rules and policies regarding the payment methods and to make the necessary changes from time to time. Unless otherwise specified, the payment for Products purchased by any Customer may be made via any of the following methods (collectively “Payment Methods”):

    i) Credit Card and/or Debit Card (“Card(s)”)
    GO SHOP accepts all types of Cards including Visa, and MasterCard issued in Malaysia save that GO SHOP is entitled to reject, revise or refuse the acceptance of any such Cards at its absolute discretion or to revise the types of Cards to be accepted without assigning any reasons or notice. However, no payments will be processed for a non-card holder and Customers shall comply with such terms and conditions as may be imposed by the issuing financial institution or bank. If a Card payment is rejected or declined for any reason, GO SHOP reserves its rights under the Terms and Conditions to reject the relevant Order either in whole or in part.

    ii) Cash on delivery (COD)
    COD is available to a Customer who wishes to make payments for a Product upon delivery provided that COD may only be transacted up to Orders not exceeding RM1,500.00 per Order per Customer per day. Any Order having a value exceeding RM1,500.00 will be referred to payment via the credit card/debit card method. Customers shall make the full COD payment to GO SHOP and/or GO SHOP’s Delivery Provider at the point of delivery of the Product and upon receipt of the full payment, the Product will be handed over to the Customer.

    iii) Easy payment plan (EPP)
    Subject to such terms and conditions as may be decided by GO SHOP at its absolute discretion and such terms imposed by the issuing bank, EPP is only applicable to Customers who purchase Products above a fixed amount via their credit cards. Customers are advised to enquire with GO SHOP for details of any EPP facilities available or call the GO SHOP’s hotline number and speak to a Personal Go Shopper for details of any EPP facilities available.

    iv) GrabPay e-Wallet payment
    Customers who have signed up with “GRAB” for GrabPay e-Wallet cashless payment payable using GrabPay credits from the GrabPay mobile application (“GrabPay e-Wallet”) may use the same to pay for Orders of s elected Products not exceeding Ringgit Malaysia One Thousand (RM1,000.00) only per Order per Customer per day for delivery in Peninsular Malaysia only (“e-Wallet Order” or e-Wallet Orders”) subject to the following which may be revised from time to time by GO SHOP:
    • Payment is only available for s elected Products using GrabPay e-Wallet payment so Customers are advised to contact GO SHOP or refer to the Site for further details.
    • A Customer must make full payment to the Delivery Provider at the point of delivery using GrabPay credits from the Customer’s GrabPay e-Wallet. Upon the proof of the correct payment generated and verification by the Delivery Provider on the amount due under the e-Wallet Order, the Product will be handed over to the Customer. GO SHOP reserves its right herein to reject delivery for any e-Wallet Order either in whole or in part if a Customer fails to make payment using the GrabPay e-Wallet at the point of delivery.
    • In the event a Customer has insufficient GrabPay credits to pay the e-Wallet Order amount, the Customer may use the GrabPay credits from a third party’s GrabPay e-Wallet and combine with the Customer’s own GrabPay credits to complete payment of the e-Wallet Order amount to the Delivery Provider. Upon verification by the Delivery Provider on the successful completion of payment by the Customer using the GrabPay e-Wallet, the Product will be handed over to the Customer.
    • A Customer is not allowed to use any other Payment Methods other than GrabPay e-Wallet payment to make, complete or combine payments for any e-Wallet Order.
    • Where a Customer has overpaid the e-Wallet Order amount, then Customer must request for a refund to GO SHOP by calling GO SHOP’s hotline number or online on the Site (particularly via www.goshop.com.my) and submit the proof of payment to GO SHOP. Refunds on overpayment of GrabPay credits from Grab Pay e-Wallet payments are subject to the sole discretion of GO SHOP and upon verification with GRAB. All refunds to a Customer will be made in the form of GO SHOP Points (subject to the terms of the Go Shop Club Rewards Programme) only upon successful clearance of the payment details presented to GO SHOP.

    GO SHOP shall be entitled at its discretion to revise, add or change the Payment Methods at any time and from time to time without notice. Customers are advised to either view GO SHOP TV, the Site or call GO SHOP’s hotline number for further details on the Payment Methods.

    b) All successful payments made by a Customer via Cards or EPP will be confirmed and notified by GO SHOP upon purchase by a Customer for an Order. In addition, an email confirmation together with a sales invoice which also serves as a receipt of payment will be sent to a Customer’s email, if any and Customers who have not registered an email with GO SHOP are encouraged to check the status of an Order through the Site (in particular GO SHOP’s website at www.goshop.com.my or via GO SHOP mobile application) or by calling GO SHOP’s hotline number and speak to a Personal Go Shopper. A copy of the said sales invoice will also be provided to the Customer upon delivery of the Product save that GO SHOP shall be entitled to revise, change or amend this provision at its absolute discretion without notice.

    c) In the event GO SHOP shall discover any fraud, an attempt at deception or in the event of the suspicion of other illegal activities in connection with any payment made by any Customer in relation to any Product then GO SHOP shall be entitled to without limitation to any rights or legal remedies of GO SHOP herein, require a different means of payment from the Customer, or to refuse, cancel or reject an Order and/or close a Customer’s Account.

    5. DELIVERY

    a) GO SHOP is entitled at its sole discretion at any time from time to time to appoint any third party (“Delivery Provider” which definition may include a Business Partner or its authorized personnel) to carry out logistics and delivery services including without limitation to deliver a Product to a Customer without giving notice of the same to the Customer. For certain Products that require installation, installation of the Product will be carried out upon delivery. Customers are advised to call GO SHOP’s hotline number and speak to a Personal Go Shopper on Products that require installation, if any.

    b) The Customer shall notify Personal Go Shopper if he/she intends to authorize a third party to receive delivery of the Product ordered and shall if requested by GO SHOP or the Delivery Provider, provide an authorization letter to GO SHOP or the Delivery Provider at the point of delivery for identification and verification purposes.

    c) Subject to the terms herein, delivery of the Products shall only be available to designated areas in Malaysia (which may be revised from time to time by GO SHOP at its discretion) (“Designated delivery areas”) and to the address specified by the Customer in an Order, provided that such address falls within the Designated delivery areas. Customers are advised to check at the point of placing an Order, the Designated delivery areas and GO SHOP shall be entitled to reject any delivery which is not within the Designated delivery areas.

    d) The delivery hours are within 9.00 am to 6.00 pm on a Business Day (“Delivery Hours”) subject to any revision as shall be determined by GO SHOP at its absolute discretion as it deems fit and GO SHOP shall not be liable to any Customer for such revision. Any request for deliveries after the Delivery Hours is subject to the discretion of GO SHOP and additional charges may apply. Customers are advised to call GO SHOP’s hotline number if he/she wishes to request for a specific delivery date and time at the time of placing an Order subject to the availability of the Delivery Provider.

    e) Subject to the terms herein, any Order placed before 3.00pm on a Business Day will be subject to the following delivery periods:
    i) For deliveries within Peninsular Malaysia, Products will be delivered between 2 to 7 Business days.
    ii) For deliveries within East Malaysia, Products will be delivered within 14 to 21 Business days.
    iii) For Products that consist of bulky items and/or that which require installation, delivery periods may vary.

    Orders placed after 3.00pm on any day shall be considered as orders which are placed on the following Business Day. Notwithstanding the above, the delivery periods may be changed and revised from time to time by GO SHOP as it deems fit at its absolute discretion and GO SHOP shall not be liable to any Customer for delay due to reasons beyond its control.

    f) GO SHOP will inform the Customer if it is unable to meet an estimated delivery date or time or delivery period. In the event a Customer is not present at the address upon delivery then attempts will be made to fulfill the delivery and the Customer shall inform GO SHOP’s call center to re-schedule the delivery. If the Customer fails to take delivery of any Product after the third (3rd) attempt for delivery for any reason (otherwise than by reason of any cause beyond the Customer's reasonable control or by reason of GO SHOP's fault) then without prejudice to any other right or remedy available to GO SHOP, GO SHOP is entitled to cancel the Order and refund any payment made by Customer back to the Customer.

    g) Risk of damage to or loss of the Products shall pass to the Customer at the time of delivery or if the Customer wrongfully fails to take delivery of the Products at the time when GO SHOP or the Delivery Provider has tendered delivery of the Products. Notwithstanding delivery and the passing of risk in the Products, the property and ownership in the Products shall not pass to the Customer until GO SHOP has received payment in full of the price of the Products in an Order. To the extent permitted by law, GO SHOP shall not be liable to any Customer for any losses, liabilities, costs, damages, charges and/or upon passing of risk to Customer.

    Customers are advised to call the GO SHOP’s hotline number and speak to a Personal Go Shopper or browse the Site for further details on delivery terms before placing an Order for any Product.

    6. EXCHANGE/ RETURNS /CANCELLATION /REFUNDS

    a) EXCHANGES / RETURNS
    All Product exchanges and/or returns (including any repairs, damage, wrong delivered items), are subject to the following conditions:
    i) Subject to the remaining terms of this Section 6, Customers can request for exchange or return of a Product within TEN (10) calendar days (“Returns Period”) from the date of the Customer’s receipt of the delivered Product (“Date of Product Receipt”). Customers are advised to perform checks on the spot upon receipt of a Product to ensure it is not damaged or defective. A Customer’s request for exchange or return of the same Product shall not exceed Three (3) times (provided that the first request must be made within the Returns Period) and in any event no later than sixty (60) days from the first Date of Product Receipt, subject to the remaining terms in this Section 6(a).

    ii) Requests for any returns and/or exchange during the Returns Period may be requested by a Customer via these methods:
    A) by calling in to GO SHOP’s hotline number and seeking the assistance of the Personal Go Shopper or through GO SHOP’s website; OR

    B) self-return service (“Self Return Service”) by Customer via d rop-off at specific collection points determined by GO SHOP at its absolute discretion (“Collection Points” or “Collection Point” the list of which can be found on GO SHOP’s website at www.goshop.com.my) SUBJECT TO the following terms:
    • Prior to any d rop-off at a Collection Point, Customer must request for self-return by logging into the Customer’s account online via GO SHOP’s website at www.goshop.com.my OR via such manner determined by GO SHOP from time to time. Only s elected Products (“Selected Products” which definition forms part of the definition of Product) may be d ropped off at a Collection Point and Customers are required to s elect the nearest Collection Point available and take note of the collection hours. Customers are advised to refer to www.goshop.com.my for full details on the Self Return Service.
    • All Selected Products returned by a Customer under this Self Return Service must comply with the terms and conditions on exchanges/returns under this Section 6. GO SHOP and/or its servants, agents and authorized representatives including its Delivery Providers are entitled at its discretion to reject any Selected Product submitted by any Customer at a Collection Point for failure to comply with the required terms and conditions.
    • Customer acknowledges that in using this Self Return Service, it shall not hold GO SHOP liable for any costs or expenses incurred by Customer including without limitation, travel costs and costs incurred for any failed attempt to d rop off any Product at a Collection Point,
    • All terms in relation to the return of a Selected Product under the Self-Return Service shall be subject to the other provisions under these Terms and Conditions unless otherwise specified.

    iii) During the Returns Period, all exchanges or returns of any Product are collected or re-delivered by GO SHOP free of charge. After the Returns Period, GO SHOP shall be entitled to charge Customers a collection cost which shall be paid by the Customer to the Delivery Provider at the point of collection.

    iv) Unless decided otherwise by GO SHOP at its absolute discretion, requirements for exchanges or returns shall be subject to the following conditions failing which no returns or exchanges shall be allowed:
    • All Products (including any free gifts or free promotional items and warranty cards (if any) associated with the purchase) must be in their original packaging with all tags, accessories, sales invoice and warranty card (if any) enclosed and where any seal is attached, such seal must not be broken.
    • Undergarments and inner wear cannot be exchanged or returned for any reason whatsoever.
    • Perishable items (food or fresh produce) and cosmetic items (body care & skin care, makeup) cannot be returned nor exchanged if they have been partially consumed or used.
    • Fashion items (including shoes and accessories) can be exchanged due to issues relating to color and size. However, if items returned for exchange are soiled, damaged or shows some form of wear and tear, no exchange or return will be considered.
    • Subject to product warranty conditions, digital items (such as Smart TVs, tablets, phones, photo printers, digital cameras) cannot be exchanged or returned if the original seal is broken OR if there is no seal and the original packaging is opened.
    • No Product may be exchanged or returned if it is specified in the warranty card that no exchanges or returns are allowed.
    • All Products must be cleared of any defects or damage to the reasonable satisfaction of GO SHOP and/or Business Partners and/or /supplier/manufacturer of Product before any exchange or returns of Products are completed or accepted by GO SHOP.

    v) Notwithstanding anything to the contrary, GO SHOP shall have the absolute discretion to decide on what Products (including Selected Products under the Self Return Service) that may be exchanged or returned. Customers are advised to call GO SHOP’s hotline number to speak with the Personal Go Shopper on the full list of items or check the Site for further details.

    vi) During the Returns Period, requests for exchange or returns to GO SHOP are allowed for defective Products which are still within any valid warranty period subject to the Product warranty conditions and applicable laws. After the Returns Period, requests for exchange or returns for defective Products must be addressed directly to the supplier or manufacturer (at their service center stated in the warranty card) provided that the warranty period for a Product is still valid. Where the service center of the supplier or manufacturer is not specified, then GO SHOP may, at its sole discretion, and at the request of the Customer, collect the Product free of charge from the Customer and deliver the Product back to the supplier or manufacturer on behalf of the Customer. For avoidance of doubt, a Customer is not entitled to any exchange or returns after the expiry of the warranty period of the Product.

    b) CANCELLATION/REFUNDS
    Notwithstanding the terms of this Section 6(a) above, cancellation and refunds on returns requested for any Product during the Returns Period shall subject to the following conditions:
    i) Customers may cancel an Order prior to confirmed delivery of a Product and request for a refund if payment has been made (other than COD). Cancellation may be done by contacting any Personal Go Shopper. For avoidance of doubt once a Product has been confirmed for delivery and/or delivered and received by a Customer, the Order cannot be cancelled.
    ii) Requests for refunds and the process of refunds will be subject to the terms on exchange and returns in Section 6(a) above and refunds will be processed after the successful clearance of any defects or damage on the returned Product to the reasonable satisfaction of GO SHOP. Customers may contact GO SHOP for full details of such refund. Depending on the method of payment, refunds including the time frame of refunds are also subject to the terms imposed by the issuing bank.

    c) For avoidance of doubt, unless otherwise stated herein, no request for exchange or returns or cancellations or refunds on a Product may be made by Customers after the Returns Period and the decision of GO SHOP with regards to this shall be final and binding.

    7. WARRANTIES

    a) GO SHOP will take reasonable steps to have all Products screened and inspected by GO SHOP’s Business Partner who shall ensure that the Products are of the standard, quality, composition, style or model that they represent and as presented, displayed and broadcasted on GO SHOP TV. GO SHOP does not take any responsibility for any inaccuracy or error in the presentation, display and broadcasting of such information. GO SHOP binds itself only to exercise reasonable care when delivering the Products in accordance with the general description under which they were sold, whether or not any special or particular description shall have been given or shall be implied by law. Any such special or particular description shall be taken only as the expression of GO SHOP's opinion in that regard.

    b) Subject to Section 8 below, GO SHOP does not make any express or implied warranties, representations or endorsements including but not limited to any warranties of title, non-infringement, merchantability, usefulness, operation, completeness, accuracy, satisfactory quality, reliability or fitness for a particular purpose, in respect of any Product sold to a Customer (and/or any free gift or promotional items given in relation to any such Product), the material, information and/or functions therein and expressly disclaims liability for all errors and omissions in such materials, information and/or functions.

    8. LIABILITY AND INDEMNITY

    a) To the full extent allowed by applicable law, the Customer agrees that GO SHOP will not be liable to a Customer/or any third party for any claims against GO SHOP for consequential or incidental loss and damages (including but not limited to loss of revenue, loss of profits, loss of goodwill, loss of reputation, loss of anticipated savings, wasted expenditure, loss of privacy and loss of data) or any other indirect, special or punitive damages whatsoever that arise out of or are related to any Product sold (including free gifts or promotional items given in relation to any such Product) by GO SHOP.

    b) GO SHOP shall further be under no liability in respect of : a) any allergies or other health or medical condition suffered by a Customer; and b) any defect to any Product, arising from unsuitable or improper use, defective installation or commissioning by the Customer or third parties, fair wear and tear, willful damage, negligence, abnormal working conditions, defective or negligent handling, improper maintenance, excessive load, unsuitable operating materials and replacement materials, poor work, unsuitable foundation, chemical, electro-technical/electronic or electric influences, failure to follow instructions (whether oral or in writing) misuse or alteration or repair of the Product, addition and i nsertion of parts, in particular of spare parts which do not come from GO SHOP without the approval of GO SHOP. In this connection, the Customer shall indemnify GO SHOP against each loss liability and cost arising out of such claims.

    c) The Customer shall indemnify and hold harmless GO SHOP, its subsidiaries and affiliates from any claim or demand, or actions made by any third party due to or arising out of the Customer’s breach of these Terms and Conditions.

    d) To the extent permitted by law, GO SHOP’s total liability to the Customer or any third party in respect of any cause of action, shall in no circumstances exceed, in aggregate, a sum equal to 100% of any aggregate amount paid by the Customer in respect of the relevant Products.

    e) Nothing in this Terms and Conditions shall exclude or limit our liability for (i) fraud; (ii) any breach of the consumer guarantees relating to the supply of products and/or services which cannot be excluded or limited pursuant to the Consumer Protection Act 1999; and (iii) any other liability which cannot be excluded or limited under any applicable law.

    9. GENERAL TERMS

    a) GO SHOP shall not be liable for any breach of its obligations under these Terms and Conditions where it is hindered or prevented from carrying out its obligations by any event of force majeure or cause outside its reasonable control, (or by any damage caused by any of such events).

    b) These Terms and Conditions constitute the entire agreement between the parties with respect to the subject matter hereof and shall be read with GO SHOP’s Terms and Conditions of Use and in the event of any inconsistencies the terms and conditions herein shall prevail

    c) These Terms and Conditions shall be governed in all respects by the laws of Malaysia and the parties shall submit to the exclusive jurisdiction of the Malaysian courts.

    d) If any provision herein is held to be invalid or unenforceable, that provision shall be struck and the remaining provisions shall be enforced.

    f) Any communication or notice to GO SHOP should be in writing to GO SHOP’s address stated on GO SHOP’s invoice. All correspondence and notices by GO SHOP to the Customer will be sent in writing to the most recent mailing address provided by the Customer to GO SHOP upon registration or via email to the email address provided by the Customer. Notices will be considered to be received upon hand delivery or upon the fifth working day after posting or upon successful delivery of the email.

  • 1. GENERAL


    a) The Terms and Conditions of Use herein ("TOU") shall apply to your use of the Home Shopping Platform. Before using the Home Shopping Platform, you must read carefully this TOU. By accessing, viewing, browsing and/or using the Home Shopping Platform you agree to accept and be bound by this TOU which may be posted by GO SHOP on the Home Shopping Platform from time to time.


    b) GO SHOP reserves the right, to change, modify, add, or remove portions of this TOU at any time without notice. All such changes, modifications and amendments are effective once they are posted on the Site or notified by GO SHOP. The continued usage of the Home Shopping Platform following such changes to these TOU constitutes your acceptance of those changes. In the event you do not agree to the amended TOU, you must not continue to access, view, browse and/or use the Home Shopping Platform.


    c) For avoidance of doubt, the terms and conditions governing any person who has registered with GO SHOP as a customer will be governed by the GO SHOP Customer Terms and Conditions and GO SHOP Privacy Notice (all of which can be found on the Site). The GO SHOP Privacy Notice also applies to any personal data collected used or stored by GO SHOP and further by accessing and using the Home Shopping Platform, you consent and agree to the terms specified in the GO SHOP Privacy Notice and all our actions taken in respect with your personal data consistent with the GO SHOP Privacy Notice.


    d) All materials and information provided on the Home Shopping Platform including without limitation images, photographs, pictures, recordings, text, statements, graphics, data, logos, graphics, sound, programs, audio, video, links or other items and any other material and information (collectively “Content”) are provided on an "as is" and "as available" basis. References to such Content include the material and information provided by third parties. Subject to applicable law, GO SHOP reserves the right to change, rearrange, add, d elete or otherwise modify any Content presented on the Home Shopping Platform at any time, with or without prior notice to you, including changing, rearranging or otherwise modifying without limitation the programs, advertisements, schedules that are presented or broadcasted on GO SHOP TV.


    e) Definitions:


    Astro” means Astro Malaysia Group, and includes all its related companies including without limitation MEASAT Broadcast Network Systems Sdn Bhd (Company Number 240064-A), a satellite and cable TV service operator which provides data, high definition format services, recording services, pay-per-view, premium/special events, near video on demand, interactive and other special services (including paid packages of television and radio channels);


    Business Partners” means the business partners of GO SHOP whose products and/or services are featured, advertised, promoted or offered for sale on the Home Shopping Platform including without limitation suppliers, vendors, sellers, merchants and other third parties;


    "Customer/Customers” means a registered Customer of GO SHOP as defined under GO SHOP’s Customer Terms and Conditions;


    GO SHOP” means the home shopping business operated by Astro GS Shop Sdn Bhd (Company Number 1081077-X) a company incorporated in Malaysia and having its registered address at 3rd Floor, All Asia Broadcast Centre, Technology Park Malaysia, Lebuhraya Puchong-Sungai Besi, Bukit Jalil, 57000 Kuala Lumpur, Malaysia, and which operates on the Home Shopping Platform to provide a venue for Customers to access, view, browse, and/or place an order for any Product;


    "GO SHOP Customer Terms and Conditions" means the Terms and Conditions applicable to GO SHOP’s Customers as defined therein;


    GO SHOP TV” means collectively the home shopping television channels and programs operated by GO SHOP which is currently available on Astro’s TV Channels via cable or satellite TV services including without limitation Astro Channels 118, 120 and 303 (subject to such changes from time to time) that features and offers Products for sale;


    Home Shopping Platform” means collectively GO SHOP TV and the Site and/or such other home shopping platforms, on ground locations or stores where GO SHOP shall advertise or sell or offer for sale the Products;


    "Product/Products" means any product/merchandise/offers/display items and shall include the Services that are uploaded /showcased/displayed/broadcasted and/or offered for sale on the Home Shopping Platform;


    "Site" means collectively GO SHOP’s website at www.goshop.com.my, m.goshop.com.my (mobile site/ mobile website) and/or any mobile applications/mobile interfaces applications/ apps and the services provided and/or social media platforms (including without limitation Facebook, YouTube, Instagram) which provides a venue / platform to the users of the Site and/or a Customer to access, view, browse or purchase the Products featured, showcased/displayed and/or offered for sale on the Site;


    Services” which means the services provided by GO SHOP in relation to any Products and/or services featured or offered for sale on its Home Shopping Platform including those offered for sale by any of the Business Partners;


    You/Your” means the person who uses the Home Shopping Platform and includes any Customer/Customers and any person accessing, viewing, browsing and/or the Home Shopping Platform.


    2. ACCEPTANCE OF TERMS


    a) You must be an individual person above the age of eighteen (18) years who is capable of entering into a legally binding agreement under Malaysian law and contacting GO SHOP for information on any of the Products and to use and access the features and services of this Site. You agree to notify us immediately whenever your personal or billing information changes (including, for example, your name, address, credit card and telephone number). You agree to comply with this TOU and all applicable laws, statutes and regulations regarding your use of the Home Shopping Platform and our Products featured or offered on the Home Shopping Platform.


    b) By using the Home Shopping Platform, you expressly accept and give your unconditional consent that we may use and/or disclose information about your demographics in any manner which does not reveal your identity for purposes of marketing, promotional, strategic development, research and customer care.


    c) You agree that GO SHOP TV is operated by GO SHOP via Astro’s satellite and cable television channel and where you are a subscriber of Astro, you shall also comply with the terms and conditions imposed by Astro on its subscribers.


    3. YOUR RESPONSILIBITIES AND CONDUCT


    a) You are personally responsible for your use of the Home Shopping Platform and you shall use at your own risk. You shall use the Home Shopping Platform in accordance with these TOU and any law at the time being in force in Malaysia including, but not limited to, the Malaysian Communications and Multimedia Act 1998 and the Malaysian Communications and Multimedia Content Code. GO SHOP reserves the right to remove any items that it deems in violation of the above, at its sole discretion.


    b) Where you agree and consent to provide any Information or personal data as specified in GO SHOP’s Privacy Notice to GO SHOP, you shall not provide and/or cause to be provided any information which:

    • is false, inaccurate or misleading;

    • violates or breaches any law;

    • is defamatory;

    • contains pornographic or obscene wordings and materials.

    • contains any computer viruses and/or other computer programming routines that may damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information;

    • introduces, spreads or is intended to introduce and/or spread contents or propaganda of religious, cultural or racist nature;

    • any other prohibited content as provided under applicable laws.


    "Information" referred to hereinabove includes but is not limited to any information (including personal data) provided by you to GO SHOP via its toll-free number to GO SHOP’s authorised personnel, information in any public message area (such as community forums, photo area and feedback area) or through electronic mail and social media.


    c) The Home Shopping Platform may not be available to all devices which connect to the Internet. You assume all responsibility regarding the end-user equipment and software necessary to access the Home Shopping Platform and assume all risk associated therewith.


    d) The Home Shopping Platform is provided to you for internal, non-commercial, personal use by you only. You may not allow any other person to: (a) resell, timeshare, sublicense, or otherwise transfer all or any portion of the Home Shopping Platform to any other party; or (b) make commercial use of the Home Shopping Platform without the express written consent of GO SHOP.


    e) You agree to use the Home Shopping Platform only for lawful purposes and for internal personal use only.


    f) You agree to abide by all applicable local, state, national and international laws and regulations and are solely responsible for all acts or omissions that occur under your usage, including the content of your communication to GO SHOP. Recognizing the global nature of the Internet, you agree to comply with all local rules regarding online conduct. Specifically, you agree to comply with all applicable laws regarding on-line communication in the country in which you reside.


    g) You will not use the Home Shopping Platform in any manner that could damage, disable, overburden, or impair the Home Shopping Platform (or the network(s) connected) or interfere with any other party's use and enjoyment of the Home Shopping Platform. You will not attempt to gain unauthorized access to the Home Shopping Platform and Customers’ accounts with GO SHOP, computer systems or networks connected to the Home Shopping Platform, through hacking, password mining or any other means. You will not obtain or attempt to obtain any materials or information through any means not intentionally made available through the Home Shopping Platform.


    h) You will not post or transmit through the Home Shopping Platform any defamatory, libelous, harassing, harmful, obscene, threatening, pornographic or otherwise illegal material or material which would violate or infringe in any way upon our rights or those of others (including intellectual property rights, rights of confidentiality, or rights of privacy) or cause distress or inconvenience. You must not express opinions that are crude, racist sexist, vulgar, or otherwise offensive. You will always treat other users with respect and will not interfere with other users’ use or enjoyment of the Home Shopping Platform.


    i) You will not post or otherwise make available on the Home Shopping Platform any material, which you do not own without the express permission of the owner of the material.

    j) You will not broadcast, copy, download, frame, reproduce, republish, transmit in any manner whatsoever, any material and/or Content on the Home Shopping Platform except as is strictly necessary for your own personal non-commercial home use.


    k) You will not do anything that affects the operability or security of the Home Shopping Platform or causes unreasonable inconvenience or offence or disruption to GO SHOP, its employees, servants or authorized personnel.


    4. TERMINATION/ACCESS RESTRICTION


    a) Without limiting anything herein contained, GO SHOP reserves the right at its sole discretion to terminate any one of the Home Shopping Platform and your use and access to any one of the Home Shopping Platform at any time without notice and for any reason.


    c) In addition to any termination rights GO SHOP may have under this TOU, GO SHOP may suspend your use and/or access to any one of the Home Shopping Platform without notice and in its sole discretion if:

    i) if you commit or perform fraudulent activities or fraudulent activities are performed by third parties under a Customer’s Account or GO SHOP suspects fraudulent use of any one of the Home Shopping Platform ((“fraudulent activities” or “fraudulent use” of an Account may include but is not limited tounauthorised access to or by third parties of a Customer’s e-mail address and password, entering invalid or apparently invalid user information for the Account, or attempting to register for free, trial, or promotional offers under several aliases or with different user information to circumvent any one-trial-per-user limitation or using another person’s banking account to pay for any order or such other illegal activities that breach or infringe applicable laws).

    ii) You materially violate this TOU or any notice posted from time to time on the Home Shopping Platform, any applicable law, rule or regulation relating to the use of the Products including without limitation carrying out illegal or criminal activities.

    iii) Any law, regulation, or governmental action renders all or any portion of the Home Shopping Platform (or your use of the Products) unlawful or impracticable.

    iv) Your use and access of the Home Shopping Platform impairs or threatens to impair the integrity or reputation, business and operations of GO SHOP in any manner whatsoever.

    v) GO SHOP, at its sole discretion ceases to offer any free, trial, or promotions for the Products, where such termination or suspension shall solely relate to such Products.

    vi) If GO SHOP believes that you have violated or acted inconsistently with the letter or spirit of this TOU.


    d) You agree that GO SHOP shall not be liable to you or any third-party for any termination and/or suspension of your use of any part of the Home Shopping Platform and/or access to the Home Shopping Platformor if you are a Customer, your account with GO SHOP.


    e) Information on the Home Shopping Platform may contain technical inaccuracies or typographical errors and may be changed or u pdated without notice. GO SHOP may also make improvements and/or changes to the Home Shopping Platform, at any time without notice. Your access to the Home Shopping Platform may occasionally be restricted to allow for repairs, maintenance or the introduction of new facilities or services to the Home Shopping Platform.


    f) The Home Shopping Platform may not be available to be accessed from all regions and countries of the world. GO SHOP reserves the right, in its sole discretion, to limit or terminate your ability to access the Home Shopping Platform from certain regions or countries, and you assume all risk associated with the accessibility of the Home Shopping Platform from any given region or country of the world.


    5. DISCLAIMER & LIMITATION OF LIABILITY


    a) GO SHOP makes no warranty or guarantees of any kind that the Home Shopping Platform will meet your requirement or that the Home Shopping Platform will be secure, timely, uninterrupted or error free, or that any Content found on the Home Shopping Platform, software or other material accessible on or through the Home Shopping Platform are true, accurate, or are free of viruses or other harmful components. In relation to the Site, you are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for accuracy of data input and output, and for maintaining a means external to the Site for the reconstruction of any lost data. All use of the Home Shopping Platform is at your own risk and you are solely responsible for all damages resulting therefrom.


    b) To the maximum extent permitted by applicable law, GO SHOP disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title and non-infringement with respect to the Home Shopping Platform the broadcasting and transmission of GO SHOP TV and transactions performed through the Products generally. GO SHOP makes no representations or warranties as to the quality of the call or any connection to or any transmission on the Home Shopping Platform, the incompatibility of the Home Shopping Platform with any of your equipment, software or telecommunication links, technical problems including errors or interruptions of the Home Shopping Platform, unsuitability, unreliability or inaccuracy or the inadequacy of the Home Shopping Platform to meet your requirements. GO SHOP also makes no representations or warranties as to the quality of the programs or any transmission over GO SHOP TV.


    c) To the fullest extent permitted by applicable law, under no circumstances, including, but not limited to, negligence, shall GO SHOP be liable for any direct, indirect, incidental, special or consequential damages, damages for loss of profits (even if GO SHOP has been advised of the possibility of such damages or even if such damage is foreseeable), loss of anticipated savings, wasted expenditure, loss of privacy, loss of data, that result from the use of or the inability to use the Home Shopping Platform, any changes to the Home Shopping Platform and unauthorized access to or alteration of your transmissions or data, any communication, transmission, material or data sent or received or not sent or received, or any transactions entered into through the Home Shopping Platform or arising in connection with the fraudulent or unlawful acts of any third party.


    d) You specifically agree that GO SHOP is not responsible or liable for any threatening, defamatory, obscene, offensive or illegal content or conduct of any other party or any infringement of another's rights, including intellectual property rights.


    e) If you are dissatisfied with the Home Shopping Platform, the materials available on or through the Home Shopping Platform or with the provisions of this TOU, you agree that your sole and exclusive remedy is to discontinue using the Home Shopping Platform.



    f) GO SHOP will take reasonable measures to maintain the privacy and security of all private information provided by you, but third parties (such as hackers) may breach or attempt to breach GO SHOP's security measures or may gain unauthorized access to the GO SHOP database or other equipment containing your information. You agree that GO SHOP shall not be liable for damages of any sort, whether arising under contract, tort, or otherwise, with respect to any breach of security of the Home Shopping Platform or any other company equipment or user information.


    g) Information on the Home Shopping Platform may contain technical inaccuracies or typographical errors and may be changed or u pdated without notice. GO SHOP may also make improvements and/or changes to the Home Shopping Platform, at any time without notice. Your access to the Home Shopping Platform may occasionally be restricted to allow for repairs, maintenance or the introduction of new facilities or services.


    h) The Home Shopping Platform may not be available to be accessed from all regions and countries of the world. GO SHOP reserves the right, in its sole discretion, to limit or terminate your ability to access the Home Shopping Platform from certain regions or countries, and you assume all risk associated with the accessibility of the Home Shopping Platform from any given region or country of the world.


    i) GO SHOP reserves the right to limit or prohibit your entry into the Home Shopping Platform in its sole discretion and shall not be liable for such limitation or prohibition.


    j) GO SHOP shall not be held responsible for (i) any loss, damage or harm which you may or will suffer or incur as a result of the terms and conditions applying to any contract entered into by you with any GO SHOP’s Business Partners whose products and/or services are featured on the Home Shopping Platform; or (ii) for any acts, omissions, errors or defaults of any Business Partner in reference to those terms and conditions, in respect of any product or services purchased by you from the Business Partner via the Products offered by GO SHOP on the Home Shopping Platform.


    6. INDEMNITY


    You agree to indemnify, defend and hold GO SHOP, its subsidiaries and affiliates and any third-party information providers to the Home Shopping Platform harmless from and against all losses, liability, expenses, damages and costs, including legal fees, resulting from any violation by you of this TOU or asserted by any third party due to or arising out of your use of or conduct on the Home Shopping Platform including the use of or conduct on the Site by a third party through your password or where you are a Customer, your account with GO SHOP.


    7. LINKS TO THIRD PARTY SITES

    a) The Site may contain links to third party websites, resource and advertisements (collectively "Linked Websites"). You agree that Linked Websites are necessary for GO SHOP to provide the Products. Such Linked Websites are provided to you only as a convenience. GO SHOP shall not be responsible if any of the Linked Websites is not working appropriately. If you decide to access and use any of the Linked Websites, you do so entirely at your own risk.


    b) You agree that GO SHOP shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any content, advertisement, product and/or services available on or through any such Linked Websites. The purchase of any product or service from a merchant, seller, vendor or supplier (collectively “Merchant”) from a Linked Website is a transaction solely between you and that Merchant, and any question or dispute you may have regarding any such product or service should be addressed directly to the responsible Merchant. GO SHOP has no responsibility or liability for any Merchant or your relationship with such Merchant.


    8. DISCLOSURE AND CONFIDENTIALITY


    a) GO SHOP reserves the right to disclose any personal information about you or your use of the GO SHOP Service and without your prior permission if GO SHOP in good faith, believes that such action is necessary to: (1) conform to legal requirements or comply with legal process; (2) protect and defend the rights or property of GO SHOP or its holding or affiliated company; (3) enforce this TOU; or (4) act to protect the interests of its members or others.


    b) Any non-personal information or material sent to GO SHOP by you will generally NOT be treated as confidential. For further details on use and disclosure of your personal information please see GO SHOP’s Privacy Notice posted on the Site, which is incorporated into and forms part of this TOU.


    9. PROPRIETARY RIGHTS


    a) COPYRIGHT

    i) All Content found on the Home Shopping Platform are protected by trademark, copyright, or other intellectual property laws and international treaties. Any commercial use of and Content found on the Home Shopping Platform, including any reproduction, modification, copying, distribution or use of any of the materials and Content of the Home Shopping Platform, is strictly prohibited, without GO SHOP's express and prior written consent. Any reproduction or redistribution of the Content found on the Home Shopping Platform is expressly prohibited by law, and may result in severe civil and criminal penalties.


    ii) Content found on the GO SHOP TV are provided on an "as is" and "as available" basis. References to such Content contained on GO SHOP TV include the material and information provided by third parties. Subject to applicable law, GO SHOP reserves the right to change, rearrange, add, d elete or otherwise modify any Content presented on GO SHOP TV at any time, with or without prior notice to you, including changing, rearranging or otherwise modifying without limitation the programs, advertisements, schedules that are presented or broadcasted on GO SHOP TV.


    iii) Elements of the Home Shopping Platform, its design and layout are protected by trade dress and other laws and may not be copied or imitated in whole or in part.


    iv) No Content from the Home Shopping Platform may be copied or retransmitted unless expressly permitted in writing by GO SHOP.


    b) GRANT OF LICENSE AND RESTRICTIONS

    i) You acknowledge and agree that any necessary intellectual property including the Content used in connection with the Home Shopping Platform contain proprietary and confidential information that is protected by applicable intellectual property and other laws. GO SHOP reserves all rights not expressly granted herein, including without limitation ownership and proprietary rights.


    ii) You may not copy the Content to any other server or location for further reproduction or redistribution. You may not reverse engineer, decompile, disassemble or modify the Content, except insofar as such restriction is prohibited by law. Any reproduction or redistribution of the Content is expressly prohibited by law, and may result in severe civil and criminal penalties. Violators will be prosecuted to the maximum extent possible.


    iii) GO SHOP is the owner or the licensee of all intellectual property rights in the Home Shopping Platform, and in the Content broadcasted, displayed and/or published on the Home Shopping Platform. The Content is protected by copyright laws and treaties around the world. All such rights are reserved. If you print off, copy or download any part of the Content on the Home Shopping Platform without GO SHOP’s consent, we shall be entitled to demand from you to return or destroy any copies of the materials you have made.


    c) TRADEMARKS AND THIRD-PARTY MATERIALS

    GO SHOP reserves all rights in its corporate names, service marks, logos, trade names, trademarks, websites and domain names and any other intellectual property rights in relation to Go Shop or otherwise (collectively "Marks") and nothing in this TOU grants you the license to use such Marks. Additionally, other marks which appear on the Home Shopping Platform may be marks of third parties that are not affiliated with GO SHOP and you shall ensure that the intellectual property rights to such third-party marks are not infringed.


    d) Anything that you submit to the Home Shopping Platform and/or provide to us, including but not limited to, questions, reviews, comments, and suggestions (collectively, "Submissions") will become our sole and exclusive property and shall not be returned to you. In addition to the rights applicable to any Submission, when you post comments or reviews to the Site, you also grant us the right to use the name that you submit, in connection with such review, comment, or other content. You shall not use a false e-mail address, pretend to be someone other than yourself or otherwise mislead us or third parties as to the origin of any Submissions. We may, but shall not be obligated to, remove or edit any Submissions.


    10. MOBILE SERVICES


    a) The Content provided on the Site in particular mobile site/mobile website (“Mobile Services”) by GO SHOP and/or its content providers which includes without limitation messages, files, data, images, photographs, software, ring tones, pictures, logos, video clips, video streaming, live feeds, information on demand content (e.g. information about health, lifestyle, etc) and games or otherwise (collectively referred to as the "Mobile Content") that you may download or stream to your mobile device, personal media player, mobile gaming device or personal computer which is equipped with the necessary functions or applications to support the Mobile Content to be downloaded or streamed. We advise you to check with your respective mobile phone operator or Internet service provider on whether your device can support or is compatible to download, view and stream the Mobile Content.


    b) GO SHOP will not be responsible or liable for any problem, loss or damage of whatsoever nature suffered by you due to any delay and/or failure in receiving and sending a SMS/MMS as a result of any network, communication or system error, interruption and/or failure experienced by the participating mobile phone operators.


    11. COOKIES


    A “cookie” is an element of data that can be sent to your browser. Your browser may then store it on your system based on the preferences you have set on your browser. Cookies gather information about your operating system, including but not limited to browser type, and Internet Protocol (IP) address. GO SHOP may use this information to analyze traffic on the Site, in order to better serve you when you return to the Site. It is not our intention to use such information to personally identify a user. You have the option to configure your Internet browser to notify you when you receive a cookie, giving you the chance to decide whether to accept it. Further you have the option to block all cookies. Please note, however, that if you refuse or otherwise block cookies you may not be able to use all of the functionality available on the Site.


    12. GENERAL


    a) This TOU is governed by the laws of Malaysia, without reference to conflict of laws principles. Any dispute between you and GO SHOP regarding this TOU will be subject to the exclusive jurisdiction of the courts located in Malaysia and you expressly waive all defenses to jurisdiction.


    b) If there is any conflict or inconsistency between this TOU and the GO SHOP Customer Terms and Conditions, such conflict or inconsistency will be resolved in a manner most favorable to GO SHOP. However, if such conflict or inconsistency cannot be so resolved, the GO SHOP Customer Terms and Conditions will prevail over this TOU.


    c) GO SHOP's failure to insist upon or enforce strict performance of any provision of this TOU or GO SHOP’s failure to take immediate action for any breaches of the terms of this TOU shall not be construed as a waiver of any provision or right unless acknowledged and agreed to by GO SHOP in writing.


    d) GO SHOP may assign its rights and duties under this TOU to any party at any time without notice to you and this TOU shall be binding upon and inure to the benefit of each party's respective permitted successors and assignees.


    e) This TOU contain the entire understanding between the parties hereto with respect to the Home Shopping Platform. Neither the course of conduct between the parties nor trade practice shall act to modify any provision of this TOU.


    f) GO SHOP's performance of this TOU is subject to existing laws and legal process, and nothing contained in this TOU is in derogation of GO SHOP's right and obligation to comply with governmental, court and law enforcement requests or requirements relating to your use of the Home Shopping Platform or information provided to or gathered by GO SHOP with respect to such use.


    g) If any provision of this TOU is held invalid, the remainder of this TOU will continue in full force and effect, and if any provision(s) of the TOU is held by a court of competent jurisdiction to be contrary to law, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties with the other provisions remaining in full force and effect. This TOU shall not be construed against any party as the principal draftsperson hereof. A printed version of this TOU and any notice given in electronic form shall be admissible in judicial or administrative proceedings.


    h) Notices to you shall not be modified, except by an express modification by GO SHOP as described herein and may be made via either email or regular mail or by displaying notices or links to notices to you on the Site.


    i) This TOU shall be governed in all respects by the laws of Malaysia and the parties shall submit to the exclusive jurisdiction of the Malaysian courts.


    j) If any provision of this TOU is held to be invalid or unenforceable, that provision shall be struck and the remaining provisions shall be enforced.

    The Personal Data Protection Act 2010 (“the Act”) was introduced by the Government of Malaysia to regulate the processing of personal data in respect of commercial transactions. The Act, which generally applies to all companies and firms that are established in Malaysia, requires us to inform you of your rights in respect of your personal data that is being processed (or that is to be collected and further processed by us) and to also notify you of, among others, the purposes for the data processing. Astro GS Shop Sdn Bhd (1081077-X) (“AGSSB”, “we”, “us” or “our” and operating as “Go Shop”) is committed to the protection of your personal data. This Privacy Notice explains how AGSSB collects and processes your personal data in accordance with the Act.

    (A) CONSENT
    (i) Your personal data and other information that identifies you as an individual (such as name, postal address, e-mail address and telephone number) including sensitive personal data as defined in the Act (collectively, “Personal Data”) which you provide or have provided to us, including any additional information which you may subsequently provide, for the access, use or purchase of products and/or services advertised, featured, listed or sold by AGSSB whether or not on our home shopping platforms [collectively referred to as “Home Shopping Platform” that includes without limitation, AGSSB’s home shopping TV channel(s) on Astro, online on Go Shop’s website at www.goshop.com.my, m.goshop.com.my (mobile site/ mobile website) and/or any mobile applications/mobile interfaces applications/apps on social media (the Go Shop website(s), mobile site/mobile website and said mobile applications/mobile interfaces applications/apps may be collectively and/or individually referred to as the “Site”), ] may be processed and used by AGSSB.
    (ii) In order to process and use your Personal Data, your consent is required. If you do not consent to the processing of your Personal Data, we may not be able to process your Personal Data for any of the Purposes defined herein and/or we will not be able to process your access, use or purchase of products and/or services advertised, featured, listed or sold by AGSSB whether or not on the Home Shopping Platform and/or approve your application to be a registered customer of AGSSB. However, where you have provided your Personal Data to us, you shall be deemed to have consented to provide your Personal Data to us.
    (iii) Where a copy of this Privacy Notice is dispatched or notified to you, if we do not hear from you within fourteen (14) days from the date of dispatch or notification of this Privacy Notice to you, we shall presume that you have approved and consented for us to collect, handle and process your Personal Data in accordance with and in the manner as set out in this Privacy Notice, including for us to contact you for purposes of marketing our products and services. However, you may at any point choose to limit or withdraw your consent to our processing of your Personal Data at any time by contacting our call center whose contact details are as set out below.
    (iv) Your consent that is given pursuant to this Privacy Notice is additional to and does not supersede any other consent that you had provided to AGSSB with regards to processing of your Personal Data.

    (B) NOTICE AND CHOICE
    Your Personal Data may be used and processed by AGSSB for the following purposes (collectively “Purposes”):
    a) to administer, facilitate, assess and process your request for the access, use and/or purchase of our products and/or services advertised, featured, sold or listed by Go Shop and/or our business partners (including without limitation our suppliers, vendors, sellers, merchants, partners, collectively “Business Partners”) on the Home Shopping Platform or otherwise;
    b) to register you as a customer of AGSSB and/or to deal with, process and/or administer the account that you may open with us to facilitate your transactions or activities on the Home Shopping Platform;
    c) to process, assess and/or register (where any registration is required) your use of the Home Shopping Platform;
    d) monitoring, processing and/or tracking your use of the Site in order to provide you with a seamless experience, facilitating or administering your use of the Site, and/or to assist us in improving your experience in using the Site;
    e) carrying out your instructions or responding to any enquiry given by (or purported to be given by) you or on your behalf;
    f) to communicate with you, including to respond to your inquiries and/or requests for the purposes of administering and/or managing your use of the Home Shopping Platform, your account with us or any transactions made by you with us.     i) to process your application, orders and payment transactions, administering, facilitating, processing and/or dealing in any transactions or activities carried out by you on or through the Home Shopping Platform including implementing transactions and the supply of products and/or services to you that you have requested or purchased from Go Shop and/or our Business Partners;
    j) to carry out internal investigations, compliance, audit or security purposes including, without limitation, crime detection, prevention and prosecution;
    k) to conduct market surveys and trend analysis and/or development activities (including but not limited to data analytics, surveys and / or profiling) to improve our services and facilities in order to enhance any continued interaction between yourself and us in relation to the Home Shopping Platform, or to improve any of our products or services;
    l) to provide you with information on products and services of AGSSB, and/or Astro Malaysia Group and/or our Business Partners;
    m) to perform other legitimate business activities of AGSSB;
    n) to plan and implement any corporate transactions or proposals including without limitation, the purchase, sale, lease, merger or amalgamation or any other acquisition, disposal or financing of an organisation or a portion of an organisation or of any of the business or assets of an organisation;
    o) to implement and maintain our information technology systems, including to store and process Personal Data in computer databases and servers located within and outside Malaysia;
    p) to support and/or assist with the operation, administration, development or enhancement of AGSSB’s business, including that which may be contained in any terms and conditions applicable to the Home Shopping Platform;
    q) record-keeping purposes and producing statistics and research for internal and/or statutory reporting and/or record-keeping requirements, of AGSSB or of its affiliates/related corporations;
    r) where AGSSB considers that such use or disclosure of Personal Data is necessary to protect its interests, including to respond to any claims or legal process;
    s) for purposes of compliance with any applicable laws, regulations, court order or order of any regulatory body to which we are subject to comply;
    t) for such other purposes which support and/or assist with the operation, administration, development or enhancement of AGSSB’s business, including that which may be contained in any terms and conditions applicable the Home Shopping Platform;

    (C) DISCLOSURE AND TRANSFER
    (i) Disclosure of Personal Data - We may disclose your Personal Data to any one or more of the following classes of third parties:
    a) our related corporations (including the Astro Malaysia Group) and Business Partners;
    b) our licensees, consultants, advisors, contractors and service providers;
    c) persons authorized by you;
    d) any actual or proposed assignee or transferee of the business of AGSSB; and
    e) any other person to whom such disclosure is required by law or regulatory requirement or pursuant to a court order,
    notwithstanding that any such persons may be within or outside Malaysia, for (1) any of the above Purposes; or (2) any other purpose for which your Personal Data was to be disclosed at the time of its collection, or a purpose directly related to any such purpose.
    (ii) Provision of third party Personal Data - Should you provide AGSSB with Personal Data of individual(s) other than yourself, you represent and warrant to AGSSB and you hereby confirm that:
    a) prior to disclosing such Personal Data to us, you would have and had obtained consent from the individuals whose Personal Data are being disclosed to us, to:
    (1) permit you to disclose the individuals’ Personal Data to AGSSB for the Purposes; and
    (2) permit AGSSB to collect, use, disclose and/or process the individuals’ Personal Data for the Purposes, as set out in paragraphs (A) above;
    b) any Personal Data of individuals that you disclose to us is accurate; and
    c) you are validly acting on behalf of such individuals and that you have the authority of such individuals to provide their Personal Data to AGSSB and for AGSSB to collect, use, disclose and process such Personal Data for the Purposes.
    d) Without limiting the generality of the foregoing, should you make a purchase to be delivered to a third party recipient, you consent to us disclosing Personal Data that identifies you, to the said third party recipient (such as but not limited to your name). Further, you acknowledge and agree that delivery of your purchase could involve disclosure of certain Personal Data about you to bring about delivery of the same such as your name and contact details, which may be disclosed on the cover of the parcel, on an envelope or a delivery related document, as the case may be, which could be seen by third parties who view such parcel, envelope or said document.
    (iii) Transfer of Personal Data - Your Personal Data may also be transferred to locations outside Malaysia and stored in any server located in Malaysia or outside Malaysia, for any of the Purposes as stated in this Privacy Notice.

    (D) SECURITY
    We respect your privacy and take seriously the trust you place in us, and we follow strict guidelines for protecting the security of your Personal Data.     (ii) Untuk memproses dan menggunakan Data Peribadi anda, persetujuan anda diperlukan. Sekiranya anda tidak bersetuju dengan pemprosesan Data Peribadi anda, kami tidak dapat memproses Data Peribadi anda untuk mana-mana Tujuan yang ditakrifkan di sini dan/atau kami tidak akan dapat memproses aksess, penggunaan atau pembelian produk dan/atau perkhidmatan yang diiklankan, paparkan, senaraikan atau dijual oleh AGSSB sama ada atau tidak pada Platform Pembelian Dari Rumah anda dan/atau meluluskan permohonan anda sebagai pelanggan berdaftar dengan AGSSB. Bagaimanapun, sekiranya anda telah memberikan Data Peribadi kepada kami, anda akan dianggap telah memberikan persetujuan untuk membekalkan Data Peribadi anda kepada kami.
    (iii) Sekiranya sesalinan Notis Privasi ini telah dihantar atau dikemukakan kepada anda, dan sekiranya kami tidak mendapat maklumbalas daripada anda dalam masa tempoh empat belas (14) hari dari tarikh penghantaran atay pengemukaan Notis Privasi ini kepada anda, kami akan maklum bahawa anda telah meluluskan dan bersetuju kepada kami untuk mengumpul, mengendali dan memproseskan Data Peribadi anda selaras dengan kandungan Notis Privasi ini, termasuk untuk membolehkan kami menghubungi anda bagi tujuan memasarkan produk dan perkhidmatan kami.     (B) NOTIS DAN PILIHAN
    Data Peribadi anda boleh digunakan dan diproses oleh AGSSB bagi tujuan berikut (secara kolektif “Tujuan”)-:
    a) mentabdir, memudahkan, mengakses dan memproses permohonan anda untuk mengakses, mengguna dan/atau membeli produk dan/atau perkhidmatan kami yang diiklankan, dipaparkan,dijual atau disenaraikan oleh Go Shop dan/atau rakan kongsi perniagaan kami (termasuk tanpa terhad pembekal, penjual, pedagang, rakan kongsi, secara kolektifnya "Rakan Kongsi Perniagaan") di Platform Pembelian Dari Rumah ataupun sebaliknya;
    b) mendaftarkan anda sebagai pelanggan AGSSB dan/atau untuk menangani, memproses dan/atau mentadbir akaun yang akan dibukakan oleh anda dengan kami untuk memudahkan transaksi atau aktiviti anda pada Platform Pembelian Dari Rumah;
    c) memproses, mengakses dan/atau mendaftar (di mana pendaftaran diperlukan) penggunaan anda di Platform Pembelian Dari Rumah;
    d) pemantauan, pemprosesan dan/atau menjejaki penggunaan anda di Tapak untuk memberi pengalaman yang lancarkepada anda, memudahkan atau mentadbir penggunaan anda di Tapak ini, dan/atau membantu kami dalam meningkatkan pengalaman anda dalam menggunakan Tapak ini;
    e) melaksanakan arahan anda atau memberi maklum balas kepada sebarang pertanyaan yang diberikan oleh (atau kononnya diberikan oleh) anda atau bagi pihak anda;
    f) berkomunikasi dengan anda, termasuk menjawab pertanyaan dan/atau permintaan untuk tujuan mentadbirkan dan/atau menguruskan penggunaan anda pada Platform Pembelian Dari Rumah, akaun anda dengan kami atau sebarang transaksi yang dibuat oleh anda dengan kami. Anda mengakui dan bersetuju bahawa komunikasi sedemikian yang dibuat oleh kami boleh melalui surat-menyurat, dokumen atau notis kepada anda, yang mungkin melibatkan pendedahan Data Peribadi tertentu yang terlibat di dalam penghantaran sama serta pada penutup luaran sampul/pakej mel;
    g) memberikan perkhidmatan kepada anda sebagai pemegang akaun kami, sebagai pelanggan kami, atau apabila diminta oleh anda;
    h) berkongsi atau mendedahkan (mengikut budi bicara kami) cadangan, komen, maklum balas atau kandungan anda (termasuk audio, video dan sebagainya) (secara kolektif "Maklum Balas") yang anda membekalkan pada Platform Pembelian Dari Rumah, dengan pengguna lain pada Platform Pembelian Dari Rumah atau dengan orang awam. Ini termasuk pendedahan nama anda bersama-sama dengan Maklum Balas anda oleh kami. Jangan membekalkan Maklum Balas jika anda tidak mahu maklum balas tersebut didedahkan kepada orang awam. Sekiranya anda ingin memberikan komen atau Maklum Balas anda tanpa didedahkan kepada orang awam seperti yang tersebut di atas, sila hantar email kepada kumpulan perkhidmatan pelanggan kami di alamat e-mel yang terdapat di Tapak dan ketatkan subjek e-mel anda dengan perkataan "Sulit";
    i) memproses permohonan anda, transaksi tempahan dan pembayaran, mentadbir, memudahkan, memproses dan/atau berurusan di dalam transaksi dan aktiviti yang dijalankan oleh anda pada atau melalui Platform Pembelian Dari Rumah, termasuk melaksanakan transaksi dan membekalkan produk dan/atau perkhidmatan kepada anda seperti diminta oleh anda atau dibeli dari Go Shop atau/dan Rakan Kongsi Perkongsian kami.
    j) penyiasatan dalaman, pematuhan, audit atau tujuan keselamatan termasuk, tanpa limitasi, pengesahan jenayah, pencegahan dan pendakwaan;
    k) tinjauan pemasaran dan analisa trend dan/atau pembangunan (termasuk tetapi tidak terhad kepada analisis data, kaji selidik dan/atau pensyarah) untuk meningkatkan perkhidmatan dan kemudahan kami supaya meningkatkan interaksi yang berterusan antara anda dengan kami berhubung dengan Platform Pembelian Dari Rumah, atau memperbaiki mana-mana produk atau perkhidmatan kami;
    l) memberikan maklumat mengenai produk dan perkhidmatan AGSSB kepada anda dan/atau Kumpulan Astro Malaysia dan/atau Rakan Kongsi Perniagaan kami.
    m) aktiviti perniagaan sah lain yang dijalankan oleh AGSSB;
    n) merancang dan melaksanakan sebarang transaksi atau cadangan korporat termasuk tanpa had pembelian, penjualan, pajakan, penggabungan atau penyatuan atau lain-lain pemerolehan, pelupusan atau pembiayaan sesuatu organisasi atau sebahagian daripada sesuatu organisasi atau mana-mana perniagaan atau aset sesuatu organisasi;
    o) melaksanakan dan mengekalkan sistem teknologi maklumat kami, termasuk untuk menyimpan dan memproses Data Peribadi di dalam pangkalan data komputer dan penghidang fail (‘server’) berlokasi di dalam dan di luar Malaysia;
    p) untuk menyokong dan/atau membantu operasi, pentadbiran, pembangunan atau penambahbaikan perniagaan AGSSB, termasuk yang terkandung di dalam mana-mana terma dan syarat yang berkenaan pada Platform Pembelian Dari Rumah;
    q) tujuan untuk menyimpan rekod dan menerbitkan statistik dan penyelidikan untuk keperluan pelaporan dalaman dan/atau undang-undang dan/atau keperluan rekod, AGSSB atau syarikat sekutu/yang berkaitannya;
    r) di mana AGSSB mempertimbangkan penggunaan atau pendedahan Data Peribadi adalah perlu untuk memelihara kepentingannya, termasuk memberikan maklumbalas terhadap sebarang tuntutan atau proses perundangan;
    s) bagi tujuan pematuhan kepada sebarang undang-undang, peraturan, perintah mahkamah atau perintah dari mana-mana badan kawalselia yang berkenaan di mana kami adalah tertakluk untuk mematuhi ;
    t) bagi tujuan lain yang menyokong/membantu dalam operasi, pentadbiran, pembangunan atau peningkatan periagaan AGSSB, termasuk yang terkandung di dalam terma dan syarat Platform Pembelian Dari Rumah;
    u) AGSSB, syarikat-syarikat kumpulan Astro atau tujuan pelaporan korporat yang berkaitan termasuk tetapi tidak terhad kepada pelaporan atas prestasi perniagaan AGSSB
    v) di mana berkaitan, bagi tujuan lain yang bersampingan dan/atau berkaitan dengan mana-mana perkara di atas.

    (C) PENDEDAHAN DAN PEMINDAHAN
    (i) Pendedahan Data Peribadi - Kami mungkin akan mendedahkan Data Peribadi anda kepada satu atau lebih pihak atau kelas berikut:
    a) Perbadanan berkaitan kami (termasuk kumpulan Astro Malaysia) dan Rakan Kongsi Perniagaan;
    b) Pemegang lesen, konsultan, penasihat, kontraktor dan pemberi perkhidmatan kami;
    c) Individu yang diberikan kuasa oleh anda;
    d) Sebarang pemegang serah hak atau penerima pindahan kepada perniagaan AGSSB; dan
    e) Pihak lain berkaitan di mana pendedahan adalah perlu dari segi undang-undang atau keperluan kawalselia atau berikutan perintah mahkamah,
    walaupun individu berkenaan berada di dalam atau di luar Malaysia, untuk (1) sebarang Tujuan di atas; atau (2) sebarang tujuan lain di mana Data Peribadi anda didedahkan sewaktu pengumpulan, atau tujuan yang secara langsung berkait dengan tujuan tersebut.
    (ii) Peruntukan Data Peribadi Pihak Ketiga - Sekiranya anda membekalkan AGSSB dengan Data Peribadi individu selain diri anda, anda mewakili dan memberi kebenaran kepada AGSSB dan anda mengesahkan bahawa:
    (a) sebelum mendedahkan Data Peribadi berkenaan kepada kami, anda telah mendapatkan kebenaran daripada individu berkenaan di mana Data Peribadi telah didedahkan kepada kami untuk:
    (i) membenarkan anda mendedahkan Data Peribadi individu berkenaan kepada AGSSB untuk Tujuan; dan
    (ii) membenarkan AGSSB untuk mengumpul, menggunakan, mendedahkan dan/atau memproses Data Peribadi individu berkenaan untuk Tujuan, seperti dinyatakan di perenggan (A) di atas;
    (b) sebarang Data Peribadi individu berkenaan yang didedahkan oleh anda kepada kami adalah tepat; dan
    (c) anda dengan sah bertindak mewakili individu berkenaan dan anda berhak ke atas individu berkenaan untuk mengemukakan Data Peribadi mereka kepada AGSSB dan membenarkan AGSSB mengumpul, menggunakan, mendedahkan dan memproses Data Individu berkenaan untuk Tujuan yang dinyatakan di perenggan (A) di atas.
    (d) Tanpa mengehadkan keluasan yang disebut di atas, sekiranya anda membuat pembelian untuk dihantar kepada penerima pihak ketiga, anda bersetuju dengan kami mendedahkan Data Peribadi yang mengenali anda, kepada penerima pihak ketiga tersebut (seperti tetapi tidak terhad kepada nama anda). Selanjutnya, anda mengakui dan bersetuju bahawa penghantaran pembelian anda mungkin melibatkan pendedahan Data Peribadi tertentu yang mengenai anda yang terlibat di dalam penghantaran seperti nama dan butiran hubungan anda, yang boleh didedahkan di sampul bungkusan, pada sampul atau dokumen berkaitan penghantaran, mengikut mana yang berkenaan, yang boleh dilihat oleh pihak ketiga yang melihat bungkusan, sampul surat atau dokumen tersebut;
    (iii) Pemindahan Data Peribadi - Data Peribadi anda boleh juga dipindahkan ke lokasi di luar Malaysia dan disimpan di dalam penghidang fail (‘server’) yang berlokasi di dalam atau di luar Malaysia, bagi sebarang Tujuan yang dinyatakan di dalam Notis Privasi ini.

    (D) KESELAMATAN
    Kami menghormati privasi anda dan mengambil serious akan kepercayaan yang diberikan anda kepada kami, dan kami mematuhi sepenuhnya garispanduan untuk melindungi keselamatan Data Peribadi anda. Kami menggunapakai polisi dan prosedur untuk memelihara keselamatan Data Peribadi yang telah dikumpul, untuk mengekalkan ketepatan data, untuk memastikan penggunaan Data Peribadi dan untuk menghalang akses atau pendedahan maklumat yang tidak dibenarkan.

    (E) PENGEKALAN
    AGSSB mengekalkan Data Peribadi anda dalam rekod perniagaan kami untuk suatu tempoh setelah anda tidak lagi menjadi pelanggan kami atau menggunakan mana-mana produk dan/atau perkhidmatan atau pengguna Platform Pembelian Dari Rumah sekiranya Data Peribadi tersebut diperlukan bagi Tujuan di mana Data Peribadi tersebut dikumpul atau untuk memenuhi keperluan undang-undang.

    (F) INTERGRITI
    Kami akan mengambil langkah yang sewajarnya untuk memastikan Data Peribadi anda adalah tepat dan lengkap, jika Data Peribadi anda mungkin digunakan oleh AGSSB untuk membuat keputusan yang mempengaruhi anda, atau didedahkan kepada organisasi lain. Walau bagaimanapun, anda juga harus mengemaskini sebarang perubahan dalam Data Peribadi anda di mana anda telah membekalkan kepada kami pada mulanya. Kami tidak akan bertanggungjawab kerana bergantung pada Data Peribadi yang tidak tepat atau tidak lengkap yang timbul daripada atas tidak kemaskini oleh anda tentang sebarang perubahan dalam Data Peribadi anda di mana anda telah membekalkan kepada kami pada mulanya.

    (G) AKSES, PEMBETULAN, PERTANYAAN DAN ADUAN
    (i) Sepertimana tersebut di dalam Akta, anda mempunyai hak untuk mendapatkan akses dan membuat pembetulan kepada Data Peribadi yang dipegang oleh kami mengenai anda. Secara am dan tertakluk kepada pengecualian tertentu, anda boleh mengakses Data Peribadi anda, termasuk salinan, yang mana kami boleh mengenakan bayaran yang tertentu untuk tujuan tersebut.

    (ii) Anda boleh pada sebarang waktu membuat pertanyaan, aduan dan memohon untuk akses, atau membuat pembetulan kepada, Data Peribadi anda atau menghadkan pemprosesan Data Peribadi anda melalui pos berdaftar atau e-mel kepada alamat berikut:

    (iii) Anda boleh menghadkan pemprosesan Data Peribadi anda seperti berikut. Di mana berkaitan sebarang aktiviti pemasaran dan pengiklanan yang dijalankan oleh AGSSB pada masa hadapan, anda boleh membuat permohonan untuk dikeluarkan kepada AGSSB melalui notis bertulis (berikutan perenggan berikut) untuk tidak memproses Data Peribadi anda bagi sebarang perkara berikut:
    (a) pengiklanan atau pemasaran melalui telefon produk atau perkhidmatan AGSSB atau rakan kongsi perniagaan dan/atau perbadanan berkaitan;
    (b) menghantar kepada anda melalui pos atau e-mel bahan pemasaran atau pengiklanan berkaitan sebarang produk atau perkhidmatan AGSSB atau rakan Kongsi perniagaan dan/atau perbadanan berkaitan;
    (c) menghantar kepada anda melalui e-mel atau SMS sebarang bahan pemasaran atau pengiklanan berkaitan produk atau perkhidmatan AGSSB atau rakan kongsi perniagaan dan/atau perbadanan berkaitan; atau
    (d) berkomunikasi kepada anda produk atau perkhidmatan AGSSB atau rakan kongsi perniagaan kami melalui mana-mana saluran pemasaran atau pengiklanan atau yang mana berkaitan dengan rakan kongsi perniagaan dan/atau perbadanan berkaitan.

    PINDAAN DAN KEMASKINI ATAS NOTIS PRIVASI
    (i) Sebagai sebahagian daripada usaha kami untuk memastikan bahawa kami menguruskan, melindungi dan memproses Data Peribadi anda dengan betul, kami mungkin/akan mengkaji semula dasar, prosedur dan proses kami dari masa ke semasa.

    (ii) Notis Privasi ini boleh dipinda dari masa ke semasa. Sebarang pindaan kepada Notis Privasi ini akan disiarkan atau diterbitkan di Platform Pembelian Dari Rumah dan/atau disampaikan kepada anda melalui saluran yang ditentukan kami. Penggunaan berterusan produk dan/atau perkhidmatan Platform Pembelian Dari Rumah oleh anda akan ditafsirkan sebagai persetujuan anda kepada pemindaan Notis Privasi yang tersebut di atas.

These general terms and conditions for promotional codes (“General Terms and Conditions for Promo Codes”) applies to promotions (“Promotion” or “Promotions”) organized by Astro GS Shop Sdn Bhd (Company No. 1081077-X) (known as “AGSSB” and operating as “Go Shop”) covering the use of promotional codes, discount codes, voucher codes, and/or such other promotional codes that provide a discount price off (collectively “Promo Codes”) offered on Go Shop’s home shopping platforms (“Go Shop Platforms” including Go Shop TV on Astro Channels 118, 120 and 303, online at www.goshop.com.my and on mobile applications at m.goshop.com.my [both online and mobile applications shall be known as “Site”]) for the purchase of a Go Shop product (“Products) subject to terms and conditions.

    2. The Promotions are only applicable to registered customers of Go Shop (“Customer” or “Customers”). Registration as a Customer can be done by calling Go Shop’s hotline number 03-95441188 and getting the assistance of Go Shop’s call center agent (“Personal Go Shopper”) or online at www.goshop.com.my.

    3. Unless otherwise specified herein, the General Terms and Conditions for Promo Codes shall be read together with the conditions applicable for each Promotion and Promo Code during its promotional period organized by Go Shop which are found on Go Shop Platforms from time to time and with Go Shop’s Customer Terms and Conditions, Privacy Notice and all other relevant terms and conditions which can be found on Go Shop’s Site at www.goshop.com.my.     6. AGSSB reserves the right to change, revise or amend these General Terms & Conditions for Promo Codes and/or cancel, revise or reject any discounts or promotions in relation to the Promo Code at any time without notice and without any liability or compensation whatsoever to any Customer or any person or party. Any decision made by AGSSB in relation thereto shall be final and binding on all persons.

    7. AGSSB shall not be liable to any Customer and/or be liable to offer replacement of any Promo Codes, cash or otherwise compensate any Customer for expired, invalid, discontinued or cancelled Promo Codes; improper use of, or inability to redeem any Promo Code; or the inability to redeem a Promo Code due to technical issues.

  • 1. INTRODUCTION

    a) The Terms and Conditions herein (“GO SHOP K-Mall Terms and Conditions”) shall govern the rights, duties and responsibilities in relation to the order, sale and purchase of any Mall Product from the GO SHOP K-Mall. By visiting the GO SHOP K-Mall located on the Site and/or opening an Account and/or placing an Order to purchase any Mall Product from the GO SHOP K-Mall, Buyers are deemed to have read, accepted and agreed to be bound by these GO SHOP K-MALL Terms and Conditions. The terms herein shall be read with the GO SHOP Terms of Use and the GO SHOP Privacy Notice (located on the Site) before a Buyer provides any personal data to GO SHOP.

    b) The GO SHOP K-Mall webpage features the Mall Product where Buyers may purchase the Mall Product from the Seller which shall constitute a contract entered into directly between the Buyer and the Seller. GO SHOP may process the Buyer’s Order on behalf of the Seller including collecting payment on behalf of a Seller (subject to the terms herein) but is not a party to the contract with the Buyer and accepts no obligations in connection with any such contract. The Seller shall be entirely responsible for the contract with regards to the Mall Product including without limitation, product warranties and returns.

    c) GO SHOP reserves the right to amend, change, modify, add, d elete or remove any part of these GO SHOP K-Mall Terms and Conditions and the information provided to at any time it deems fit without notice. Changes will be effective after they are posted on the Site or notified by GO SHOP. The continued use of the GO SHOP K-Mall and/or purchase of Mall Products from GO SHOP K-Mall by a following such amendments, changes, modifications, additions, deletions or removal to these Terms and Conditions constitutes the ’s acceptance of those changes and the agrees to be bound by the same.

    d) Definitions:

    “Account” means a one-time registration account created by GO SHOP for purposes of transacting on the GO SHOP K-Mall and containing the information of the Buyer including without limitation name, address, telephone number and/or such other information as may be required for such registration;

    “Business Day (s)” means a day (s) on which commercial banks are open for business in Selangor (other than Saturdays, Sundays and public holidays);

    "Buyer/Buyers” means the person or persons who has opened and registered an Account and aged 18 years and above at the time of registration;

    “GO SHOP” means the home shopping business operated by Astro GS Shop Sdn Bhd (Company Number 1081077-X) a company incorporated in Malaysia and having its registered address at 3rd Floor, All Asia Broadcast Centre, Technology Park Malaysia, Lebuhraya Puchong-Sungai Besi, Bukit Jalil, 57000 Kuala Lumpur, Malaysia, and which operates on the Home Shopping Platform to provide a venue for Buyers to, inter alia, access, view, browse, and/or place an Order for any Mall Product;

    “GO SHOP K-Mall” means the webpage(s) or location(s) on the Site that features and offers Mall Products for sale by a Seller;

    “Home Shopping Platform” means the platforms where GO SHOP shall advertise or sell or offer for sale products, including the Mall Products and consists of the the Site that includes the GO SHOP K-Mall and/or such other platforms, on ground locations or stores;

    “Mall Product/Mall Products” means any product/merchandise/offers/display items that are featured/uploaded/showcased/displayed and/or offered for sale on the GO SHOP K-Mall by a Seller;

    "Order" or “Orders” means any order submitted or placed to GO SHOP to purchase a Mall Product;

    “Personal Go Shopper” means GO SHOP’s call center agent or such agent appointed by GO SHOP;

    Seller” means the third-party vendor whose products and/or services are featured, advertised, promoted or offered for sale on the GO SHOP K-Mall;

    "Site" means collectively GO SHOP’s website at www.goshop.com.my, mobile application at m.goshop.com.my (mobile site/ mobile website) and/or any other mobile applications/mobile interfaces applications/ apps and the services provided GO SHOP and/or social media platforms (including without limitation Facebook, YouTube, Instagram) which provides a venue / platform to the users of the Site and/or a to, inter alia, access, view, browse or purchase the Mall Products featured, showcased/displayed and/or offered for sale on the GO SHOP K-Mall;

    2. ACCOUNT REGISTRATION, ORDER ACCEPTANCE AND PRICING

    a) ACCOUNT REGISTRATION
    i) Prior to placing the first Order, a Buyer must carry out a one-time registration and creation of a new Account online on the Site. To register, a Buyer must be aged eighteen (18) years and above at the time of registration and have a designated local address in Malaysia. A Buyer must provide all relevant information required in the registration form on the Site, and a unique and valid e-mail address and password upon completing the Account registration process. Buyers must maintain and promptly u pdate such registration data to keep it accurate, current and complete. Upon registration as per the manner above, the Account will be created.

    ii) Buyers are responsible for maintaining the confidentiality of the password and e-mail address, and are fully responsible for all activities that occur under such password or e-mail address whether or not actually or expressly authorized and/or used by the Buyer. Buyers agree to immediately notify GO SHOP if any authorised third party has that password or if there is any unauthorized use of the Buyer’s email address or any breach of security known to the Buyer.

    iii) The Account is not transferable and may not be assigned to any third party. Buyers agree to: (1) notify GO SHOP immediately of any unauthorized use or any other breach of security, and/or (2) ensure that Buyers properly exit from the Account at the end of each session on the Site and the GO SHOP K-Mall webpage. GO SHOP cannot and will not be liable for any loss or damage arising from Buyers’ failure to comply with this provision.

    iv) Subject to the terms contained herein, GO SHOP reserves the right, in its sole discretion and without notice, to decline a new Account OR to suspend, cancel or terminate an existing Account at any time in any of the following circumstances:
    1) if any Buyer provides any information that is untrue, false, inaccurate, not current or incomplete or if GO SHOP has reasons to believe that such information is untrue, false, inaccurate, not current or incomplete; and/or
    2) if any Account is dormant and has not been used for a period of six (6) months or longer; and/or
    3) if a Buyer breaches any of these Terms and Conditions, and/or the GO SHOP Terms and Conditions of Use and/or the GO SHOP Privacy Notice; and/or
    4) if any Buyer commits or performs fraudulent activities or fraudulent activities are performed by third parties under the Buyer’s Account or if GO SHOP suspects fraudulent use of the Buyer’s Account (“fraudulent activities” or “fraudulent use” of an Account may include but is not limited to unauthorised access to or by third parties of a Buyer’s e-mail address and password, entering invalid or apparently invalid user information for the Account, or attempting to register for free, trial, or promotional offers under several aliases or with different user information to circumvent any promotional offer or using another person’s banking account to pay for any Order or such other illegal activities that breach or infringe applicable laws); and/or
    5) if any Buyer commits any act or if GO SHOP has reasons to believe that the Buyer has committed any act that affects or damages the reputation of GO SHOP or a Seller.

    v) Upon any termination of an Account, the Buyer shall immediately cease all access to and use of the Home Shopping Platform including the GO SHOP K-Mall and GO SHOP may, in addition to any other legal or equitable remedies, immediately cancel the Account and deny access to and use of the Home Shopping Platform to the Customer in whole or in part. Any termination of an Account shall not affect the respective rights and obligations (including without limitation, payment obligations of the Buyer) of the parties arising before the date of termination.

    vi) A Buyer may terminate and close the Account by e-mailing to GO SHOP at the email address specified on the Site or as u pdated from time to time and the email must specify Buyer’s e-mail address, name and address and expressly state that Buyer’s wish to terminate and/or close the Account.

    b) ORDER ACCEPTANCE AND PRICING
    i) To place an Order, a Buyer must have a valid and subsisting Account. All Orders shall be subject to Seller’s acceptance in their sole discretion and GO SHOP shall be entitled to process such Orders on behalf of the Seller. Seller and/or GO SHOP reserves the right to accept, refuse, cancel or reject or process any Order from any Buyer and Buyers may be asked to provide additional verifications or information before an Order is accepted.

    ii) Order acceptance and completion will only be completed upon issuance of confirmation by GO SHOP to the Buyer Save for processing an Order, GO SHOP does not have possession of anything listed or sold through the GO SHOP K-Mall and is not involved in the purchase transaction of any Mall Product, which shall be solely between the Buyer and Seller.

    iii) Notwithstanding the aforesaid, non-acceptance of an Order by GO SHOP/ Seller may be a result of, without limitation any one of the following:
    • The Mall Product ordered is unavailable or out of stock;
    • GO SHOP is unable to obtain authorization for s’ payment;
    • The identification of a pricing or product description error;
    • If there is false, omitted, erroneous information in the registration of the Buyer’s Account;
    • If a Buyer is found to be under the age of 18 years;
    • If Seller believes that it is not technically able to fulfill the Order (including delivery).

    iv) All prices for the Mall Product shall be as stated on the GO SHOP K-Mall at the time a Buyer shall place an Order. All prices, unless indicated otherwise are in Ringgit Malaysia and includes relevant tax (if any) unless otherwise stated save that the GO SHOP or Seller shall be entitled to charge delivery or installation charges Prices shall be subject to changes from time to time without notice.

    v) Buyers shall also be responsible for payment of customs duties, and taxes and any other charges related to the shipping and custom clearance of Mall Products (if any).

    3. PRODUCTS DESCRIPTION AND AVAILABILITY

    a) All images, photographs or videos of the Mall Products presented, showcased, displayed and made available are for illustrative purposes only subject to the provisions on warranties in Section 6 below. GO SHOP will attempt to procure Seller to ensure that all description of the Mall Products shown are as accurate as possible. Notwithstanding the above, the actual Mall Products delivered may vary slightly from those shown on the GO SHOP K-Mall due to reasons including without limitation image quality, packaging, redesign and improvements.

    b) The availability of the Mall Products presented on the GO SHOP K-Mall depends on availability of stock and GO SHOP/ Seller does not guarantee the availability of the Mall Products. In order to ensure that Mall Products are available, Seller has the right to set maximum limits in advance. If the Mall Products requested are unavailable or out of stock, Seller shall make every effort to offer a substitute item which is closest in terms of price and type to the originally requested item and in this connection, GO SHOP/ Seller shall not be held liable in any manner whatsoever to the Buyer. GO SHOP/ Seller shall also be entitled to carry out special promotions which offer free gifts or promotional items at its sole discretion from time to time subject to such terms as may be decided by GO SHOP/ Seller. In addition to the above, Buyers shall also comply with all terms and conditions imposed by the Seller for purchase of the Mall Products.

    4. TERMS OF PAYMENT

    a) All payments for any Mall Product purchased by a Buyer shall be made to GO SHOP, either accepting payment in its own right or as Seller’s agent. Buyer acknowledge that GO SHOP is entitled to collect payments from Buyer on behalf of a Seller.

    b) Unless otherwise specified, payment may be made via Credit Card and/or Debit Card (“Card(s)” which includes all types of cards including Visa, and MasterCard issued in Malaysia) save that GO SHOP is entitled to reject, revise or refuse the acceptance of any such Cards at its absolute discretion or to revise the types of Cards to be accepted without assigning any reasons or notice.

    c) No payments will be processed for a non-card holder and Buyers shall comply with such terms and conditions as may be imposed by the issuing financial institution or bank. If a Card payment is rejected or declined for any reason, GO SHOP reserves its rights under the Terms and Conditions to reject the relevant Order either in whole or in part. GO SHOP shall be entitled at its discretion to revise, add or change the payment methods at any time and from time to time without notice.

    d) All successful payments will be confirmed and notified by GO SHOP to the Buyer. In addition, an email confirmation together with a sales invoice which also serves as a receipt of payment will be sent to a Buyer’s email, if any and Customers who have not registered an email with GO SHOP are encouraged to check the status of an Order through the Site (in particular GO SHOP’s website at www.goshop.com.my or via GO SHOP mobile application)

    e) In the event GO SHOP shall discover any fraud, an attempt at deception or in the event of the suspicion of other illegal activities in connection with any payment made by any person including a Buyer in relation to any Mall Product then GO SHOP shall be entitled to without limitation to any rights or legal remedies of GO SHOP herein, to refuse, cancel or reject an Order and/or close a Buyer’s Account.

    4. DELIVERY

    a) Delivery will be carried out by Seller’s delivery provider (“Delivery Provider”) to the Buyer at the address of the Buyer stated on the Order.

    b) Any delivery period provided or quoted for delivery of the Mall Products to Buyers are for estimates only and delays may occur. GO SHOP shall not be liable for any delay in delivery of the Mall Products howsoever caused.

    c) Buyers understand that the Seller bears all risk attached to the delivery of the Mall Products and in the event where the purchased Mall Products are damaged, lost or if there is a failure of delivery, Buyers acknowledge and agree that GO SHOP will not be liable for any damage, expense, cost or fees resulted therefrom and Seller and/or Buyer will contact and liaise with to the Delivery Provider to resolve such dispute.

    d) Buyers agree and acknowledge that, where a Mall Product is being sold from a Seller based outside of Malaysia and whereupon the said Mall Product will be delivered from overseas (“Cross-border Transaction”), the importation and exportation of such product is subject to local laws and regulations and Buyers should familiarise themselves with all import and export restrictions that apply. Where required, Buyers shall be responsible to apply for the relevant import or clearance permits on their own and Buyers acknowledge that GO SHOP shall not bear any risk or liabilities associated with the Cross-border Transaction and the import and export of the Mall Products to Malaysia.


    5. EXCHANGE/ RETURNS /CANCELLATION /REFUNDS

    a) EXCHANGES / RETURNS
    All Product exchanges and/or returns (including any repairs, damage, wrong delivered items), are subject to the following conditions:
    i) Subject to the remaining terms of this Section 5, Buyers can request for exchange or return of a Product within TEN (10) calendar days (“Returns Period”) from the date of the Buyer’s receipt of the delivered Product (“Date of Product Receipt”). A Buyer’s request for exchange or return of the same Product shall not exceed Three (3) times (provided that the first request must be made within the Returns Period) and in any event no later than sixty (60) days from the first Date of Product Receipt, subject to the remaining terms in this Section 5(a).

    ii) Requests for any returns and/or exchange during the Returns Period may be requested by a Buyer by calling in to GO SHOP’s hotline number and seeking the assistance of the Personal Go Shopper or through GO SHOP’s website.

    iii) During the Returns Period, all exchanges or returns of any Product are collected or re-delivered by GO SHOP free of charge. After the Returns Period, GO SHOP shall be entitled to charge Buyers a collection cost which shall be paid by the Buyer to the Delivery Provider at the point of collection.

    iv) Unless decided otherwise by GO SHOP at its absolute discretion, requirements for exchanges or returns shall be subject to the following conditions failing which no returns or exchanges shall be allowed:
    • All Products (including any free gifts or free promotional items and warranty cards (if any) associated with the purchase) must be in their original packaging with all tags, accessories, sales invoice and warranty card (if any) enclosed and where any seal is attached, such seal must not be broken.
    • Undergarments and inner wear cannot be exchanged or returned for any reason whatsoever.
    • Perishable items (food or fresh produce) and cosmetic items (body care & skin care, makeup) cannot be returned nor exchanged if they have been partially consumed or used.
    • Fashion items (including shoes and accessories) can be exchanged due to issues relating to color and size. However, if items returned for exchange are soiled, damaged or shows some form of wear and tear, no exchange or return will be considered.
    • Subject to product warranty conditions, digital items (such as Smart TVs, tablets, phones, photo printers, digital cameras) cannot be exchanged or returned if the original seal is broken OR if there is no seal and the original packaging is opened.
    • No Product may be exchanged or returned if it is specified in the warranty card that no exchanges or returns are allowed.
    • All Products must be cleared of any defects or damage to the reasonable satisfaction of GO SHOP and/or SellerSeller and/or /supplier/manufacturer of Product before any exchange or returns of Products are completed or accepted by GO SHOP.

    v) Notwithstanding anything to the contrary, GO SHOP shall have the absolute discretion to decide on what Products that may be exchanged or returned. Buyers are advised to call GO SHOP’s hotline number to speak with the Personal Go Shopper on the full list of items or check the Site for further details.

    vi) During the Returns Period, requests for exchange or returns to GO SHOP are allowed for defective Products which are still within any valid warranty period subject to the Product warranty conditions and applicable laws. After the Returns Period, requests for exchange or returns for defective Products must be addressed directly to the supplier or manufacturer (at their service center stated in the warranty card) provided that the warranty period for a Product is still valid. Where the service center of the supplier or manufacturer is not specified, then GO SHOP may, at its sole discretion, and at the request of the Buyer, collect the Product free of charge from the Buyer and deliver the Product back to the supplier or manufacturer on behalf of the Buyer. For avoidance of doubt, a Buyer is not entitled to any exchange or returns after the expiry of the warranty period of the Product.


    b) CANCELLATION/REFUNDS
    Notwithstanding the terms of this Section 5(a) above, cancellation and refunds on returns requested for any Product during the Returns Period shall subject to the following conditions:
    i) Buyers may cancel an Order prior to confirmed delivery of a Product and request for a refund if payment has been made. Cancellation may be done by contacting any Personal GO SHOPper. For avoidance of doubt once a Product has been confirmed for delivery and/or delivered and received by a Buyer, the Order cannot be cancelled.
    ii) Requests for refunds and the process of refunds will be subject to the terms on exchange and returns in Section 5(a) above and refunds will be processed after the successful clearance of any defects or damage on the returned Product to the reasonable satisfaction of GO SHOP. Buyers may contact GO SHOP for full details of such refund. Depending on the method of payment, refunds including the time frame of refunds are also subject to the terms imposed by the issuing bank.

    c) For avoidance of doubt, unless otherwise stated herein, no request for exchange or returns or cancellations or refunds on a Product may be made by Buyers after the Returns Period and the decision of GO SHOP with regards to this shall be final and binding.

    6. WARRANTIES

    a) GO SHOP has no control over and does not guarantee that the Mall Products are of the standard, quality, composition, style or model as presented or displayed on the GO SHOP K-Mall. GO SHOP does not take any responsibility for any inaccuracy or error in the presentation or display of such information.

    b) Subject to Section 7 below, GO SHOP does not make any express or implied warranties, representations or endorsements including but not limited to any warranties of title, non-infringement, merchantability, usefulness, operation, completeness, accuracy, satisfactory quality, reliability or fitness for a particular purpose, in respect of any Mall Product sold by the Seller to a Buyer (and/or any free gift or promotional items given in relation to any such Mall Product), the material, information and/or functions therein and expressly disclaims liability for all errors and omissions in such materials, information and/or functions.

    7. LIABILITY AND INDEMNITY

    a) To the full extent allowed by applicable law, as GO SHOP is not involved in the purchase transaction of a Mall Product between Seller and Buyer, the Buyer agrees that GO SHOP will not be liable to a Buyer/or any third party for any claims against GO SHOP for consequential or incidental loss and damages (including but not limited to loss of revenue, loss of profits, loss of goodwill, loss of reputation, loss of anticipated savings, wasted expenditure, loss of privacy and loss of data) or any other indirect, special or punitive damages whatsoever that arise out of or are related to any Mall Product purchased by Buyer (including free gifts or promotional items given in relation to any such Mall Product) from the Seller through the GO SHOP K-Mall.

    b) GO SHOP shall further be under no liability in respect of : a) any allergies or other health or medical condition suffered by a Buyer; and b) any defect to any Mall Product, arising from unsuitable or improper use, defective installation or commissioning by the Buyer or third parties, fair wear and tear, willful damage, negligence, abnormal working conditions, defective or negligent handling, improper maintenance, excessive load, unsuitable operating materials and replacement materials, poor work, unsuitable foundation, chemical, electro-technical/electronic or electric influences, failure to follow instructions (whether oral or in writing) misuse or alteration or repair of the Mall Product, addition and i nsertion of parts, in particular of spare parts which do not come from GO SHOP/ Seller without the approval of GO SHOP/ Seller.

    c) The information made available on the GO SHOP K-Mall in connection with the supply of the Mall Product, including photographs, drawings, data about the extent of the delivery, appearance, performance, dimensions, weight, consumption of operating materials, operating costs or any other information are for information purposes only. Buyer acknowledges that it does not rely on and waives any claim based on any such representations or information so provided.

    8. GENERAL TERMS

    a) GO SHOP shall not be liable for any breach of its obligations under these Terms and Conditions where it is hindered or prevented from carrying out its obligations by any event of force majeure or cause outside its reasonable control, (or by any damage caused by any of such events).

    b) These Terms and Conditions shall be governed in all respects by the laws of Malaysia and the parties shall submit to the exclusive jurisdiction of the Malaysian courts.

    c) If any provision herein is held to be invalid or unenforceable, that provision shall be struck and the remaining provisions shall be enforced.

    1.   • 1. The promotion known as the “Go Shop Birthday Campaign 2019 (“Campaign”) is organized by Astro GS Shop Sdn Bhd (1081077-X) (“Go Shop”) and valid from 1 April 2019 to 31 March 2020 (“Campaign Period”) only.

    2. This campaign is applicable to (i) all registered customers of Go Shop prior 1 April 2019 (“Existing Customers”) AND (ii) new customers who have registered as a customer of Go Shop after 1 April 2019 and at least one (1) month prior to the first day of the respective customer’s birthday month (according to the customer’s birthday as registered with Go Shop) (“New Customers”). Existing Customers and New Customers shall collectively be referred to as “Eligible Customers” or each, an “Eligible Customer”.

    Example: If a customer registers with Go Shop on 1st April 2019 and his birthday falls in the month of May, he will receive a promo code under this Campaign. If a customer registers with Go Shop on 1st May 2019 and his birthday falls in the month of May, he will not receive a promo code under this Campaign.

    3. Eligible Customers shall be entitled to receive a one-time birthday promo code (“Promo Code”) during their birthday month (according to the customer’s birthday as registered with Go Shop) which shall entitle the Customer to a 10% discount off the purchase of one (1) single s elected products (“Selected Products”) in a single Order (“Order” which definition means one (1) single invoice invoiced by Go Shop to a Customer) (i) via Astro TV Channels (including 118, 120 and 303) or (ii) via the “TV Shopping” category on Go Shop’s online website at www.goshop.com.my or (iii) via the “TV Shopping” category on Go Shop’s mobile application at m.goshop.com.my.

    4. The Promo Code will be made automatically available in an Eligible Customers’ Go Shop account before the 7th day of their respective birthday month for discount s election during checkout for payment of the Order.

    5. The Promo Code can only be used once and is valid for thirty (30) days only from the date of receipt.

    6. Eligible Customers must apply the Promo Code at the check-out page prior to payment and follow instructions given therein. Alternatively, Eligible Customers who call Go Shop’s hotline number at 039544 1188 must inform Go Shop’s Personal Go Shopper the use of the Promo Code prior to placing the Order.
  • CAMPAIGN TERMS AND CONDITIONS

    1. This Campaign is only valid from 22 April 2019 to 31 December 2019 (both dates inclusive and hereinafter referred to as the “Campaign Period”) and is applicable to all registered customers of Astro GS Shop Sdn Bhd (“Go Shop”) including new customers that register during the Campaign Period (“Customers” or each, a “Customer”). Registration as a Customer can be done by calling Go Shop’s hotline number 03-9544 1188 or online at www.goshop.com.my.

    2. During EVERY WEDNESDAY of the Wednesday Campaign Period, Customers who purchase s elected product(s) via (i) the “TV Shopping” category on Go Shop’s website at www.goshop.com.my; or (ii) the “TV Shopping” category on Go Shop’s mobile website at m.www.goshop.com.my, AND using Maybank credit or debit card for payment upon check-out are entitled to use the promo code “MBB10” (“Promo Code”) for an instant TEN PERCENT (10%) discount off the total purchase price of the Order (“Order” which definition means one (1) single invoice invoiced by Go Shop to a Customer).

    3. Customers must register the Promo Code first before applying the same at the check-out page prior to payment and follow instructions given therein. Only ONE (1) promo code can be used and applied for each Order.

    4. The use of the Promo Code is applicable for non-cash purchases using Maybank credit or debit card only. The Promo Code is not valid for use in conjunction with other promotions, offers or discounts.
    5. Go Shop reserves the right to change, revise or amend these Terms & Conditions herein (including to amend the products which are eligible for the Promo Code) and/or cancel, revise or reject any discounts or promotions in relation to the Campaign at any time without notice and without any liability or compensation whatsoever to any Customer or person or party. Any decision made by Go Shop in relation thereto shall be final and binding on all persons.

    6. The terms herein shall be read with Go Shop’s General Terms and Conditions for Promo Codes and Go Shop’s Customer Terms and Conditions which can be found on www.goshop.com.my unless otherwise specified. The terms and conditions herein shall prevail over any inconsistencies only to the extent of such inconsistencies relate to this Campaign.

This campaign known as the “Go Shop GoRewards Campaign 2019” (“Campaign”) is valid from 1 April 2019 to 31 March 2020 (both dates inclusive and hereinafter referred to as the “Campaign Period”) and is applicable to all registered customers of Astro GS Shop Sdn Bhd (1081077-X) (“Go Shop”) (“Customers” or each, a “Customer”). Registration as a Customer can be done by calling Go Shop’s hotline number at 03-9544 1188 or online at www.goshop.com.my.

    2. Under the Campaign, Customers who complete the following actions shall be entitled to receive 20 Go Points (as defined under the Go Shop Go Points Programme Terms and Conditions) (“Bonus Go Points”): i. place an order (“Order” which definition means one (1) single invoice invoiced by Go Shop to a Customer) to purchase any s elected product(s) from Go Shop (i) via Astro TV Channels (including 118,120 and 303) or (ii) via the “TV Shopping” category on Go Shop’s online website at www.goshop.com.my or (iii) via the “TV Shopping” category on Go Shop’s mobile application; AND ii. complete a minimum of three (3) Orders within a single calendar month during the Campaign Period with a minimum accumulated Total Invoice Value (as defined under the Go Shop Go Points Programme Terms and Conditions, i.e. the total amount (inclusive of any applicable tax) invoiced by Go Shop to customers for an order after deduction of any applicable discounts and rebates) of Ringgit Malaysia Six Hundred (RM600.00).

    3. The Bonus Go Points will be automatically credited into the Customer’s Go Shop account within thirty (30) days from the last calendar day of the month during which the actions specified in Paragraph 2 were completed. For avoidance of doubt, Customers shall be entitled to receive Bonus Go Points for each calendar month during which the actions specified in Paragraph 2 were completed.

    4. The Bonus Go Points are valid for redemption within one (1) year only from the date the Bonus Go Points are credited into the Customer’s Go Shop account, and thereafter all unused or unredeemed Bonus Go Points shall be forfeited and will be invalid for use.

    5. The Bonus Go Points cannot be transferred or exchanged for cash and may be used for non-cash purchases (credit card, debit card, Easy Payment Scheme and bank transfer) and cash on delivery (COD) purchases of products from Go Shop.

    6. Notwithstanding the above and subject to the absolute discretion of Go Shop, where a Customer has received any Bonus Go Points under this Campaign, then the Customer shall not be entitled to receive other Go Points from other offers and promotions during the Campaign Period for the purchase of the same product during the Campaign Period.

    7. Go Shop reserves the right to change, revise or amend these Terms & Conditions herein and/or cancel, revise or reject any discounts or promotions in relation to the Campaign at any time without notice and without any liability or compensation whatsoever to any Customer or person or party. Any decision made by Go Shop in relation thereto shall be final and binding on all persons.

    8. The terms herein shall be read with Go Shop’s Customer Terms and Conditions for the purchase of products from Go Shop and the Go Shop Go Points Programme Terms and Conditions on the use of the Go Points which can be found on www.goshop.com.my unless otherwise specified. The terms and conditions herein shall prevail over any inconsistencies only to the extent of such inconsistencies relate to this Campaign.
  • 1. Definitions

    In these Terms and Conditions which cover the Programme (as defined below), unless the context otherwise requires, the following words and expressions shall have the following meanings:

    “Account” means a one-time registration account created for a Customer by GO SHOP for the purposes of transacting on the Home Shopping Platform including purchasing a Product and containing the information of the Customer including without limitation name, address, identification number (NRIC/Mykad), telephone number and/or such other information as may be required by GO SHOP for such registration;

    “Astro” means Astro Malaysia Group, and includes all its related companies including without limitation MEASAT Broadcast Network Systems Sdn Bhd (Company Number 240064-A), a satellite and cable TV service operator which provides data, high definition format services, recording services, pay-per-view, premium/special events, near video on demand, interactive and other special services (including paid packages of television and radio channels);

    “Business Day(s)” means a day(s) on which commercial banks are open for business in Selangor (other than Saturdays, Sundays and public holidays);

    “Customer” or “Customers” means the person who has opened an Account and registered as a customer of GO SHOP in accordance with the GO SHOP Customer Terms and Conditions;

    “GO SHOP” means the home shopping business operated by Astro GS Shop Sdn Bhd (Company Number 1081077-X) a company incorporated in Malaysia and having its registered address at 3rd Floor, All Asia Broadcast Centre, Technology Park Malaysia, Lebuhraya Puchong-Sungai Besi, Bukit Jalil, 57000 Kuala Lumpur, Malaysia, and which operates on the Home Shopping Platform to provides a venue for Customers to access, view, browse, and/or place an Order for any Product;

    “GO SHOP TV” means collectively the home shopping television channels and programs operated by GO SHOP which is currently available on Astro’s TV Channels via cable or satellite TV services including without limitation Astro Channels 118, 120 and 303 (subject to such changes from time to time) that features and offers Products for sale;

    “GO SHOP Customer Terms and Conditions” means the terms and conditions relating to the purchase of a Product by a Customer on GO SHOP which can be found on the Site;

    “Home Shopping Platform” means collectively GO SHOP TV and the Site and/or such other home shopping platforms, on ground locations or stores where GO SHOP shall advertise or sell or offer for sale the Products;

    "Order" or “Orders” means any order submitted or placed by a Customer to GO SHOP to purchase a Product from either GO SHOP or a Business Partner (where applicable);

    "Product/Products" means any product/merchandise/offers/display items and shall include the Services that are uploaded /showcased/displayed/broadcasted and/or offered for sale on the Home Shopping Platform;

    "Site" means collectively GO SHOP’s website at www.goshop.com.my,mobile application at m.goshop.com.my (mobile site/ mobile website) and/or any other mobile applications/mobile interfaces applications/ apps and the services provided GO SHOP and/or social media platforms (including without limitation Facebook, YouTube, Instagram) which provides a venue / platform to the users of the Site and/or a Customer to access, view, browse or purchase the Products featured, showcased/displayed and/or offered for sale on the Site;

    “Services” means the services provided by GO SHOP in relation to any Product and/or services featured or offered for sale on its Home Shopping Platform including those offered for sale by any of the Business Partners;

    “Existing Customer” means a Customer who places an Order and who purchases s elected Product(s) from GO SHOP during the validity of the Programme in accordance with the Terms and Conditions set forth herein;



    “Go Point” or “Go Points” means the reward points awarded under the Programme to Existing Customers by GO SHOP upon purchase of Product(s) from GO SHOP which may be subsequently redeemed for future purchases of Products in accordance with the Terms and Conditions set forth herein;

    “Programme” means the rewards programme known as “GO SHOP Go Points Programme” operated by GO SHOP;

    “Total Invoice Value” means the total amount (inclusive of any applicable tax but less applicable discounts, rebates and/or redemption of existing Go Points, if any) stated in GO SHOP’s sales invoice invoiced by GO SHOP to an Existing Customer for payment of an Order.

    2. Entitlement

    2.1 This Programme shall subject to the Terms and Conditions herein and is open to Existing Customers of GO SHOP. For avoidance of doubt, a Customer who has registered an Account but has yet to place an Order or purchase Product(s) from GO SHOP will not be entitled to the privileges of the Programme including receiving the Go Points herein which shall be at the sole and absolute discretion of GO SHOP.

    2.2 No fee will be charged Existing Customer save that GO SHOP reserves the right to apply any charges and fees at any time as it deems fit.

    3. Awarding and Redemption of Go Points

    3.1 Awarding of Go Points

    a) Subject to GO SHOP’s right at its sole discretion to decide on the Go Points and manner of allocation which may be revised from time to time, the Go Points will be awarded to an Existing Customer based on the s elected Product(s) purchased from GO SHOP as follows:

    (i) For purchases of Products made on the Site, the Go Points awarded shall be equivalent to Five Percent (5%) of the “Total Invoice Value” (to be rounded to the nearest RM0.01) for each Order.

    (ii) For purchases of Products made by calling GO SHOP’s hotline, the Go Points awarded shall be equivalent to Zero Point Five Percent (0.5%) of the “Total Invoice Value” (to be rounded to the nearest RM0.01) for each Order.

    b) Go Points will only be awarded upon the successful delivery of the Product to the Existing Customer who receives the Product. No Go Points will be awarded if:

    (i) the Order was cancelled by the Existing Customer prior to delivery; and/or

    (ii) Incomplete information was provided by the Existing Customer for delivery purpose hence the Product was unsuccessfully delivered to the Existing Customer.

    Examples:

     Sofia who is an Existing Customer buys a home appliance worth RM159 from GO SHOP’s website (www.goshop.com.my) under her registered Account. She will be awarded 7.95 Go Points (RM159 x 5%) after she receives her product(s) at her delivery address. The Go Points will be automatically credited into Sofia’s registered Account within four (4) Business Days of successful product delivery.

     Rudie who is an Existing Customer buys a tablet worth RM499 by calling in and placing an Order from GO SHOP’s hotline. He will be awarded 2.49 Go Points (RM499 x 0.5%) after he receives the product(s) at his delivery address. The Go Points will be automatically credited into Rudie’s registered Account within four (4) Business Days of successful product delivery.

    3.2 Redemption and validity of Go Points

    a) Go Points can be redeemed once they are credited into the Existing Customer’s Account. Redeemable Go Points will be automatically credited into the Existing Customer’s Account within four (4) Business Days from the time of the successful delivery of the Product to Existing Customer (“Date of Automatic Credit”). Go Points that have been successfully credited in an Account may be subsequently redeemed by the Existing Customer to purchase s elected Products from GO SHOP.

    b) One (1) Go Point is equivalent to Ringgit Malaysia One (RM 1.00) only.

    3.3 Go Points are valid for one (1) year from the Date of Automatic Credit and will expire at the end of the validity period. Existing Customers are encouraged to redeem their accumulated Go Points before the expiry date failing which the Go Points will automatically expire on the expiry of each validity period. Any extension will not be given.
    Example 1:
    If a Go Point is credited on 1 October, they will be valid until midnight on 30 September the following year.

    Example 2:
    If a Go Point is credited on 29 February (in a leap year), then such Go Point will be valid until midnight on 28 February the following year.

    3.4 An Existing Customer may redeem his/her Go Points in full or partially to settle the Total Invoice Value, subject to the compliance with the procedures for redemption above. For a partial redemption, the remaining unpaid Total Invoice Value after redemption of Go Points is payable by the Existing Customer to GO SHOP as per the GO SHOP Customer Terms and Conditions.

    3.5 On confirmation of redemption, Go Points redeemed by the Existing Customer will be deducted from the Account. Existing Customer All Go Points that have been accepted for redemption by GO SHOP and deducted from the Account of the Existing Customer is non-refundable save and except that GO SHOP is entitled at its absolute discretion to refund and re-instate Go Points into the Account to an Existing Customer if:
    (i) an Order was auto-cancelled due to system error despite the Go Points being successfully redeemed by the Existing Customer; or

    (ii) if GO SHOP is unable to deliver an Order to the Existing Customer, after two (2) attempts of delivery, as a result of the willful default of GO SHOP or its delivery provider; or

    (iii) Where GO SHOP agreed with the Existing Customer to refund the payment of a Product after successful delivery (subject to the GO SHOP Customer Terms and Conditions) and payment of the same Product was made with Go Points in full or partial of the Total Invoice Value.

    3.6 No Go Points will be deducted from the Account save and except that where an Existing Customer has made payment on a Product other than redemption of Go Points, then in the event that the Existing Customer has requested and GO SHOP has agreed on a refund of the payment on the said Product in cash (subject to the Customer Terms and Conditions), then the Go Points awarded earlier on the said Product equivalent to the value of the refund amount will be deducted from the Account.

    3.7 Go Points are not exchangeable for cash, cannot be converted to cash, non-transferable nor credited into another Existing Customer’s or a Customer’s Account.

    3.8 GO SHOP reserves the right to suspend a transaction and/or reallocate, recalculate, reverse or adjust the Go Points or take any necessary action, with or without any notice in the event that GO SHOP has a reasonable ground to suspect that the Go Points were awarded, earned or redeemed fraudulently or in error.

    3.9 An Existing Customer shall frequently review his/her Account to check and verify the correctness and accuracy of current Go Points balance subject to Section 4.7 herein. Existing Customer may check the Go Points balance via the Site or call GO SHOP’s hotline number for assistance.

    3.10 In the event of failure by an Existing Customer to redeem the Go Points due to any issue, an Existing Customer may within twenty-four (24) hours from the time of experiencing such issue notify GO SHOP via email at [email protected] and provide the Existing Customer’s contact number and date/time of attempted redemption and/or such other information to reflect the failure of redemption. Replies from GO SHOP to an Existing Customer in this connection shall be made within Two (2) Business Days provided that the Existing Customer has provided all the said information.

    4. Dispute

    4.1 If there is any dispute on any Go Points transaction, an Existing Customer may within thirty (30) calendar days from the date of automatic credit notify GO SHOP and provide all relevant information to GO SHOP. Any submission after the thirty (30) calendar days will not be accepted.

    4.2 GO SHOP may at its sole and absolute discretion settle the disputes as it deems fit. The decision by GO SHOP shall be final and conclusive.

    5. General

    5.1 These Terms and Conditions govern and sets out the agreement between GO SHOP and each Existing Customer with regards to the Programme. It shall be read together with a) The Privacy Notice of GO SHOP on the use of personal information; b) The GO SHOP Terms and Conditions of Use; and c) the GO SHOP Customer Terms and Conditions; and d) Such other information as may be provided to an Existing Customer by GO SHOP, save that in the event of any conflict, the Terms and Conditions herein shall prevail to the extent of the Programme. By accepting and using the Go Points under the Programme, an Existing Customer is deemed to have agreed and accepted the Terms and Conditions herein.

    5.2 The accuracy of personal information shall be verified by the Existing Customers who shall notify GO SHOP upon any changes on their personal information.

    5.3 GO SHOP reserve the right to request the Existing Customer to produce his/her information/identification (including MyKad or Passport) to facilitate the Go Points transaction and for verification purposes.

    5.4 GO SHOP reserves the rights at its sole and absolute discretion to amend, change, modify, add, d elete or remove any part of these Terms and Conditions at any time as it deems fits without notice. The continued participation in the Programme and/or continued use and redemption of Go Points by any Existing Customer following such amendments, changes, modifications, additions, deletions or removal constitutes the Existing Customer’s acceptance of any amendments, changes, modifications, additions, deletions or removal to these Terms and Conditions and the Existing Customer agrees to be bound by the same.

    5.5 In addition, GO SHOP reserves the right, at any time to vary, modify, replace, substitute or terminate the Programme or any rewards, benefits, features or privileges under the Programme or withdraw Go Points from use or redemption without prior notification to any party including the Existing Customer and without being liable in any way to Existing Customers to the extent permitted by applicable laws.

    5.6 GO SHOP shall have the right, in its sole discretion and without notice, to suspend or terminate the Programme and/or revoke and forfeit any of the Go Points whether or not in an Account of the Existing Customer at any time at its sole discretion including but not limited to the following circumstances:
    a) if any Existing Customer provides any information that is untrue, false, inaccurate, not current or incomplete or if GO SHOP has reasons to believe that such information is untrue, false, inaccurate, not current or incomplete; and/or

    b) if any Existing Customer breaches any of these Terms and Conditions, and/or GO SHOP’s Customer Terms and Conditions, GO SHOP Terms and Conditions of Use and/or GO SHOP Privacy Notice; and/or

    c) if any Existing Customer commits or performs fraudulent activities or fraudulent activities are performed by third parties under the Existing Customer’s Account; and/or

    d) if any Existing Customer commits any act or if GO SHOP has reasons to believe that the Existing Customer has committed any act that affects or damages the reputation of GO SHOP or Astro; and/or

    e) if GO SHOP suspects fraudulent use of the Existing Customer’s Account and the Go Points awarded to an Existing Customer (fraudulent use of an Account may include but is not limited to unauthorised access to or by third parties of an Existing Customer’s e-mail address and password, entering invalid or apparently invalid user information for the Account, or attempting to register for free, trial, or promotional offers under several aliases or with different user information to circumvent any one-trial-per-user limitation or using another person’s banking account).

    Upon any termination of an Account herein, the Existing Customer shall immediately cease all access to and use of the Account and GO SHOP shall, in addition to any other legal or equitable remedies, immediately cancel the Account and deny access to and use of the Account to the Existing Customer in whole or in part. Any termination herein shall not affect the respective rights and obligations (including without limitation, payment obligations) of the parties arising before the date of termination.

    5.7 Existing Customers are responsible for the security of their Account including the Go Points in the Account. GO SHOP accepts no liability for the disclosure of the Account by the Existing Customer to a third party, whether intentionally or otherwise. GO SHOP reserves the right to protect an Account from being accessed if GO SHOP has reasonable grounds to believe that the security of the particular Account has been breached or at the risk of exposure in accordance with applicable laws. In this connection, the provisions covering the Account of the Existing Customer with GO SHOP under the GO SHOP Customer Terms and Conditions shall apply.

    5.8 Any communication or notice to GO SHOP should be in writing to GO SHOP’s address stated on GO SHOP’s invoice. All correspondence and notices by GO SHOP to the Existing Customer will be sent in writing to the most recent mailing address provided by the Existing Customer to GO SHOP upon registration or via email to the email address provided by the Existing Customer. Notices will be considered to be received upon hand delivery or upon the fifth business day after posting or upon successful delivery of the email.

    5.9 GO SHOP may further establish rules, procedures and policies in relation to any matter regarding the Programme, all of which shall form part of the Terms and Conditions herein. These Terms and Conditions as set out herein shall prevail in the event of any conflict or inconsistency with any other documents, statements, rules, procedures, policies or communications issued by GO SHOP, including without limitation any Frequently Asked Questions (FAQs) and advertising or promotional materials.

    5.10 These Terms and Conditions together with the aforesaid further rules, procedures and policies shall constitute the entire agreement and understanding between GO SHOP and the Existing Customers with respect to the Programme and shall not be subject to any other agreement, understanding, warranty or representation not expressly contained or referred to in these Terms and Conditions and the aforesaid further rules, procedures and policies.

    5.11 If any provision herein is held to be invalid or unenforceable, that provision shall be struck and the remaining provisions shall be enforced.

    5.12 These Terms and Conditions are governed by the laws of Malaysia and parties shall submit to the exclusive jurisdiction of the courts of Malaysia.

    2. During the Promotion Period, Customers who purchase any of the following s elected product(s) from Go Shop’s website at www.goshop.com.my or via mobile application at m.goshop.com.my are entitled to use the following promo codes (“Promo Codes” and individually, a “Promo Code”) for an instant discount off the purchase of the corresponding products as follows:



    3. Each Promo Code may be used once per Order (“Order” which definition means one (1) single invoice invoiced by Go Shop to a Customer) for an instant discount off the purchase of ONE (1) unit only of the corresponding product (in accordance with the table in Paragraph 2 above). For avoidance of doubt, multiple Promo Codes may be used in the same Order.

    4. Customers must register the Promo Code(s) first before applying the same at the check-out page prior to payment and follow instructions given therein.

    5. Any use or redemption of the Promo Codes made before or after the Promotion Period will be invalid and rejected. Promo Codes are limited on a first come first served basis.

    6. The use of the Promo Codes is applicable for non-cash purchases (credit card, debit card, Easy Payment Scheme and bank transfer) only.

    7. The terms and conditions herein shall be read with Go Shop’s General Terms and Conditions on the use of the Promo Codes, Go Shop’s Customer Terms and Conditions for purchase of products from Go Shop and Privacy Notice and all other relevant terms and conditions which can be found on www.goshop.com.my unless otherwise specified. The terms and conditions herein shall prevail over any inconsistencies only to the extent that such inconsistencies relate to the Promotion.

    8. Customers shall confirm, undertake and agree to comply with all terms and conditions imposed by Go Shop issued to its customers in relation to any purchase of product(s) from Go Shop and in this connection, Go Shop shall have the absolute discretion to withhold or decide not to provide any discounts from this Promotion and/or to any participant of this Promotion.

    9. Go Shop reserves the right to change, revise or amend the terms & conditions herein and/or cancel the Promotion and/or revise any discounts of the Promotion at any time without notice and without any liability or compensation whatsoever to any person or party.
