  • CUSTOMER TERMS & CONDITIONS


    1. PURPOSE


    The terms and conditions herein ("Terms and Conditions") is the contract or agreement that defines the rights, duties and responsibilities of AGSSB and a Customer in relation to the sale and purchase of any Product from the Platforms. By speaking to our Personal Go Shopper, registering an Account or placing an Order with AGSSB or using any facilities made available by AGSSB in relation to the purchase of any Product from the Platforms, Customers are deemed to have read and accepted and agreed to be bound by these Terms and Conditions.


    The Terms and Conditions herein shall be read with all the information made available to a Customer when placing and confirming an Order including without limitation: a) The Privacy Notice on the use of personal information; and b) The Go Shop Terms and Conditions of Use; and c) Such other information as may be provided to a Customer by AGSSB, save that in the event of any conflict, these Terms and Conditions herein shall apply.  


    In relation to placing Orders and purchasing from the Platforms, Customers may call in to AGSSB’s toll free number which can be found on GO SHOP TV or THE SITE for further information including without limitation on how to order, payment methods, delivery, and/or returns/refunds. Customers are advised to also read these Terms and Conditions and Privacy Notice before any purchase of a Product.  These Terms and Conditions and Privacy Notice are available online on THE SITE. AGSSB shall be entitled to also provide a copy of these Terms and Conditions and the Privacy Notice or such other relevant documents in relation to the sale and purchase of the Products to Customers together with the delivery of a Product.


    AGSSB reserves the right, to change, modify, add, or remove portions of these Terms and Conditions and the information provided to a Customer at any time. Changes will be effective after they are posted on THE SITE or notified by AGSSB. The continued purchase of Products from AGSSB and/or from the Platforms following such changes to these Terms and Conditions constitutes the Customer’s acceptance of those changes.


    Definitions:

    “Account” means a one-time registration account created for a Customer by AGSSB containing the information of the Customer including without limitation name, address, identification number (NRIC/Mykad), telephone number and/or such other information as may be requested by AGSSB for purposes of registration.


     “AGSSB” or “We” or “Us” or “GO SHOP” means Astro GS Shop Sdn Bhd (Company Number 1081077-X) a company incorporated in Malaysia and having its registered address at 3rd Floor, All Asia Broadcast Centre, Technology Park Malaysia, Lebuhraya Puchong-Sungai Besi, Bukit Jalil, 57000 Kuala Lumpur, Malaysia.


    Astro” means MEASAT Broadcast Network Systems Sdn Bhd (Company Number 240064-A), a satellite and cable TV service operator which provides data, high definition format services, recording services, pay-per-view, premium/special events, near video on demand, interactive and other special services (including paid packages of television and radio channels).


    Business Day (s)” means a day (s) on which commercial banks are open for business in Selangor (other than Saturdays, Sundays and public holidays);


    Business Partners” means the business partners of AGSSB whose products and/or services are featured, advertised, promoted or offered for sale on the Platforms including without limitation suppliers, vendors, sellers, merchants and other third parties.


    "Customer/Customers” means the person who places an Order and purchases a Product from either AGSSB or any Business Partners.


    “GO SHOP TV” means the television channel operated by AGSSB which is currently available on Astro’s Channel 118 and Channel 318 (subject to such changes, additions or revisions from time to time by AGSSB) that offers Products for sale via cable or satellite TV services to allow Customers to place an Order for any Product via phone or other means of communication.  


    "Order" or “Orders” means any order submitted or placed by a Customer to AGSSB to purchase a Product from either AGSSB or a Business Partner (where applicable).


    Platforms” means collectively or either GO SHOP TV, the SITE and/or such other platforms, locations or stores where AGSSB shall advertise, promote, feature, sell or offer for sale the Products.


    "Product/Products" means any products/merchandise/services/offers/display items that are advertised, promoted, featured, uploaded, showcased, displayed, broadcasted, and/or offered for sale on GO SHOP TV.


    Personal Go Shopper” means AGSSB’s call center agent or such agent appointed by AGSSB.


    "THE SITE" means GO SHOP’s website at www.goshop.com.my, m.goshop.com.my (mobile site/ mobile website) and/or any mobile applications/mobile interfaces applications/ apps and the services provided by AGSSB which provides a venue/platform to the users of THE SITE and/or a Customer to purchase the Products advertised, promoted, featured, showcased, displayed and/or offered for sale therein.


    "Terms and Conditions" means the terms and conditions as detailed herein including all schedules, appendices, annexures, and will include the references as amended, negated, supplemented, varied or replaced from time to time.


    Terms and Conditions of Use” means Go Shop’s Terms and Conditions of Use in relation to the use of the Platforms as posted on the SITE.


    2. REGISTRATION, ORDER ACCEPTANCE AND PRICING


    2.1 Prior to placing the first Order from AGSSB, a Customer must carry out a one-time registration and creation of a new Account by  either: (a) calling the designated toll free hotline number shown on GO SHOP TV or on THE SITE and speak to a Personal Go Shopper who  is able to assist the Customer to register a new Account; OR (b) carry out a one-time registration and creation of a new Account online on THE SITE OR (c) via such other methods of registration which creates a new Account as shall be determined by AGSSB at its absolute discretion from time to time. The Customer shall comply with these Terms and Conditions provided in relation to the registration of the Account and use of the Platforms.


    2.2 To register, a Customer must be 18 years and above at the time of registration and have a designated local address in Malaysia. A Customer must provide the all relevant information required by AGSSB for the purposes of registration of the Account.  For registration on THE SITE, a Customer must provide the information required in the registration form on THE SITE, and a unique and valid e-mail address and password upon completing the Account registration process. Customers are responsible for maintaining the confidentiality of the password and e-mail address, and are fully responsible for all activities that occur under such password or e-mail address whether or not actually or expressly authorized and/or used by the Customer.  Customers agree to immediately notify AGSSB if any authorised third party has that password or if there is any unauthorized use of the Customer’s email address or any breach of security known to the Customer.


    2.3 Upon registration as per the manner above, the Customer’s Account will be created. Customers only need to register an Account once.  For subsequent Orders, Customers will only need to go through AGSSB’s verification process.  Subject to the terms contained herein, AGSSB reserves the right to decline a new Account or to cancel an existing Account at any time at its sole discretion. AGSSB reserves the right to terminate any dormant Account that has not been used for a period of six (6) months or longer.


    2.4 Customers agree to: (a) provide true, accurate, current and complete information about yourself as prompted by the Account registration form and (b) maintain and promptly u pdate such registration data to keep it accurate, current and complete. If Customers provide any information that is untrue, inaccurate, not current or incomplete, or if AGSSB suspects that such information is untrue, inaccurate, not current or incomplete, AGSSB has the right to suspend or terminate the Account.


    2.5 The Account is not transferable and may not be assigned to any third party. Customers agree to (i) notify AGSSB immediately of any unauthorized use or any other breach of security, and/or (ii) ensure that Customers properly exit from the Account at the end of each session on THE SITE. AGSSB cannot and will not be liable for any loss or damage arising from Customers’ failure to comply with this provision.


    2.6 Customers may terminate and close the Account by e-mailing AGSSB at the email address specified on THE SITE from the e-mail address provided by Customers at the time Customers opened the Account and created Customers’ e-mail address. Customers’ e-mail must specify Customers’ e-mail address, and expressly state that Customers wish to terminate the Account. Alternatively, Customers may call our toll-free number and obtain the assistance of our Personal Go Shopper to terminate and close the Account.


    2.7 Subject to the provisions of the Direct Sales and Anti-Pyramid Scheme Act 1993 (Act 500) (as amended or replaced from time to time), the Customer shall have the right to rescind the contract (including the Account) with AGSSB before the expiry of the cooling off period of ten (10) Business days from the date of successful registration of the Account. For the avoidance of doubt, should the Customer place an Order successfully with AGSSB and requires for delivery of the Product ordered from AGSSB before expiry of the said cooling off period, then such Order shall constitute the notice from the Customer to AGSSB to waive his/her right to rescind the contract (including the Account).


    2.8 General Terms of ordering


    a) To place an Order with AGSSB, a Customer must complete the registration process stated in this Section 2 prior to the time of placing such Order, failing which AGSSB has the right to accept, refuse, cancel or reject any Order placed.

    b) Any Order placed by a Customer shall include the following information:


    • Product name and specifics (color, size, etc.).
    • Payment method and details.
    • Delivery address.

    c) A Customer’s successful Order will be confirmed to the Customer via Short Messaging Service (SMS) notification and/or via electronic mail confirmation containing a summary of the Order details and/or such other method that AGSSB shall decide from time to time without notice.


    d) AGSSB reserves the right to accept, refuse, cancel or reject any Order from any Customer or any person at any time or under any circumstances including where an Order cannot be processed for various reasons. Customers may be asked to provide additional verifications or information before an Order is accepted.


    e) Notwithstanding the aforesaid, non-acceptance of an Order by AGGSB may be a result of, without limitation any one of the following:



    • The Product that Customers have ordered is unavailable or out of stock;
    • AGSSB is unable to obtain authorization for Customers’ payment;
    • The identification of a pricing or product description error;
    • If there is false, omitted, erroneous information in customer registration of the Customer’s Account;
    • If a Customer is found to be under the age of 18 years;
    • If AGSSB believes that it is not technically able to fulfill the Order (including delivery).

    f) Any changes or cancellation by a Customer of any Order shall be notified to AGSSB’s Personal Go Shopper provided that any Order that has been paid, delivered or pending delivery may not be cancelled but instead the Product must be returned in accordance with Section 6 on EXCHANGE/RETURNS/ REFUNDS/CANCELLATION herein.


    g) All prices stated on the Platforms shall be the price of Products and AGSSB shall have the absolute discretion to determine the price of the Products at any time including without limitation any promotional prices. All prices, unless indicated otherwise are in Ringgit Malaysia and AGSSB reserves the right to enhance the currency offerings or limit the currency offerings at any time without notice. Prices shall be subject to changes as may be determined by AGSSB from time to time without notice.


    h) The price for the Products includes relevant goods and services tax unless otherwise determined by AGSSB. AGSSB shall be entitled to charge delivery and installation charges. AGSSB is determined to provide the most accurate pricing information but in some cases errors may occur, such as in cases when the price of an item is not displayed correctly. In the event that an item is mispriced, AGSSB may, at its own discretion, either inform and contact Customers for instructions or cancel an Order.


    3. PRODUCTS DESCRIPTION AND Availability

    a) Customers acknowledge that all images, photographs or videos of the Products presented, showcased, displayed, broadcasted and made available on the Platforms are for illustrative purposes only subject to the provisions on warranties in Section 7 below. AGSSB will attempt to ensure that all description of the Products shown are as accurate as possible. Although AGSSB has taken reasonable care to present the description of the Products accurately, the actual Products delivered may vary slightly from those shown on the Platforms due to reasons including without limitation any broadcast quality, packaging, redesign and improvements.

    b) The availability of the Products presented on the Platforms depends on availability of stock and AGSSB does not guarantee the availability of the Products. In order to ensure that Products are available to Customers, AGSSB has the right to set maximum limits in advance for the purchase of individual items by a single Customer. If the Products requested by the Customer are unavailable or out of stock, AGSSB shall make every effort to offer a substitute item which is closest in terms of price and type to the originally requested item and in this connection, AGSSB shall not be held liable in any manner whatsoever to the Customer. AGSSB shall also be entitled to carry out special promotions which offer free gifts or promotional items at its sole discretion from time to time subject to such terms as may be decided by AGSSB.

    4. Terms of Payment


    a) AGSSB reserves the rights to set the rules and policies regarding the payment methods and to make the necessary changes from time to time. Unless otherwise specified, the payment for Products purchased by any Customer may be made via any of the following methods (collectively “Payment Methods”):

    i) Credit Card and/or Debit Card (“Card(s)”)

    AGSSB accepts all types of Cards such as Visa, MasterCard and/or American Express Cards issued in Malaysia save that AGSSB is entitled to reject, revise or refuse the acceptance of any such Cards at its absolute discretion or to revise the types of Cards to be accepted without assigning any reasons or notice. However, no payments will be processed for a non-card holder and Customers shall comply with such terms and conditions as may be imposed by the issuing financial institution or bank. If a Card payment is rejected or declined for any reason, AGSSB reserves its rights under the Terms and Conditions to reject the relevant Order either in whole or in part.



    ii) Cash on delivery (COD)

    COD is available to a Customer who wishes to make payments for a Product upon delivery provided that COD may only be transacted up to Orders not exceeding RM1,000.00 per Order per Customer per day. Any Order having a value exceeding RM1,000.00 will be referred to payment via the credit card/debit card method. Customers shall make the full COD payment to AGSSB and/or AGSSB’s Delivery Provider at the point of delivery of the Product and upon receipt of the full payment, the Product will be handed over to the Customer.



    iii) Easy payment plan (EPP)

    Subject to such terms and conditions as may be decided by AGSSB at its absolute discretion and such terms imposed by the issuing bank, EPP is only applicable to Customers who purchase Products above a fixed amount via their credit cards. Customers are advised to enquire with AGSSB for details of any EPP facilities available or call the GO SHOP’s toll free number and speak to a Personal Go Shopper for details of any EPP facilities available.


    AGSSB shall be entitled at its discretion to revise, add or change the Payment Methods at any time and from time to time. Customers are advised to either view GO SHOP TV, the SITE or call AGSSB’s toll free number for further details on the Payment Methods.



    b) All successful payments made by a Customer via Cards or EPP will be confirmed and notified by AGSSB upon purchase by a Customer for an Order. In addition, an email confirmation together with a sales invoice which also serves as a receipt of payment will be sent to a Customer’s email, if any and the Customer shall also receive notification via SMS. A copy of the said sales invoice will also be provided to the Customer upon delivery of the Product save that AGSSB shall be entitled to revise, change or amend this provision at its absolute discretion without notice.

    c) In the event AGSSB shall discover any fraud, an attempt at deception or in the event of the suspicion of other illegal activities in connection with any payment made by any Customer in relation to any Product then AGSSB shall be entitled to without limitation to any rights of AGSSB herein, require a different means of payment from the Customer, or to refuse, cancel or reject an Order and/or close a Customer’s Account.

    5. Delivery


    a) AGSSB is entitled at its sole discretion at any time from time to time to appoint any third party (“Delivery Provider” which definition may include a Business Partner or its authorized personnel) to carry out logistics and delivery services including without limitation to deliver a Product to a Customer without giving notice of the same to the Customer. For certain Products that require installation, installation of the Product will be` carried out upon delivery. Customers are advised to call the GO SHOP’s toll free number and speak to a Personal Go Shopper on Products that require installation, if any.
    b) The Customer shall notify Personal Go Shopper if he/she intends to authorize a third party to receive delivery of the Product ordered and shall if requested by AGSSB or the Delivery Provider, provide an authorization letter to AGSSB or the Delivery Provider at the point of delivery for identification and verification purposes.
    c) Subject to the terms herein, delivery of the Products shall only be available to designated areas in Malaysia (which may be revised from time to time by AGSSB at its discretion) (“Designated delivery areas”) and to the address specified by the Customer in an Order, provided that such address falls within the Designated delivery areas. Customers are advised to check at the point of placing an Order on the Designated delivery areas and AGSSB shall be entitled to reject any delivery which is not within the Designated delivery areas.
    d) The delivery hours are within 9.00 am to 6.00 pm on a Business Day (“Delivery Hours”) subject to any revision as shall be determined by AGSSB. Any request for deliveries after the Delivery Hours is subject to the discretion of AGSSB and additional charges may apply. Customers are advised to call AGSSB’s toll free number if he/she wishes to request for a specific delivery date and time at the time of placing an Order subject to the availability of the Delivery Provider.
    e) Subject to the terms herein, any Order placed before 3.00pm on a Business Day will be subject to the following delivery periods (which may be revised by AGSSB at any time from time to time at its discretion):
    i) For deliveries within city areas in Peninsular Malaysia, Products will be delivered between 2 to 5 Business days.
    ii) For deliveries to and within city areas in East Malaysia, Products will be delivered within 3 to 7 Business days.
    iii) For deliveries to and within areas outside city areas nationwide, Products will be delivered between 3 to 8 Business Days.

    Orders made after 3.00pm shall be considered as orders which are placed on the following Business Day. Notwithstanding the above, delivery periods may vary for Products that consist of bulky items and/or that which require installation. Customers are advised to call the GO SHOP’s toll free number and speak to a Personal Go Shopper for further details.



    f) AGSSB will inform the Customer if it is unable to meet an estimated delivery date or time. In the event a Customer is not present at the address upon delivery then attempts will be made to fulfill the delivery and the Customer shall inform AGSSB’s call center to re-schedule the delivery. If the Customer fails to take delivery of any Product after the third attempt for delivery for any reason (otherwise than by reason of any cause beyond the Customer's reasonable control or by reason of AGSSB's fault) then without prejudice to any other right or remedy available to AGSSB, AGSSB may cancel the Order and refund any payment made by Customer back to the Customer. If the Customer requests for additional delivery attempts thereafter, Customer shall liaise with the Delivery Provider directly.

    g) Risk of damage to or loss of the Products shall pass to the Customer at the time of delivery or if the Customer wrongfully fails to take delivery of the Products at the time when AGSSB or the Delivery Provider has tendered delivery of the Products. Notwithstanding delivery and the passing of risk in the Products, the property and ownership in the Products shall not pass to the Customer until AGSSB has received payment in full of the price of the Products in an Order. To the extent permitted by law, AGSSB shall not be liable to any Customer for any losses, liabilities, costs, damages, charges and/or upon passing of risk to Customer.

    6. EXCHANGE/ RETURNS /CANCELLATION /REFUNDS


    EXCHANGES / RETURNS

    a) All Product exchanges and/or returns (including any repairs, damage, wrong delivered items), are subject to the following:

    i) Subject to Section 6(a)(iii), Customers can request for exchange or return of a Product within TEN (10) calendar days (“Returns Period”) from the date of the Customer’s receipt of the delivered Product (“Date of Product Receipt”). Customers are advised to perform checks on the spot upon receipt of a Product to ensure it is not damaged or defective. A Customer’s request for exchange or return shall not exceed Three (3) times or no later than thirty (30) days from the first Date of Product Receipt, whichever is earlier, subject to the remaining terms in this Section 6(a).
    ii) Requests for any returns and/or exchange during the Returns Period may be requested by a Customer via these methods:

    A) by calling in to AGSSB’s toll free number and seeking the assistance of the Personal Go Shopper or through AGSSB’s website;OR
    B) self-return service (“Self Return Service”) by Customer via d rop-off at specific collection points determined by AGSSB at its absolute discretion (“Collection Points” or “Collection Point” the list of which can be found on GO SHOP’s website at www.goshop.com.my) SUBJECT TO the following terms:

    • Prior to any d rop-off at a Collection Point, Customer must request for self-return by logging into the Customer’s account online via GO SHOP’s website at www.goshop.com.my OR via such manner determined by AGSSB from time to time. Only s elected Products (“Selected Products” which definition forms part of the definition of Product) may be d ropped off at a Collection Point and Customers are required to s elect the nearest Collection Point available and take note of the collection hours. Customers are advised to refer to www.goshop.com.my for full details on the Self Return Service.
    • All Selected Products returned by a Customer under this Self Return Service must comply with the terms and conditions on exchanges/returns under this Section 6. AGSSB and/or its servants, agents and authorized representatives including its Delivery Providers are entitled at its discretion to reject any Selected Product submitted by any Customer at a Collection Point for failure to comply with the required terms and conditions.
    • Customer acknowledges that in using this Self Return Service, it shall not hold AGSSB liable for any costs or expenses incurred by Customer including without limitation, travel costs and costs incurred for any failed attempt to d rop off any Product at a Collection Point,
    • All terms in relation to the return of a Selected Product under the Self-Return Service shall be subject to the other provisions herein unless otherwise specified.

    iii) No exchanges and/or returns are allowed after the Returns Period save and except for defective Products including repairs subject to the Product warranty conditions and applicable laws. For avoidance of doubt, a Customer is not entitled to any exchange or returns after the expiry of the warranty period of the Product subject to Section 6(a)(iii) below.
    iv) Notwithstanding anything to the contrary and unless decided otherwise by AGSSB at its absolute discretion, requirements for exchanges or returns shall be subject to the following failing which no returns or exchanges shall be allowed:

    • All Products (including any free gifts or free promotional items and warranty cards (if any) associated with the purchase) must be in their original packaging with all tags, accessories, sales invoice and warranty card (if any) enclosed and where any seal is attached, such seal must not be broken.
    • Undergarments and inner wear cannot be exchanged or returned for any reason whatsoever.
    • Perishable items (food or fresh produce) and cosmetic items (body care & skin care, makeup) cannot be returned nor exchanged if they have been partially consumed or used. • Fashion items (including shoes and accessories) can be exchanged due to issues relating to color and size. However, if items returned for exchange are soiled, damaged or shows some form of wear and tear, no exchange or return will be considered.
    • Subject to product warranty conditions, digital items (such as Smart TVs, tablets, phones, photo printers, digital cameras) cannot be exchanged or returned if the original seal is broken OR if there is no seal and the original packaging is opened.
    • No Product may be exchanged or returned if it is specified in the warranty card that no exchanges or returns are allowed.
    • All Products must be cleared of any defects or damage to the reasonable satisfaction of AGSSB and/or Business Partners and/or /supplier/manufacturer of Product before any exchange or returns of Products are completed or accepted by AGSSB.

    v) During the Returns Period, all exchanges or returns of any Product are collected or re-delivered by AGSSB free of charge. Thereafter, after the Returns Period, AGSSB shall be entitled to charge Customers a collection cost which shall be paid by the Customer to the Delivery Provider at the point of collection.


    vi) For avoidance of doubt, AGSSB shall have the absolute discretion to decide on what Products (including Selected Products under the Self Return Service) that may be exchanged or returned. Customers are advised to call AGSSB’s toll free number to speak with the Personal Go Shopper on the full list of items or check GO SHOP’s website at www.goshop.com.my.


    vii) During the Returns Period and subject to the terms contained herein, requests for exchange or returns are allowed for defective Products within any valid warranty period. After the Returns Period and where warranty period for a Product is still valid, the Customer must engage directly with the supplier or manufacturer (at their service center stated in the warranty card) if the Customer wishes to request and demand for any exchange or return. Where the service center of the supplier or manufacturer is not specified, then AGSSB may, at its sole discretion, and at the request of the Customer, collect the Product free of charge from the Customer and deliver the Product back to the supplier or manufacturer on behalf of the Customer. For avoidance of doubt, a Customer is not entitled to any exchange or returns after the expiry of the warranty period of the Product.



    CANCELLATION/REFUNDS

    b) Notwithstanding the terms of this Section 6(a) above, cancellation and refunds on returns requested for any Product during the Returns Period shall subject to the following:i) Customers may cancel an order prior to confirmed delivery of a Product and request for a refund if payment has been made (other than COD). Cancellation may be done by contacting any Personal Go Shopper. For avoidance of doubt once a Product has been confirmed for delivery and/or delivered and received by a Customer, the Order cannot be cancelled.

    ii) Requests for refunds and the process of refunds will be subject to the terms on exchange and returns in Section 6(a) above and refunds will be processed after the successful clearance of any defects or damage on the returned Product to the reasonable satisfaction of AGSSB. Customers may contact AGSSB for full details of such refund. Depending on the method of payment, refunds including the time frame of refunds are also subject to the terms imposed by the issuing bank. 


    c) For avoidance of doubt, unless otherwise stated herein, no request for exchange or returns or cancellations or refunds on a Product may be made by Customers after the Returns Period and the decision of AGSSB with regards to this shall be final and binding.


    7. WARRANTIES


    a) AGSSB will take reasonable steps to have all Products screened and inspected by AGSSB’s Business Partner who shall ensure that the Products are of the standard, quality, composition, style or model that they represent and as presented, displayed and broadcasted on GO SHOP TV. AGSSB does not take any responsibility for any inaccuracy or error in the presentation, display and broadcasting of such information. AGSSB binds itself only to exercise reasonable care when delivering the Products in accordance with the general description under which they were sold, whether or not any special or particular description shall have been given or shall be implied by law. Any such special or particular description shall be taken only as the expression of AGSSB's opinion in that regard.

    b) Subject to Section 8 below, AGSSB does not make any express or implied warranties, representations or endorsements including but not limited to any warranties of title, non-infringement, merchantability, usefulness, operation, completeness, accuracy, satisfactory quality, reliability or fitness for a particular purpose, in respect of  any Product sold to a Customer (and/or any free gift or promotional items given in relation to any such Product), the material, information and/or functions therein and expressly disclaims liability for all errors and omissions in such materials, information and/or functions.

    8. LIABILITY AND INDEMNITY


    a) To the full extent allowed by applicable law, the Customer agrees that AGSSB will not be liable to a Customer/or any third party for any claims against AGSSB for consequential or incidental loss and damages (including but not limited to loss of revenue, loss of profits, loss of goodwill, loss of reputation, loss of anticipated savings, wasted expenditure, loss of privacy and loss of data) or any other indirect, special or punitive damages whatsoever that arise out of or are related to any Product sold (including  free gifts or promotional items given in relation to any such Product) by AGSSB.

    b) AGSSB shall further be under no liability in respect of : a) any allergies or other health or medical condition suffered by a Customer; and b) any defect to any Product, arising from unsuitable or improper use, defective installation or commissioning by the Customer or third parties, fair wear and tear, willful damage, negligence, abnormal working conditions, defective or negligent handling, improper maintenance, excessive load, unsuitable operating materials and replacement materials, poor work, unsuitable foundation, chemical, electro-technical/electronic or electric influences, failure to follow instructions (whether oral or in writing) misuse or alteration or repair of the Product, addition and i nsertion of parts, in particular of spare parts which do not come from AGSSB without the approval of AGSSB. In this connection, the Customer shall indemnify AGSSB against each loss liability and cost arising out of such claims.
    c) The Customer shall indemnify and hold harmless AGSSB, its subsidiaries and affiliates from any claim or demand, or actions made by any third party due to or arising out of the Customer’s breach of these Terms and Conditions.
    d) To the extent permitted by law, AGSSB’s total liability to the Customer or any third party in respect of any cause of action, shall in no circumstances exceed, in aggregate, a sum equal to 100% of any aggregate amount paid by the Customer in respect of the relevant Products.


    e) Nothing in this Terms and Conditions shall exclude or limit our liability for (i) fraud; (ii) any breach of the consumer guarantees relating to the supply of products and/or services which cannot be excluded or limited pursuant to the Consumer Protection Act 1999; and (iii) any other liability which cannot be excluded or limited under any applicable law.   


    9. General TERMS


    a) AGSSB shall have the right, in its sole discretion and without notice, to suspend or terminate the Customer’s access to any Platforms if the Customer breaches any of these Terms and Conditions and including the Go Shop Terms and Conditions of Use and the Privacy Notice by giving fourteen (14) days’ written notice to the Customer. Upon any termination of this agreement, the Customer shall immediately cease all access to and use of the Platforms and AGSSB shall, in addition to any other legal or equitable remedies, immediately cancel the Account and deny access to and use of the Platforms to the Customer in whole or in part. Any termination of this agreement shall not affect the respective rights and obligations (including without limitation, payment obligations) of the parties arising before the date of termination.
    b) AGSSB shall not be liable for any breach of its obligations under the Terms and Conditions where it is hindered or prevented from carrying out its obligations by any event of force majeure or cause outside its reasonable control, (or by any damage caused by any of such events).
    c) These Terms and Conditions constitute the entire agreement between the parties with respect to the subject matter hereof.
    d) This Terms and Conditions shall be governed in all respects by the laws of Malaysia and the parties shall submit to the exclusive jurisdiction of the Malaysian courts.
    d) If any provision of this Agreement is held to be invalid or unenforceable, that provision shall be struck and the remaining provisions shall be enforced.
    f) Any communication or notice to AGSSB should be in writing to AGSSB’s address stated on AGSSB’s invoice. All correspondence and notices by AGSSB to the Customer will be sent in writing to the most recent mailing address provided by the Customer to AGSSB upon registration or via email to the email address provided by the Customer. Notices will be considered to be received upon hand delivery or upon the fifth business day after posting or upon receipt of the email.

  • 1.   TUJUAN


    Terma-terma dan syarat dinyatakan di sini ("Terma dan Syarat") adalah kontak atau perjanjian yang mentakrifkan hak, kewajipan dan tanggungjawab AGSSB dan Pelanggan berhubung dengan penjualan dan pembelian mana-mana Produk di PLATFORM. Apabila Pelanggan berhubung dengan Wakil Peribadi Go Shop, membuat pendaftaran Akaun atau membuat Pesanan dengan AGSSB atau menggunakan sebarang kemudahan yang disediakan oleh AGSSB mengenai pembelian mana-mana Produk di PLATFORM, Pelanggan adalah dengan ini dianggap sebagai telah membaca, menerima dan bersetuju untuk terikat dengan Terma dan Syarat ini.


    Terma dan Syarat ini hendaklah dibaca bersama-sama dengan semua maklumat yang diberikan kepada Pelanggan apabila membuat dan mengesahkan Pesanan termasuk tanpa had: a) Notis Privasi untuk penggunaan maklumat peribadi; dan b) Terma dan Syarat Penggunaan Go Shop; dan c) maklumat lain seperti mana yang diberikan kepada Pelanggan oleh AGSSB, kecuali bahawa jika adanya berlaku apa-apa percanggahan, Terma dan Syarat ini akan diikuti.  


    Berhubung dengan Pesanan dan pembelian dari PLATFORM, Pelanggan adalah dinasihatkan untuk menghubungi talian tol bebas Go Shop yang boleh didapati apabila menonton GO SHOP TV atau LAMAN INI untuk mendapatkan maklumat lanjut termasuk tanpa had kepada cara untuk memesan, kaedah pembayaran, penghantaran, dan/atau pulangan/ bayaran balik. Pelanggan juga adalah dinasihatkan untuk membaca Terma dan Syarat dan Notis Privasi sebelum membuat sebarang pembelian Produk. Terma dan Syarat dan Notis Privasi boleh didapati di atas talian di LAMAN INI. AGSSB berhak untuk menyediakan satu salinan Terma dan Syarat dan Notis Privasi atau dokumen lain behubung dengan penjualan dan pembelian Produk untuk Pelanggan bersama dengan penghantaran Produk.


    AGSSB mempunyai hak, untuk mengubahsuai, menambah atau mengeluarkan mana-mana bahagian daripada Terma dan Syarat ini serta maklumat yang diberikan kepada Pelanggan termasuk penggunaan PLATFORM pada bila-bila masa. Perubahan akan berkuatkuasa selepas ianya disiarkan di LAMAN INI atau dimaklumkan oleh AGSSB. Pembelian berterusan Produk oleh Pelanggan dari AGSSB dan/atau dari PLATFORM selepas perubahan tersebut kepada Terma dan Syarat ini akan dianggap sebagai penerimaan terhadap perubahan tersebut oleh Pelanggan. Sekiranya terdapat pencanggahan diantara Terma dan Syarat ini dengan versi Bahasa Inggeris, maka versi Bahasa Inggeris akan menyusuri versi Bahasa Malaysia.


     


    Definisi:

    "Akaun" bermakna akaun pendaftaran sekali yang diciptakan untuk Pelanggan oleh AGSSB yang mengandungi maklumat Pelanggan termasuk tanpa terhad nama, alamat, nombor kad pengenalan (NRIC/Mykad), nombor telefon dan/atau apa-apa maklumat lain sebagaimana yang diminta oleh AGSSB untuk tujuan pendaftaran.


     "AGSSB" atau "Kami" atau "GO SHOP” bermakna Astro GS Shop Sdn Bhd (Nombor Syarikat 1081077-X), sebuah syarikat yang diperbadankan di Malaysia dan mempunyai alamat berdaftar di 3rd Floor, All Asia Broadcast Centre, Technology Park Malaysia, Lebuhraya Puchong-Sungai Besi, Bukit Jalil, 57000 Kuala Lumpur, Malaysia.


    "Astro" bermakna MEASAT Broadcast Network Systems Sdn Bhd (Nombor Syarikat 240064-A), sebuah pengendali perkhidmatan TV dan satelit yang menyediakan data, perkhidmatan format definisi tinggi, perkhidmatan rakaman, bayar-tiap-tontonan, premium / acara-acara khas, video atas permintaan, interaktif dan perkhidmatan khusus yang lain (termasuk pakej berbayar saluran televisyen dan radio).


    "Hari Perniagaan" bermakna hari di mana bank-bank komersil adalah dibuka untuk perniagaan di Selangor (selain daripada hari Sabtu, Ahad dan cuti umum);


    "Rakan Kongsi Perniagaan" bermakna rakan kongsi perniagaan AGSSB yang mana produk dan/atau perkhidmatan adalah dipaparkan, diiklankan, dipromosikan atau ditawarkan untuk dijual di PLATFORM termasuk tanpa had pembekal, penjual, peniaga serta pihak ketiga yang lain.


    "Pelanggan" bermakna seorang individu yang membuat Pesanan dan membeli Produk melalui PLATFORM sama ada daripada AGSSB atau mana-mana Rakan Kongsi Perniagaan.


    GO SHOP TV” bermakna saluran televisyen pembelian yang dikendalikan oleh AGSSB yang kini boleh didapati di Astro Channel 118 dan Channel 303 (tertakluk kepada perubahan dari semasa ke semasa oleh AGSSB) yang menawarkan Produk untuk dijual melalui perkhidmatan kabel atau TV satelit untuk membolehkan Pelanggan untuk membuat Pesanan untuk setiap Produk melalui telefon atau cara komunikasi yang lain;


    "Pesanan" bermakna segala pesanan yang diserahkan atau dibuat oleh Pelanggan kepada AGSSB untuk membeli Produk sama ada daripada AGSSB atau Rakan Kongsi Perniagaan.


    "PLATFORM " bermakna termasuk GO SHOP TV, LAMAN INI dan/atau lain platform, lokasi atau kedai dimana Produk diiklankan, dipromosi, ditawakan atau dijual oleh AGSSB.


    "Produk" bermakna apa-apa produk / barangan / perkhidmatan / tawaran / paparan yang dimuat naik / dipamerkan / dipaparkan / disiarkan dan / atau ditawarkan untuk dijual di PLATFORM.


    "Wakil Peribadi Go Shop" bermakna ejen pusat panggilan AGSSB.


    "LAMAN INI" bermakna laman web GO SHOP di www.goshop.com.my, m.goshop.com.my (laman web mudah alih) dan / atau lain-lain aplikasi mudah alih/aplikasi interface mudah alih/aplikasi dan perkhidmatan yang disediakan oleh AGSSB yang menyediakan tempat / platform kepada pengguna LAMAN INI dan/atau Pelanggan untuk pembelian Produk yang dipaparkan, dipamerkan, dan/atau ditawarkan untuk dijual di LAMAN iNI.


    "Terma dan Syarat" bermakna terma dan syarat seperti yang dinyatakan di sini termasuk semua jadual, lampiran, dan akan termasuk rujukan kepada perjanjian ini sebagaimana yang dipinda, menafikan, ditambah, diubah atau digantikan dari semasa ke semasa.


    "Terma dan Syarat Penggunaan" bermakna terma dan syarat berkaitan dengan penggunaan PLATFORM yang dipaparkan di LAMAN INI.


    2. PENDAFTARAN, PENERIMAAN PESANAN DAN HARGA


    2.1 Sebelum membuat Pesanan pertama dari AGSSB, Pelanggan mesti melaksanakan pendaftaran sekali sahaja dan penciptaan Akaun baru dengan: (a) menghubungi talian tol bebas  Go Shop yang dipaparkan pada GO SHOP TV dan bercakap dengan Wakil Peribadi Go Shop yang sedia membantu Pelanggan untuk mendaftarkan Akaun baru; atau (b) Pelanggan melaksanakan sendiri serta mencipta Akaun baru pada LAMAIN INI, atau (c) lain-lain cara pendaftraan untuk mencipta Akaun baru sepertimana yang dinyatakan oleh AGSSB dari semasa ke semasa. Pelanggan hendaklah mematuhi Terma dan Syarat yang diberikan oleh AGSSB berhubung dengan pendaftaran Akaun dan penggunaan PLATFORM.


    2.2 Untuk mendaftar, Pelanggan mestilah berusia 18 tahun ke atas pada semasa pendaftaran dan mempunyai alamat tempatan yang ditetapkan di Malaysia. Pelanggan mesti memberikan sebatang maklumat yang diperlukan oleh AGSSB bagi tujuan pendaftaran. Bagi pendaftaran pada LAMAN INI, Pelanggan dikehendaki memberikan alamat e-mel yang sah dan kata laluan setelah melengkapkan proses pendaftaran Akaun. Pelanggan bertanggungjawab untuk menjaga kerahsiaan kata laluan dan alamat e-mel dan bertanggungjawab sepenuhnya terhadap semua aktiviti yang berlaku berkenaan penggunaan kata laluan atau alamat e-mel tersebut, sama ada secara terang-terangan diberi kebenaran oleh Pelanggan dan/atau digunakan oleh Pelanggan. Pelanggan bersetuju untuk memaklumkan kepada AGSSB dengan segera jika ada pihak ketiga mendapat kebenaran menggunakan kata laluan tersebut atau jika Pelanggan mendapati ada pihak menggunakan alamat e-mel Pelanggan tanpa kebenaran atau sebarang pelanggaran keselamatan yang Pelanggan mungkin tahu.


    2.3 Setelah pendaftaran sepertimana yang dinyatakan di atas, Akaun akan dicipta untuk Pelanggan. Pelanggan hanya perlu membuat pendaftaran Akaun untuk sekali sahaja. Untuk Pesanan berikutnya, Pelanggan hanya perlu melalui proses pengesahan AGSSB. Tertakluk kepada terma dan syarat yang terkandung di sini, AGSSB berhak untuk menolak Akaun baru atau untuk membatalkan Akaun yang sedia ada pada bila-bila masa mengikut budi bicaranya. AGSSB berhak untuk menamatkan mana-mana Akaun yang tidak aktif yang tidak digunakan untuk tempoh enam (6) bulan atau lebih.


    2.4 Pelanggan bersetuju untuk: (a) memberikan maklumat yang benar, tepat, terkini dan lengkap mengenai diri Pelanggan seperti yang dikehendaki dalam borang pendaftaran Akaun dan (b) mengekalkan dan mengemaskinikan data pendaftaran itu untuk memastikan ia tepat, terkini dan lengkap. Jika Pelanggan memberikan sebarang maklumat yang tidak benar, tidak tepat, tidak terkini atau tidak lengkap, atau jika AGSSB mengesyaki bahawa maklumat tersebut adalah tidak benar, tidak tepat, tidak terkini atau tidak lengkap, AGSSB mempunyai hak untuk menggantung atau menamatkan Akaun Pelanggan.


    2.5 Akaun Pelanggan tidak boleh dipindah milik dan tidak boleh diberikan kepada mana-mana pihak ketiga. Pelanggan bersetuju untuk (i) memberitahu AGSSB dengan segera atas sebarang penggunaan yang tidak dibenarkan atau sebarang pelanggaran keselamatan dan (ii) memastikan bahawa Pelanggan keluar daripada Akaun dengan betul di setiap penghujung sesi di LAMAN INI. AGSSB tidak akan bertanggungjawab terhadap sebarang kerugian atau kerosakan yang timbul daripada kegagalan Pelanggan untuk mematuhi peruntukan ini.


    2.6 Pelanggan boleh menamatkan dan menutupi Akaun melalui e-mel kepada AGSSB di alamat e-mel AGSSB yang dinyatakan di LAMAN INI dari alamat e-mel yang diberikan oleh Pelanggan pada masa Pelanggan membuka Akaun dan mencipta alamat e-mel Pelanggan. E-mel Pelanggan mesti menentukan alamat e-mel Pelanggan, dan Pelanggan mesti menyatakan dengan jelas bahawa Pelanggan ingin menamatkan Akaun Pelanggan. Sebagai alternatif, Pelanggan boleh menghubungi talian tol bebas Go Shop dan mendapatkan bantuan dari Wakil Peribadi Go Shop untuk menamatkan dan menutupi Akaun.


    2.7 Tertakluk kepada peruntukan-peruntukan Akta Jualan Langsung Dan Skim Anti-Piramid 1993 (Akta 500) (sepertimana yang dipinda atau digantikan dari semasa ke semasa), Pelanggan mempunyai hak untuk membatalkan kontrak (termasuk Akaun) dengan AGSSB sebelum tamat tempoh bertenang selama sepuluh (10) Hari Perniagaan dari tarikh pendaftaran Akaun yang berjaya dicipta. Untuk mengelakkan keraguan, apabila Pelanggan telah berjaya membuat Pesanan dengan AGSSB, di mana Pelanggan memerlukan penghantaran Produk yang dipesan dari AGSSB sebelum tempoh bertenang tersebut tamat, maka Pesanan tersebut merupakan notis daripada Pelanggan kepada AGSSB untuk mengetepikan haknya untuk membatalkan kontrak (termasuk Akaun).


    2.8 Syarat umum memesan


    a) Untuk membuat Pesanan dengan AGSSB, Pelanggan mesti melengkapkan proses pendaftaran seperti mana yang dinyatakan dalam Seksyen 2 di atas sebelum waktu membuat Pesanan, jika tidak, AGSSB mempunyai hak untuk menerima, menolak, membatalkan atau menolak mana-mana Pesanan yang dibuat.


    b) Sebarang Pesanan yang dibuat oleh Pelanggan hendaklah termasuk maklumat yang berikut:


    •Nama produk dan khusus (warna, saiz, dan lain-lain).
    •kaedah pembayaran dan butiran.
    •Alamat penghantaran.

    c) Sesuatu Pesanan yang berjaya dibuat oleh Pelanggan akan disahkan kepada Pelanggan melalui Perkhidmatan Pesanan Ringkas (SMS) dan / atau melalui pengesahan mel elektronik yang mengandungi ringkasan butiran Pesanan dan / atau mana-mana kaedah lain yang diputus oleh AGSSB dari semasa ke semasa tanpa notis.


    d) AGSSB berhak untuk menerima, menolak, membatalkan atau menolak sebarang Pesanan dari mana-mana Pelanggan atau mana-mana orang pada bila-bila masa atau di bawah sebarang keadaan termasuk di mana Pesanan tidak boleh diproses atas pelbagai alasan. Pelanggan mungkin akan diminta untuk memberi pengesahan atau maklumat tambahan sebelum Pesanan tersebut diterima.


    e) Selain dari yang dinyatakan di atas, penolakan suatu Pesanan oleh AGGSB mungkin disebabkan oleh, tidak terhad kepada mana-mana yang berikut:



    • Produk yang dipesankan oleh Pelanggan adalah tidak tersedia atau kehabisan stok;
    • AGSSB tidak dapat memperoleh kebenaran bagi pembayaran Pelanggan;
    • Penemuan kesilapan harga atau keterangan produk;
    • Jika ada maklumat yang palsu, yang tertinggal, maklumat yang salah dalam pendaftaran Akaun Pelanggan;
    • Jika Pelanggan didapati di bawah umur 18 tahun;
    • Jika AGSSB percaya bahawa ia tidak dapat memenuhi Pesanan (termasuk penghantaran) secara teknikal.

    f) Sebarang perubahan atau pembatalan oleh Pelanggan keatas mana-mana Pesanan hendaklah dimaklumkan kepada Wakil Peribadi Go Shop dengan syarat bahawa dimana Pesanan yang telah dibayar, dihantar atau penghantaran yang belum selesai tidak boleh dibatalkan tetapi sebaliknya Produk mesti dikembalikan mengikut Seksyen 6 -  PERTUKARAN / PULANGAN / PEMBATALAN / PEMULANGAN WANG yang dinyatakan di sini.


    g) Semua harga yang dinyatakan pada PLATFORM adalah harga Produk dan AGSSB mempunyai budi bicara mutlak untuk menentukan harga Produk pada setiap masa termasuk tanpa had sebarang harga promosi. Semua harga, melainkan jika dinyatakan sebaliknya adalah dalam Ringgit Malaysia dan AGSSB berhak untuk meningkatkan penawaran mata wang atau menghadkan penawaran mata wang pada bila-bila masa tanpa notis. Harga adalah tertakluk kepada perubahan yang ditentukan oleh AGSSB dari semasa ke semasa tanpa notis.


    h) Harga untuk Produk termasuk cukai berkaitan dengan barangan dan perkhidmatan melainkan ditentukan oleh AGSSB. AGSSB berhak untuk mengenakan caj penghantaran dan pemasangan caj. AGSSB berazam untuk memberikan maklumat harga yang paling tepat pada PLATFORM tetapi kes kesilapan mungkin berlaku, sepertimana kes-kes apabila harga tidak dipaparkan dengan betul pada PLATFORM. Sekiranya terdapat kesalahan pada barang, AGSSB boleh, mengikut budi bicaranya, sama ada menghubungi Pelanggan untuk arahan atau membatalkan Pesanan Pelanggan.


    3. KETERANGAN DAN KETERSEDIAAN PRODUK 


    a) Pelanggan mengakui bahawa semua imej, gambar atau video dari Produk yang dibentangkan, dipamerkan, dipaparkan, disiarkan dan disediakan di PLATFORM adalah untuk tujuan ilustrasi sahaja tertakluk kepada peruntukan-peruntukan mengenai jaminan dalam Seksyen 7 di bawah. AGSSB akan cuba untuk memastikan bahawa semua penerangan ke atas sesuatu Produk yang dipaparkan di PLATFORM adalah setepat yang mungkin. Walaupun AGSSB telah mengambil langkah yang sewajarnya untuk membentangkan keterangan Produk dengan tepat, tetapi Produk sebenar yang dihantar mungkin berbeza daripada yang dipaparkan di PLATFORM atas sebab termasuk tanpa had kualiti siaran, kemasan, reka bentuk semula dan penambahbaikan.


    b) Ketersediaan Produk yang dibentangkan di PLATFORM bergantung pada ketersediaan stok dan AGSSB tidak menjamin ketersediaan Products. Dalam usaha untuk memastikan bahawa Produk adalah sedia ada kepada Pelanggan, AGSSB mempunyai hak untuk menetapkan had maksimum terlebih dahulu bagi pembelian barangan individu oleh seorang Pelanggan. Jika Produk yang diminta oleh Pelanggan tidak tersedia atau kehabisan stok, AGSSB akan berusaha sedaya upaya untuk menawarkan barang gantian yang paling hampir dari segi harga dan jenis produk yang diminta sebelumnya dan dalam hubungan ini, AGSSB tidak akan bertanggungjawab dalam apa cara sekalipun kepada Pelanggan. AGSSB juga berhak untuk menjalankan promosi khas yang menawarkan hadiah percuma atau barangan promosi mengikut budi bicara mutlaknya dari semasa ke semasa tertakluk kepada apa-apa terma sebagaimana yang diputuskan oleh AGSSB.



    4. Syarat pembayaran


    a) AGSSB berhak untuk menetapkan peraturan dan dasar mengenai kaedah pembayaran serta membuat perubahan yang diperlukan dari semasa ke semasa. Melainkan dinyatakan sebaliknya, bayaran bagi Produk yang dibeli daripada PLATFORM oleh mana-mana Pelanggan boleh dibuat melalui mana-mana kaedah berikut (secara kolektif "Kaedah Pembayaran"):


    i) Kad Kredit dan / atau Kad Debit ("Kad")

    AGSSB menerima semua kad seperti Visa, MasterCard dan/atau Kad American Express yang dikeluarkan di Malaysia tetapi AGSSB berhak menyemak semula atau menolak penerimaan mana-mana Kad atau menukar jenis Kad yang akan diterima mengikut budi bicara mutlaknya tanpa memberikan sebarang alasan atau notis. Walau bagaimanapun, tiada pembayaran akan diproses bagi seorang yang bukan pemegang kad dan Pelanggan hendaklah mematuhi sebarang terma dan syarat sebagaimana yang dikenakan oleh institusi kewangan atau bank. Jika pembayaran Kad telah ditolak atau ditolak atas mana-mana sebab, AGSSB mempunyai haknya di bawah Terma dan Syarat untuk menolak Pesanan yang berkaitan sama ada secara keseluruhan atau sebahagian.


    ii) Pembayaran secara Tunai Waktu Terima atau “Cash on Delivey” (COD)

    COD boleh digunakan oleh Pelanggan yang ingin membuat pembayaran apabila Produk dihantar kepada Pelanggan dengan syarat COD hanya boleh digunakan untuk Pesanan yang tidak melebihi RM1,000.00 bagi setiap Pesanan untuk seorang Pelanggan setiap hari. Sebarang Pesanan yang mempunyai nilai melebihi RM1,000.00 akan dirujuk kepada pembayaran melalui kaedah kad kad kredit/kad debit. Pelanggan hendaklah membuat bayaran COD sepenuhnya kepada AGSSB dan/atau Pembekal Penghantaran AGSSB semasa penghantaran Produk dan setelah menerima bayaran yang penuh, Produk akan diserahkan kepada Pelanggan.


    iii) Pelan pembayaran mudah (ansuran) atau “Easy Payment Plan” (EPP)

    Tertakluk kepada mana-mana terma dan syarat sebagaimana yang diputuskan oleh AGSSB mengikut budi bicara mutlaknya dan mana-mana terma yang dikenakan oleh bank, EPP hanya boleh digunakan oleh Pelanggan yang membeli produk di atas jumlah yang ditetapkan melalui kad kredit mereka. Pelanggan adalah dinasihatkan untuk menghubungi AGSSB untuk butiran mengenai mana-mana kemudahan EPP atau menghubungi talian tol bebas GO SHOP dan bercakap dengan Wakil Peribadi Go Shop untuk butiran mengenai mana-mana kemudahan EPP yang sedia ada.


    AGSSB berhak mengikut budi bicaranya untuk menyemak semula, menambah atau mengubah Kaedah Pembayaran pada bila-bila masa dan dari semasa ke semasa. Pelanggan adalah dinasihatkan untuk menonton GO SHOP TV atau LAMAN INI atau menghubungi talian tol bebas Go Shop untuk maklumat lanjut mengenai Kaedah Pembayaran.



    b) Semua pembayaran yang berjaya dibuat oleh Pelanggan melalui Kad atau EPP akan disahkan dan dimaklumkan oleh oleh AGSSB semasa pembelian oleh Pengguna untuk sesuatu Pesanan. Di samping itu, satu pengesahan e-mel bersama-sama dengan invois penjualan yang juga berfungsi sebagai tanda penerimaam pembayaran akan dihantar ke e-mel Pelanggan, jika ada dan Pelanggan juga menerima pemberitahuan melalui SMS. Sesalinan invois jualan tersebut juga akan disediakan kepada Pelanggan semasa penghantaran Produkkecuali AGSSB berhkak untuk menyemak, mengubah atau meminda peruntukan ini mengikut budi bicara mutlaknya tanpa notis.
    c) Sekiranya AGSSB menemui sebarang penipuan, percubaan untuk penipuan atau sekiranya berlaku kecurigaan aktiviti yang menyalahi undang-undang yang berkaitan dengan apa-apa bayaran yang dibuat oleh mana-mana Pelanggan berhubung dengan mana-mana Produk, AGSSB berhak untuk tetapi tidak terhad kepada mana-mana hak AGSSB di sini, untuk meminta kaedah pembayaran yang berlainan daripada Pelanggan, atau untuk menolak, membatalkan atau menolak Pesanan dan / atau menutup Akaun Pelanggan terebut.

    5. penghantaran


    a) AGSSB berhak mengikut budi bicara mutlaknya pada bila-bila masa dari semasa ke semasa untuk melantik mana-mana pihak ketiga ("Pembekal Penghantaran" dimana definisi mungkin termasuk Rakan Kongsi Perniagaan atau kakitangan yang diberi kuasa) untuk melaksanakan perkhidmatan logistik dan penghantaran termasuk tanpa had untuk menghantar Produk kepada Pelanggan tanpa memberi notis yang sama kepada Pelanggan. Bagi Produk tertentu yang memerlukan pemasangan, pemasangan Produk akan dijalankan semasa penghantaran. Pelanggan adalah dinasihatkan untuk menghubungi talian tol bebas GO SHOP dan bercakap dengan Wakil Peribadi Go Shop mengenai Produk yang memerlukan pemasangan, jika ada.

    b) Pelanggan hendaklah memaklumkan Wakil Peribadi Go Shop jika beliau bercadang untuk memberi kuasa kepada pihak ketiga untuk menerima penghantaran Produk yang dipesan dan jika diminta oleh AGSSB atau pembekal Penghantaran, hendaklah menyediakan surat kebenaran kepada AGSSB atau Pembekal Penghantaran semasa penghantaran bagi pengenalan dan tujuan pengesahan.

    c) Tertakluk kepada terma-terma yang terkandung di sini, penghantaran Produk hanya disediakan untuk kawasan-kawasan tertentu di Malaysia (yang boleh diubah oleh AGSSB dari semasa ke semasa mengikut budi bicaranya) ("Kawasan penghantaran yang ditetapkan") dan kepada alamat yang dinyatakan oleh Pelanggan di dalam Pesanan, dengan syarat bahawa alamat tersebut adalah di dalam Kawasan penghantaran yang ditetapkan. Pelanggan adalah dinasihatkan untuk membuat pemeriksaan semasa membuat Pesanan di Kawasan penghantaran yang ditetapkan dan AGSSB berhak untuk menolak sebarang penghantaran yang tidak terletak di dalam Kawasan penghantaran yang ditetapkan.

    d) Waktu penghantaran adalah dari 9:00 pagi hingga 18:00 petang pada Hari Perniagaan ("Waktu Penghantaran") tertakluk kepada sebarang perubahan yang ditentukan oleh AGSSB. Sebarang permintaan untuk penghantaran selepas Waktu Penghantaran adalah tertakluk kepada budi bicara AGSSB dan caj tambahan akan dikenakan. Pelanggan adalah dinasihatkan untuk menghubungi talian til bebas AGSSB jika beliau ingin meminta penghantaran pada masa dan hari yang tertentu semasa membuat Pesanan tertakluk kepada ketersediaan Pembekal Penghantaran.

    e) Tertakluk kepada terma-terma yang terkandung di sini, sebarang Pesanan yang dibuat sebelum 15:00 petang pada Hari Perniagaan akan tertakluk kepada tempoh penghantaran berikut (yang boleh diubah oleh AGSSB pada bila-bila dari semasa ke semasa mengikut budi bicaranya):
    i) Untuk penghantaran di dalam kawasan bandar sekitar Semenanjung Malaysia, Produk akan dihantar antara masa 2 hingga 5 Hari Perniagaan.
    ii) Untuk penghantaran ke dan di kawasan bandar di Malaysia Timur, Produk akan dihantar dalam masa 3 hingga 7 Hari Perniagaan.
    iii) Untuk penghantaran ke dan di luar kawasan bandar di seluruh negara, Produk akan dihantar dalam masa 3 hingga 8 Hari Perniagaan.

    Pesanan yang dibuat selepas 15:00 petang akan dianggap sebagai Pesanan yang dibuat pada Hari Perniagaan yang berikutnya. Selain dari yang dinyatakan di atas, tempoh penghantaran mungkin berbeza untuk Produk yang terdiri daripada barangan berat dan / atau yang memerlukan pemasangan. Pelanggan adalah dinasihatkan untuk menghubungi talian tol bebas Go Shop dan bercakap dengan Wakil Peribadi Go Shop untuk maklumat lanjut.



    f) AGSSB akan memaklumkan kepada Pelanggan sekiranya tidak dapat memenuhi anggaran tarikh atau waktu penghantaran. Sekiranya Pelanggan tidak berada di alamat semasa penghantaran, percubaan penghantaran akan dilaksanakan dan Pelanggan hendaklah menghubungi pusat panggilan AGSSB untuk membuat jadual-penghantaran semula. Jika Pelanggan telah gagal untuk menerima penghantaran Produk selepas percubaan kali ketiga atas mana-mana sebab (selain daripada sebab yang di luar kawalan munasabah pihak Pelanggan atau atas sebab kesalahan AGSSB) maka tanpa penjejaskan sebarang hak atau remedi yang disediakan kepada AGSSB, AGSSB boleh membatalkan Pesanan dan membayar balik sebarang bayaran yang dibuat oleh Pelanggan kepada Pelanggan. Jika Pelanggan meminta untuk penghantaran tambahan selepas itu, Pelanggan hendaklah berhubung terus dengan Pembekal Penghantaran.
    g) Risiko kerosakan atau kehilangan Produk boleh berpindah kepada Pelanggan pada masa penghantaran atau jika Pelanggan gagal menerima penghantaran Produk semasa AGSSB atau Pembekal Penghantaran telah mengemukakan penghantaran Produk. Selain dari yang dinyatakan penghantaran dan perpindahan risiko dalam Produk, harta dan pemilikan dalam Produk tidak berpindah kepada Pelanggan sehingga AGSSB telah menerima bayaran sepenuhnya bagi Produk di dalam Pesanan. Setakat yang dibenarkan oleh undang-undang, AGSSB tidak bertanggungjawab kepada mana-mana Pelanggan atas sebarang kerugian, liabiliti, kos, ganti rugi, caj dan/atau setelah perpindahan risiko kepada Pelanggan.

    6. PERTUKARAN/PULANGAN/ PEMBATALAN / PEMULANGAN WANG


    PERTUKARAN / PULANGAN


    A) Semua pertukaran dan / atau pulanganProduk (termasuk sebarang pembaikan, kerosakan, Produk yang salah dihantar), tertakluk kepada yang berikut:
    i) Tertakluk kepada Seksyen 6 (a)(iii), Pelanggan adalah dibenarkan untuk meminta pertukaran atau pemulangan Produk dalam masa SEPULUH (10) hari kalendar ("Tempoh Pulangan") dari tarikh penerimaan Produk yang dihantar oleh Pelanggan Produk ("Tarikh Penerimaan Produk"). Pelanggan adalah dinasihatkan untuk melakukan pemeriksaan semasa menerima Produk supaya Produk yang diterima tidak rosak atau tidak sempurna. Permintaan Pelanggan untuk pertukaran atau pemulangan tidak boleh melebihi tiga (3) kali atau tidak selewatnya daripada tiga puluh (30) hari dari Tarikh Penerimaan Produk, yang mana lebih awal, tertakluk kepada terma lain di dalam Seksyen 6(a) ini.
    ii) Permintaan bagi mana-mana pulangan dan / atau pertukaran semasa Tempoh Pulangan boleh dilakukan oleh seorang Pelanggan melalui cara-cara berikut:

    A)     dengan menghubungi talian tol bebas Go Shop dan mendapatkan bantuan daripada Wakil Peribadi Go Shop atau melalui laman web AGSSB; ATAU


    B)     perkhidmatan pulangan sendiri (“Perkhidmatan Pulangan Sendiri”) oleh Pelanggan melalui “d rop-off” di pusat-pusat pengumpulan yang ditentukan oleh AGSSB mengikut budi bicara mutlaknya (“Pusat-Pusat Pengumpulan” atau “Pusat Pengumpulan” yang mana senarainya boleh didapati memalui laman web GO SHOP di www.goshop.com.my) TERTAKLUK KEPADA terma-terma berikut:


    • Sebelum sebarang “d rop-off” di suatu Pusat Pengumpulan, Pelanggan mesti meminta pulangan sendiri dengan log masuk ke dalam akaun Pelanggan melalui laman web GO SHOP di www.goshop.com.my ATAU melalui apa-apa cara yang ditentukan oleh AGSSB dari semasa ke semasa. Hanya Produk yang terpilih (“Produk Terpilih” yang mana definisinya merupakan sebahagian daripada definisi Produk) yang boleh “d rop-off” di suatu Pusat Pengumpulan dan Pelanggan-Pelanggan diperlukan untuk memilik Pusat Pengumpulan yang terdekat dan mengambil perhatian terhadap waktu pengunmpulan. Pelanggan adalah dinasihati merujuk kepada www.goshop.com.my untuk butiran-butiran penuh mengenai Perkhidmatan Pulangan Sendiri.
    • Semua Produk Terpilih yang dipulangkan oleh seorang Pelanggan melalui Perkhidmatan Pulangan Sendiri mesti mematuhi terma dan syarat pertukaran/pulangan di bawah Seksyen 6 ini. AGSSB dan/atau orang gaji, agen dan wakil yang diberikuasa AGSSB termasuk Pembekal Penghantaran berhak untuk menolak sebarang Produk Terpilih yang dihantar oleh seorang Pelanggan kepada suatu Pusat Pengumpulan mengikut budi bicaranya oleh sebab kegagalan untuk mematuhi terma dan syarat yang diperlukan.
    • Pelanggan mengakui bahawa dengan menggunakan Perkhidmatan Pulangan Sendiri ini, dia tidak akan memutuskan bahawa AGSSB bertanggungjawab atas sebarang kos atau perbelanjaan yang ditanggung oleh Pelaggan, termasuk kos perjalanan dan kos yang ditanggung untuk sebarang percubaan gagal untuk “d rop off” sebarang Produk di suatu Pusat Pengumpulan.
    • Semua terma-terma yang berkaitan dengan pulangan suatu Produk Terpilih di bawah Perkhidmatan Pulangan Sendiri akan tertakluk kepada peruntukan-peruntukan lain di sini melainkan dinyatakan sebaliknya.

    iii) Tiada pertukaran dan/atau pulangan dibenarkan selepas Tempoh Pulangan melainkan Produk yang defektif termasuk pembaikan yang tertakluk kepada terma jaminan Produk dan undang-undang. Untuk mengelakkan keraguan, Pelanggan tidak dibenarkan untuk membuat pertukaran atau pulangan selepas tempoh jaminan Produk tamat tertakluk kepada Seksyen 6 (a) (iii) dibawah.
    iv) Selain dari yang dinyatakan di atas dan tertakluk kepada pertimbangan AGSSB mengikut budi bicara mutlaknya, permintaan untuk pertukaran atau pulangan hendaklah tertakluk kepada syarat berikut dimana pulangan atau pertukaran tidak dibenarkan jika syarat berikut gagal dipatuhi:
    • Semua Produk (termasuk sebarang hadiah percuma atau barangan promosi percuma dan kad jaminan (jika ada) yang berkaitan dengan pembelian) mesti berada di dalam bungkusan asal dengan semua tag, aksesori, invois jualan dan kad jaminan (jika ada) yang dilampirkan dan di mana meterai asal (original seal) dilampirkan, meterai itu mesti tidak terpatah.
    • Pakaian dalaman tidak boleh ditukarganti atau dipulangkan walaupun diatas sebarang alasan.
    • Barangan yang mudah rosak (makanan atau produk segar) dan barangan kosmetik (penjagaan badan & penjagaan kulit, alat solek) tidak boleh dipulangkan atau ditukarganti jika sebahagian daripadanya telah dimakan atau digunakan.
    • Barangan fesyen (termasuk kasut dan aksesori) boleh ditukar atas sebab yang berkaitan dengan warna dan saiz. Walau bagaimanapun, jika barangan yang dikembalikan untuk pertukaran telah kotor, rosak atau lusuh, pertukaran atau pemulangan tidak akan dipertimbangkan.
    • Tertakluk kepada terma dan syarat jaminan produk, barangan digital (seperti TV Pintar, tablet, telefon, pencetak foto, kamera digital) tidak boleh ditukarganti atau dipulangkan jika meterai asal (original seal) rosak ATAU sekiranya tiada meterai asal dan bungkusan asal dibuka.
    • Tiada produk boleh ditukarganti atau dipulangkan jika di dalam kad jaminan terdapat penyataan bahawa tiada pertukaran atau pulangan adalah dibenarkan.
    • Semua Produk mesti bebas daripada sebarang ketidaksempurnaan atau kerosakan mengikut penilaian munasabah oleh AGSSB dan/atau Rakan Perniagaan dan/atau pengilang Produk sebelum sebarang pertukaran atau pulangan Produk disempurnakan atau diterima oleh AGSSB.

    v) Dalam Tempoh Pulangan, sebarang pertukaran atau pulangan Produk yang diambil atau yang dihantar semula oleh AGSSB adalah percuma. Selepas Tempoh Pulangan, AGSSB berhak untuk mengenakan kos koleksi atas Pelanggan dimana kos hendaklah dibayar oleh Pelanggan kepada Pembekal Penghantaran sewaktu pengambilan.
    vi) Untuk mengelakkan keraguan, AGSSB mempunyai budi bicara mutlak untuk membuat keputusan mengenai Produk (termasuk Produk Terpilih di bawah Perkhidmatan Pulangan Sendiri) yang boleh ditukarganti atau dikembalikan. Pelanggan adalah dinasihatkan menghubungi talian tol bebas Go Shop dan bercakap dengan Wakil Peribadi Go Shop mengenai senarai penuh Produk atau menyemak laman web GO SHOP di www.goshop.com.my.
    vii) Semasa Tempoh Pulangan dan tertakluk kepada syarat-syarat yang terkandung di sini, permintaan untuk pertukaran atau pulangan adalah dibenarkan untuk Produk yang rosak semasa tempoh sah jaminan. Selepas Tempoh Pulangan dan semasa tempoh sag jaminan bagi Produk, Pelanggan perlu menghubungi pembekal atau pengilang (di pusat perkhidmatan mereka seperti yang tertera pada kad jaminan) secara terus sekiranya Pelanggan ingin meminta pertukaran atau kembali. Di mana pusat perkhidmatan pembekal atau pengilang tidak dinyatakan, maka AGSSB berhak, mengikut budi bicara mutlaknya, dan di atas permintaan Pelanggan, memungut Produk secara percuma daripada Pelanggan dan menghantar Produk tersebut kepada pembekal atau pengilang bagi pihak Pelanggan. Untuk mengelakkan keraguan, Pelanggan tidak berhak untuk meminta sebarang pertukaran atau pemulangan selepas tamat tempoh jaminan Produk.

    PEMBATALAN / PEMULANGAN WANG

    b)         Selain dari yang dinyatakan di Seksyen 6 (a) di atas, pembatalan dan bayaran balik yang diminta bagi mana-mana Produk semasa Tempoh Pulangan hendaklah tertakluk kepada yang berikut:


    i) Pelanggan boleh membatalkan pesanan sebelum penghantaran Produk telah disahkan dan permintaan bayaran balik dapat dilakukan jika bayaran telah dibuat (selain daripada COD). Pembatalan boleh dilakukan dengan menghubungi Wakil Peribadi Go Shop. Untuk mengelakkan keraguan apabila Produk telah disahkan untuk penghantaran dan/atau diserahkan dan diterima oleh Pelanggan, Pesanan tidak boleh dibatalkan.
    ii)     Permintaan untuk pembayaran balik dan proses bayaran balik akan tertakluk kepada terma pertukaran dan pemulangan di Seksyen 6(a) di atas dan bayaran balik akan diproses setelah pemeriksaan Produk yang dikembalikan adalah bebas daripada sebarang ketidaksempurnaan atau kerosakan mengikut penilaian munasabah AGSSB. Pelanggan boleh menghubungi AGSSB mengenai maklumat lanjut atas pembayaran balik tersebut. Bergantung kepada kaedah pembayaran, pembayaran balik termasuk tempoh masa bayaran balik juga tertakluk kepada terma yang dikenakan oleh bank.

    c) Untuk mengelakkan keraguan, selain yang telah dinyatakan di sini, tiada sebarang permohonan untuk pertukaran atau pemulangan atau pembatalan atau bayaran balik bagi Produk boleh dilaksanaan oleh Pelanggan selepas Tempoh Pulangan dan keputusan AGSSB berkaitan dengan ini adalah muktamad dan terikat.


    7. JAMINAN


    a) AGSSB akan mengambil langkah yang sewajarnya untuk memastikan semua Produk telah disemak dan diperiksa oleh Rakan Perniagaan bagi memastikan bahawa Produk adalah pada tahap, kualiti, komposisi, gaya atau model yang mereka mewakili dan seperti yang dibentangkan, dipaparkan dan disiarkan di PLATFORM. AGSSB tidak mengambil sebarang tanggungjawab bagi apa jua ketidaktepatan atau kesilapan sewaktu persembahan, paparan dan penyiaran maklumat itu. AGSSB terikat hanya didalam menjaga dan menyelia pada kadar yang munasabah semasa menghantar Produk mengikut keterangan umum yang dijual, tanpa mengira jika maklumat khusus atau tertentu telah diberikan atau termaktub dibawah undang-undang. Sebarang keterangan khusus atau tertentu hendaklah diambil kira sebagai ungkapan pendapat AGSSB sahaja didalam hal tersebut.
    b) Tertakluk kepada Seksyen 8 di bawah, AGSSB tidak membuat apa-apa jaminan, perwakilan atau pengendorsan yang nyata atau tersirat, termasuk tanpa terhad kepada sebarang jaminan dalam tajuk, bukan pelanggaran, kebolehdagangan, kegunaan, operasi, kesempurnaan, ketepatan, kepuasan kualiti, kebolehpercayaan atau kesesuaian untuk tujuan tertentu, berkenaan dengan mana-mana Produk yang dijual kepada Pelanggan (dan/atau mana-mana hadiah percuma atau barangan promosi diberikan berhubung dengan mana-mana Produk tersebut), bahan, maklumat dan/atau fungsi di dalamnya dan dengan jelasnya menafikan liabiliti untuk semua kesilapan dan ketinggalan dalam bahan-bahan, maklumat dan/atau fungsi.

    8. KEWAJIBAN DAN TANGGUNG RUGI


    a) Setakat yang dibenarkan sepenuhnya oleh undang-undang, Pelanggan bersetuju bahawa AGSSB tidak akan bertanggungjawab kepada Pelanggan / atau mana-mana pihak ketiga ke atas sebarang tuntutan terhadap AGSSB untuk kerugian turutan atau bersampingan dan kerosakan (termasuk tetapi tidak terhad kepada kehilangan pendapatan, kehilangan keuntungan, kehilangan nama baik, kehilangan reputasi, kerugian simpanan yang dijangka, perbelanjaan sia-sia, kehilangan privasi dan kehilangan data) atau sebarang kerosakan tidak langsung, khas atau punitif lain yang ditimbulkan daripada atau berkaitan dengan mana-mana Produk yang dijual (termasuk hadiah percuma atau barangan promosi yang diberikan berhubung dengan mana-mana Produk tersebut) melalui AGSSB.
    b) AGSSB adalah dengan selanjutnya tidak menanggung sebarang liabiliti berkaitan dengan: a) segala alahan atau masalah kesihatan yang lain atau keadaan perubatan yang dialami oleh Pelanggan; dan b) segala defek kepada mana-mana Produk, yang timbul akibat daripada penggunaan yang tidak sesuai atau tidak betul, pemasangan yang tidak sempurna atau pentauliahan oleh Pelanggan atau pihak ketiga, haus dan lusuh, kerosakan yang disengajakan, kecuaian, keadaan kerja yang tidak normal, pengendalian yang salah atau cuai, penyelenggaraan yang tidak betul, berlebihan beban, bahan kegunaan atau gantian yang tidak sesuai, kerja berkualiti rendah, asas yang tidak sesuai, kimia, elektro-teknikal/electronik atau pengaruh elektronik, kegagalan mematuhi arahan (sama ada secara lisan atau bertulis) penyalahgunaan atau pengubahsuaian atau pembaikan Produk, penambahan dan kemasukan bahagian, khususnya alat ganti yang tidak datang dari AGSSB tanpa kelulusan AGSSB. Sehubungan ini, Pelanggan akan menanggung rugi AGSSB daripada setiap liabiliti kerugian dan kos berbangkit daripada tuntutan tersebut.
    c) Pelanggan hendaklah menanggung rugi dan melindungi AGSSB, anak syarikat dan sekutu dari sebarang tuntutan atau permintaan, atau tindakan yang diambil oleh mana-mana pihak ketiga yang disebabkan oleh atau yang timbul akibat pelanggaran Terma dan Syarat.
    d) Setakat yang dibenarkan oleh undang-undang, jumlah liabiliti AGSSB kepada Pelanggan atau mana-mana pihak ketiga berhubung dengan apa-apa kuasa tindakan, hendaklah didalam apa jua keadaan tidak melebihi, dalam agregat, jumlah yang bersamaan dengan 100% daripada apa-apa amaun agregat yang dibayar oleh Pelanggan berkenaan untuk Produk tersebut.

    e) Tiada terdapat dalam Terma dan Syarat ini akan mengecualikan atau menghadkan liabiliti kami bagi (i) penipuan ini; (ii) sebarang pelanggaran jaminan pengguna yang berhubungan dengan pembekalan produk dan / atau perkhidmatan yang tidak boleh dikecualikan atau terhad menurut Akta Perlindungan Pengguna 1999; dan (iii) apa-apa liabiliti lain yang tidak boleh dikecualikan atau terhad di bawah mana-mana undang-undang.   


    9. TERMA umum


    a) AGSSB mempunyai hak, mengikut budi bicara mutlaknya dan tanpa notis, untuk menggantung atau menamatkan akses Pelanggan kepada PLATFORM  jika Pelanggan melanggar mana-mana Terma dan Syarat ini dan termasuk Terma & Syarat Penggunaan Go Shop serta Notis Privasi dengan memberi empat belas (14) hari notis bertulis kepada Pelanggan.Sebaik saja perjanjian ini ditamatkan, Pelanggan hendaklah dengan segeranya menghentikan semua akses dan penggunaan PLATFORM  dan AGSSB akan, selain dari segala remedi undang-undang atau ekuiti lain, membatalkan Akaun dengan segara dan menafikan akses untuk penggunaan PLATFORM kepada Pelanggan secara keseluruhan atau sebahagiannya. Sebarang penamatan perjanjian ini tidak akan menjejaskan hak-hak dan obligasi masing-masing (termasuk tanpa had, obligasi untuk membuat bayaran) dari pihak-pihak yang timbul sebelum tarikh penamatan perjanjian.
    b) AGSSB tidak akan bertanggungjawab ke atas apa-apa pelanggaran obligasinya di bawah Terma dan Syarat ini di mana ia terhalang atau dihalang daripada menjalankan tanggungjawabnya disebabkan oleh mana-mana situasi di luar kawalan atau sebab di luar kawalan yang munasabah, (atau oleh mana-mana kerosakan yang disebabkan oleh salah satu daripada peristiwa tersebut).
    c) Terma dan Syarat ini merupakan perjanjian diantara pihak-pihak berkenaan perkara yang disebut di sini.
    d) Terma dan Syarat ini akan ditadbir dalam setiap aspek oleh undang-undang Malaysia dan pihak-pihak terbabit adalah tertakluk kepada bidang kuasa mahkamah Malaysia.
    e) Jika mana-mana peruntukan Perjanjian ini dianggap tidak sah atau tidak boleh dikuatkuasakan, peruntukan tersebut hendaklah dibatalkan dan peruntukan-peruntukan lain akan dikuatkuasakan.
    f) Sebarang komunikasi atau notis kepada AGSSB harus secara bertulis ke alamat AGSSB seperti yang tertera pada invois AGSSB. Semua surat-menyurat dan notis oleh AGSSB kepada Pelanggan akan dihantar secara bertulis ke alamat surat-menyurat yang paling terkini yang diberikan oleh Pelanggan kepada AGSSB semasa pendaftaran atau melalui e-mel ke alamat e-mel yang diberikan oleh Pelanggan. Notis akan dianggap sebagai diterima semasa serahan tangan atau pada hari perniagaan kelima selepas pengeposan atau apabila menerima e-mel.

  • 1. GENERAL

    a) The use of the Home Shopping Platform is subject to this Terms and Conditions of Use (collectively "TOU"). By accessing, viewing, browsing and/or using the Home Shopping Platform you agree to be bound by this TOU (which term shall include guidelines and rules) which may be posted by AGSSB on the Site from time to time.

    b) AGSSB reserves the right, to change, modify, add, or remove portions of this TOU at any time without notice. All such changes, modifications and amendments are effective once they are posted on the Site or notified by AGSSB. The continued usage of the Home Shopping Platform following such changes to these TOU constitutes your acceptance of those changes. In the event you do not agree to the amended TOU, you shall not continue to access, view, browse and/or use the Home Shopping Platform.

    c) For avoidance of doubt, the terms and conditions governing any person who has registered with Go Shop as a customer will be governed by the Customer Terms and Conditions and Go Shop Privacy Notice (which can be found on the Site at www.goshop.com.my).

    d) All materials and information provided on the Home Shopping Platform including without limitation images, photographs, pictures, recordings, text, statements, graphics, data, logos, graphics, sound, programs, audio, video, links or other items and any other material and information (collectively “Content”) are provided on an "as is" and "as available" basis. References to such Content include the material and information provided by third parties. Subject to applicable law, AGSSB reserves the right to change, rearrange, add, d elete or otherwise modify any Content presented on the Home Shopping Platform at any time, with or without prior notice to you, including changing, rearranging or otherwise modifying without limitation the programs, advertisements, schedules that are presented or broadcasted on GO SHOP TV.

    e) Definitions:
    “Account” means a one-time registration account created for a Customer containing the information of the Customer including without limitation name, address, identification number (NRIC/Mykad), telephone number and/or such other information as may be requested by AGSSB for purposes of registration from time to time.

    “AGSSB” or “We” or “Us” or “Go Shop” means Astro GS Shop Sdn Bhd (Company Number 1081077-X) a company incorporated in Malaysia and having its registered address at All Asia Broadcast Centre, Technology Park Malaysia 57000 Bukit Jalil, Kuala Lumpur, Malaysia.

    “Astro” means MEASAT Broadcast Network Systems Sdn Bhd (Company Number 240064-A), a satellite and cable TV service operator which provides data, high definition format services, recording services, pay-per-view, premium/special events, near video on demand, interactive and other special services (including paid packages of television and radio channels).

    “Business Day (s)” means a day (s) on which commercial banks are open for business in Selangor (other than Saturdays, Sundays and public holidays);

    “Business Partners” means the business partners of AGSSB whose products and/or services are featured, advertised, promoted or offered for sale on the Home Shopping Platform including without limitation suppliers, vendors, sellers, merchants.

    "Customer/Customers” or “You/Your” means the person who places an Order and purchases a Product via GO SHOP TV or the Site from either AGSSB or a Business Partner.

    “GO SHOP TV” means the home shopping television channel operated by AGSSB which is currently available on Astro’s Channel 118 and Channel 318 (subject to such changes from time to time by AGSSB) that offers Products for sale via cable or satellite TV services to allow Customers to place an Order for any Product via phone or other means of communication.

    “Home Shopping Platform” means collective GO SHOP TV and the Site and/or such other home shopping platforms, on ground locations or stores where AGSSB shall sell or offer for sale the Products;

    "Site" means the GO SHOP’s website at www.goshop.com.my, m.goshop.com.my (mobile site/ mobile website) and/or any mobile applications/mobile interfaces applications/ apps and the services provided which provides a venue / platform to the users of the Site and/or a Customer to purchase the Products featured, showcased/displayed and/or offered for sale on the Site.

    “Services” which means the services provided by AGSSB in relation to any Products and/or services featured or offered for sale on its Home Shopping Platform including those offered for sale by any of the Business Partners.

    "Order" or “Orders” means any order submitted or placed by a Customer to AGSSB to purchase a Product from the Home Shopping Platform.

    "Product/Products" means any products/merchandise/services/offers/display items that are uploaded /showcased/displayed/broadcasted and/or offered for sale on the Site and/or GO SHOP TV.

    “You/Your” means the person who uses the Home Shopping Platform and includes any Customer/Customers and any person accessing, viewing, browsing and/or the Home Shopping Platform.

    2. ACCEPTANCE OF TERMS
    a) You must be an individual person above the age of 18 years who is capable of entering into a legally binding agreement under Malaysian law and contacting AGSSB for information on any of the Products. You agree to notify us immediately whenever your personal or billing information changes (including, for example, your name, address, credit card and telephone number).

    b) By using the Home Shopping Platform, you expressly accept and give your unconditional consent that we may use and/or disclose information about your demographics in any manner which does not reveal your identity for purposes of marketing, promotional, strategic development, research and customer care.

    c) You agree that GO SHOP TV is operated by AGSSB via Astro’s satellite and cable television channel and where the Customer is a subscriber of Astro, the Customer shall also comply with the terms and conditions imposed by Astro on its subscribers.

    3. YOUR RESPONSILIBITIES AND CONDUCT
    a) You are personally responsible for your use of the Home Shopping Platform and you shall use at your own risk. You shall use the Home Shopping Platform in accordance with these TOU and any law at the time being in force in Malaysia including, but not limited to, the Malaysian Communications and Multimedia Act 1998 and the Malaysian Communications and Multimedia Content Code. AGSSB reserves the right to remove any items that it deems in violation of the above, at its sole discretion.

    b) Where you agree and consent to provide any Information or personal data as specified in our Privacy Notice to AGSSB, you shall not provide and/or cause to be provided information which:
    o is false, inaccurate or misleading;
    o violates or breaches any law;
    o is defamatory;
    o contains pornographic or obscene wordings and materials.
    o contains any computer viruses and/or other computer programming routines that may damage, detrimentally interfere with, surreptitiously intercept or expropriate any system, data or personal information;
    o introduces, spreads or is intended to introduce and/or spread contents or propaganda of religious, cultural or racist nature; or
    o any other prohibited content as provided under applicable laws.
    "Information" referred to hereinabove includes but is not limited to any information (including personal data) provided by you to AGSSB via its toll-free number to AGSSB’s authorised personnel, information in any public message area (such as community forums, photo area and feedback area) or through electronic mail and social media.

    c) The Home Shopping Platform may not be available to all devices which connect to the Internet. You assume all responsibility regarding the end-user equipment and software necessary to access the Home Shopping Platform and assume all risk associated therewith.


    d) The Home Shopping Platform is provided to you for internal, non-commercial, personal use by you only. You may not allow any other person to: (a) resell, timeshare, sublicense, or otherwise transfer all or any portion of the Home Shopping Platform to any other party; or (b) make commercial use of the Home Shopping Platform without the express written consent of AGSSB.

    e) You agree to use the Home Shopping Platform only for lawful purposes and for internal, personal use only.
    f) You agree to abide by all applicable local, state, national and international laws and regulations and are solely responsible for all acts or omissions that occur under your usage, including the content of your communication through the AGSSB Service. Recognizing the global nature of the Internet, you agree to comply with all local rules regarding online conduct. Specifically, you agree to comply with all applicable laws regarding on-line communication in the country in which you reside.

    g) You will not use the Home Shopping Platform in any manner that could damage, disable, overburden, or impair the Home Shopping Platform (or the network(s) connected to AGSSB Service) or interfere with any other party's use and enjoyment of the AGSSB Service. You will not attempt to gain unauthorized access to the Home Shopping Platform and other Accounts, computer systems or networks connected to the Home Shopping Platform, through hacking, password mining or any other means. You will not obtain or attempt to obtain any materials or information through any means not intentionally made available through the Home Shopping Platform.

    h) You will not post or transmit through the Home Shopping Platform any defamatory, libelous, harassing, harmful, obscene, threatening, pornographic or otherwise illegal material or material which would violate or infringe in any way upon our rights or those of others (including intellectual property rights, rights of confidentiality, or rights of privacy) or cause distress or inconvenience. You must not express opinions that are crude, racist sexist, vulgar, or otherwise offensive. You will always treat other users with respect and will not interfere with other users’ use or enjoyment of the Home Shopping Platform.

    i) You will not post or otherwise make available on the Site any material, which you do not own without the express permission of the owner of the material.

    j) You will not broadcast, copy, download, frame, reproduce, republish, transmit in any manner whatsoever, any material on the Home Shopping Platform and any Content on GO SHOP TV except as is strictly necessary for your own personal non-commercial home use.

    k) You will not do anything that affects the operability or security of the Home Shopping Platform or causes unreasonable inconvenience or offence or disruption to AGSSB our employees, servants or authorized personnel.

    4. TERMINATION/ACCESS RESTRICTION
    a) You may terminate and close your Account by e-mailing AGSSB at the email address specified on the Site from the e-mail address provided by you the time you opened your Account and created your e-mail address. Your e-mail must specify your e-mail address, and expressly state that you wish to terminate your Account. Alternatively, you may call our toll-free number and obtain the assistance of our Personal Go Shopper to terminate and close your Account.

    b) Without limiting anything herein contained, AGSSB reserves the right at its sole discretion to terminate any one of the Home Shopping Platform and your access to the Site and your use of the Account at any time without notice and for any reason.

    c) In addition to any termination rights AGSSB may have under this TOU, AGSSB may suspend your Account and/or access to the Site without notice and in its sole discretion if:
    i) AGSSB, at its sole discretion ceases to offer any free, trial, or promotions for the Products, where such termination or suspension shall solely relate to such Products.
    ii) For inactivity, this is defined as failing to log into your Account for an extended period of time, as specified in Section 2 (b) above.
    iii) AGSSB suspects fraudulent use (Fraudulent use of an account may include but is not limited to: (a) permitting access to your e-mail address and password to third parties, or (b) entering invalid or apparently invalid user information for your Account, or (c) attempting to register for free, trial, or promotional offers under several aliases or with different user information to circumvent any one-trial-per-user limitation) of the Site and/or your Account.
    iv) You materially violate this TOU or any notice posted from time to time on the Home Shopping Platform, any applicable law, rule or regulation relating to the use of the Products.
    v) Any law, regulation, or governmental action renders all or any portion of the Home Shopping Platform (or your use of the Products) unlawful or impracticable.
    vi) Your use of Home Shopping Platform impairs or threatens to impair the integrity or functionality of the AGSSB’s network in any manner.
    vii) If AGSSB believes that you have violated or acted inconsistently with the letter or spirit of this TOU.

    d) You agree that AGSSB shall not be liable to you or any third-party for any termination and/or suspension of your use of any part of the Home Shopping Platform and/or access to the Home Shopping Platform access to the Site or your Account.

    e) Information on the Home Shopping Platform may contain technical inaccuracies or typographical errors and may be changed or u pdated without notice. AGSSB may also make improvements and/or changes to the Home Shopping Platform, at any time without notice. Your access to the Home Shopping Platform may occasionally be restricted to allow for repairs, maintenance or the introduction of new facilities or services to the Site.

    e) The Home Shopping Platform may not be available to be accessed from all regions and countries of the world. AGSSB reserves the right, in its sole discretion, to limit or terminate your ability to access the Home Shopping Platform from certain regions or countries, and you assume all risk associated with the accessibility of the Home Shopping Platform from any given region or country of the world.

    5. DISCLAIMER & LIMITATION OF LIABILITY
    a) AGSSB makes no warranty or guarantees of any kind that the Home Shopping Platform will meet your requirement or that the Home Shopping Platform will be secure, timely, uninterrupted or error free, or that any images, photographs, pictures, recordings, text, statement, graphics, data, logos, sound, programs, audio video, links, content, information and any other material and information found on the Home Shopping Platform, software or other material accessible on or through the Home Shopping Platform are true, accurate, or are free of viruses or other harmful components. In relation to the Site, you are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for accuracy of data input and output, and for maintaining a means external to the Site for the reconstruction of any lost data. All use of the Home Shopping Platform is at your own risk and you are solely responsible for all damages resulting therefrom.

    b) To the maximum extent permitted by applicable law, AGSSB disclaims all warranties, express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, title and non-infringement with respect to the Home Shopping Platform the broadcasting and transmission of GO SHOP TV and transactions performed through the Products and Services generally. AGSSB makes no representations or warranties as to the quality of the call or any connection to or any transmission on the Home Shopping Platform, the incompatibility of the Home Shopping Platform with any of your equipment, software or telecommunication links, technical problems including errors or interruptions of the Home Shopping Platform, unsuitability, unreliability or inaccuracy or the inadequacy of the Home Shopping Platform to meet your requirements. AGSSB also makes no representations or warranties as to the quality of the programs or any transmission over GO SHOP TV.

    c) To the fullest extent permitted by applicable law, under no circumstances, including, but not limited to, negligence, shall AGSSB be liable for any direct, indirect, incidental, special or consequential damages, damages for loss of profits (even if AGSSB has been advised of the possibility of such damages or even if such damage is foreseeable), loss of anticipated savings, wasted expenditure, loss of privacy, loss of data, that result from the use of or the inability to use the Home Shopping Platform, any changes to the Home Shopping Platform and unauthorized access to or alteration of your transmissions or data, any communication, transmission, material or data sent or received or not sent or received, or any transactions entered into through the Home Shopping Platform or arising in connection with the fraudulent or unlawful acts of any third party.

    d) You specifically agree that AGSSB is not responsible or liable for any threatening, defamatory, obscene, offensive or illegal content or conduct of any other party or any infringement of another's rights, including intellectual property rights.

    e) If you are dissatisfied with the Home Shopping Platform, the materials available on or through the Home Shopping Platform or with the provisions of this TOU, you agree that your sole and exclusive remedy is to discontinue using the Home Shopping Platform, the Account and/or the Products.

    f) AGSSB will take reasonable measures to maintain the privacy and security of all private information provided by you, but third parties (such as hackers) may breach or attempt to breach AGSSB's security measures or may gain unauthorized access to the AGSSB database or other equipment containing your information. You agree that AGSSB shall not be liable for damages of any sort, whether arising under contract, tort, or otherwise, with respect to any breach of security of the Home Shopping Platform or any other company equipment or user information.

    g) Information on the Home Shopping Platform may contain technical inaccuracies or typographical errors and may be changed or u pdated without notice. AGSSB may also make improvements and/or changes to the Home Shopping Platform, at any time without notice. Your access to the Home Shopping Platform may occasionally be restricted to allow for repairs, maintenance or the introduction of new facilities or services to the Site.

    h) The Home Shopping Platform may not be available to be accessed from all regions and countries of the world. AGSSB reserves the right, in its sole discretion, to limit or terminate your ability to access the Home Shopping Platform from certain regions or countries, and you assume all risk associated with the accessibility of the Home Shopping Platform from any given region or country of the world.

    i) AGSSB reserves the right to limit or prohibit your entry into the Home Shopping Platform in its sole discretion and shall not be liable for such limitation or prohibition.

    j) AGSSB shall not be held responsible for (1) any loss, damage or harm which you may or will suffer or incur as a result of the terms and conditions applying to any contract entered into by you with any AGSSB’s Business Partners whose products and/or services are featured on the Home Shopping Platform; or (2) for any acts, omissions, errors or defaults of any Business Partner in reference to those terms and conditions, in respect of any product or services purchased by you from the Business Partner via the Products offered by AGSSB on the Home Shopping Platform. You are advised to raise your complaints and concerns directly to the relevant Business Partner responsible for supplying the product or services.
    6. INDEMNITY
    You agree to indemnify, defend and hold AGSSB its subsidiaries and affiliates and any third party information providers to the Home Shopping Platform harmless from and against all losses, liability, expenses, damages and costs, including legal fees, resulting from any violation by you of this TOU or asserted by any third party due to or arising out of your use of or conduct on the Home Shopping Platform including the use of or conduct on the Site by a third party through your password.

    7. LINKS TO THIRD PARTY SITES
    a) The Site may contain links to third party websites, resource and advertisements (collectively "Linked Websites"). You agree that Linked Websites are necessary for AGSSB to provide the Products. Such Linked Websites are provided to you only as a convenience. AGSSB shall not be responsible if any of the Linked Websites is not working appropriately. AGSSB has no control over such Linked Websites and shall not be responsible for the contents, advertisements, products and/or services of any Linked Website, including without limitation any link contained in a Linked Website, including that relating to social networking sites such as Facebook and does not endorse any content, advertising, products, services, and/or other materials on or available from such Linked Websites. If you decide to access and use any of the Linked Websites, you do so entirely at your own risk.

    b) You agree that AGSSB shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any content, advertisement, product and/or services available on or through any such Linked Websites. The purchase of any product or service from a merchant, seller, vendor or supplier (collectively “Merchant”) from a Linked Website is a transaction solely between you and that Merchant, and any question or dispute you may have regarding any such product or service should be addressed directly to the responsible Merchant. AGSSB has no responsibility or liability for any Merchant or your relationship with such Merchant.

    8. DISCLOSURE AND CONFIDENTIALITY
    a) AGSSB reserves the right to disclose any personal information about you or your use of the AGSSB Service and without your prior permission if AGSSB in good faith, believes that such action is necessary to: (1) conform to legal requirements or comply with legal process; (2) protect and defend the rights or property of AGSSB or its holding or affiliated company; (3) enforce this TOU; or (4) act to protect the interests of its members or others.
    b) Any non-personal information or material sent to AGSSB by you will generally NOT be treated as confidential. For further details on use and disclosure of your personal information please see our Privacy Notice posted on the Site, which is incorporated into and forms part of this TOU.

    9. PROPRIETARY RIGHTS
    a) COPYRIGHT
    i) All Content found on the Home Shopping Platform are protected by trademark, copyright, or other intellectual property laws and international treaties. Any commercial use of and Content found on the Home Shopping Platform, including any reproduction, modification, copying, distribution or use of any of the materials and Content of the Home Shopping Platform, is strictly prohibited, without AGSSB's express and prior written consent. Any reproduction or redistribution of the Content found on the Home Shopping Platform is expressly prohibited by law, and may result in severe civil and criminal penalties.
    ii) Content found on the GO SHOP TV are provided on an "as is" and "as available" basis. References to such Content contained on GO SHOP TV include the material and information provided by third parties. Subject to applicable law, AGSSB reserves the right to change, rearrange, add, d elete or otherwise modify any Content presented on GO SHOP TV at any time, with or without prior notice to you, including changing, rearranging or otherwise modifying without limitation the programs, advertisements, schedules that are presented or broadcasted on GO SHOP TV.
    iii) Elements of the Home Shopping Platform, its design and layout are protected by trade dress and other laws and may not be copied or imitated in whole or in part.
    iv) No Content from the Home Shopping Platform may be copied or retransmitted unless expressly permitted in writing by AGSSB.

    b) GRANT OF LICENSE AND RESTRICTIONS
    i) You acknowledge and agree that any necessary intellectual property including the Content used in connection with the Home Shopping Platform contain proprietary and confidential information that is protected by applicable intellectual property and other laws. AGSSB reserves all rights not expressly granted herein, including without limitation ownership and proprietary rights.
    ii) You may not copy the Content to any other server or location for further reproduction or redistribution. You may not reverse engineer, decompile, disassemble or modify the Content, except insofar as such restriction is prohibited by law. Any reproduction or redistribution of the Content is expressly prohibited by law, and may result in severe civil and criminal penalties. Violators will be prosecuted to the maximum extent possible.
    iii) AGSSB is the owner or the licensee of all intellectual property rights in the Home Shopping Platform, and in the Content broadcasted, displayed and/or published on the Home Shopping Platform. The Content are protected by copyright laws and treaties around the world. All such rights are reserved. If you print off, copy or download any part of the Content on the Home Shopping Platform without AGSSB’s consent, we shall be entitled to demand from you to return or destroy any copies of the materials you have made.

    c) TRADEMARKS AND THIRD PARTY MATERIALS
    AGSSB reserves all rights in its corporate names, service marks, logos, trade names, trademarks, websites and domain names and any other intellectual property rights in relation to Go Shop or otherwise (collectively "Marks") and nothing in this TOU grants you the license to use such Marks. Additionally, other marks which appear on the Home Shopping Platform may be marks of third parties that are not affiliated with AGSSB and you shall ensure that the intellectual property rights to such third party marks are not infringed.

    d) Anything that you submit to the Home Shopping Platform and/or provide to us, including but not limited to, questions, reviews, comments, and suggestions (collectively, "Submissions") will become our sole and exclusive property and shall not be returned to you. In addition to the rights applicable to any Submission, when you post comments or reviews to the Site, you also grant us the right to use the name that you submit, in connection with such review, comment, or other content. You shall not use a false e-mail address, pretend to be someone other than yourself or otherwise mislead us or third parties as to the origin of any Submissions. We may, but shall not be obligated to, remove or edit any Submissions.



    10. MOBILE SERVICES
    a) The Content provided on the Site in particular mobile site/mobile website (“Mobile Services”) by AGSSB and/or its content providers which includes without limitation messages, files, data, images, photographs, software, ring tones, pictures, logos, video clips, video streaming, live feeds, information on demand content (e.g. information about health, lifestyle, etc) and games or otherwise (collectively referred to as the "Mobile Content") that you may download or stream to your mobile device, personal media player, mobile gaming device or personal computer which is equipped with the necessary functions or applications to support the Mobile Content to be downloaded or streamed. We advise you to check with your respective mobile phone operator or Internet service provider on whether your device can support or is compatible to download, view and stream the Content.
    b) AGSSB will not be responsible or liable for any problem, loss or damage of whatsoever nature suffered by you due to any delay and/or failure in receiving and sending a SMS/MMS as a result of any network, communication or system error, interruption and/or failure experienced by the participating mobile phone operators.

    11. COOKIES
    A “cookie” is an element of data that can be sent to your browser. Your browser may then store it on your system based on the preferences you have set on your browser. Cookies gather information about your operating system, including but not limited to browser type, and Internet Protocol (IP) address. AGSSB may use this information to analyze traffic on the Site, in order to better serve you when you return to the Site. It is not our intention to use such information to personally identify a user. You have the option to configure your Internet browser to notify you when you receive a cookie, giving you the chance to decide whether to accept it. Further you have the option to block all cookies. Please note, however, that if you refuse or otherwise block cookies you may not be able to use all of the functionality available on the Site.

    12. GENERAL
    a) This TOU are governed by the laws of Malaysia, without reference to conflict of laws principles. Any dispute between you and AGSSB regarding this TOU will be subject to the exclusive jurisdiction of the courts located in Malaysia and you expressly waive all defenses to jurisdiction.

    b) If there is any conflict or inconsistency between this TOU and the Customer Terms and Conditions, such conflict or inconsistency will be resolved in a manner most favorable to AGSSB. However, if such conflict or inconsistency cannot be so resolved, the Customer Terms and Conditions will prevail over this TOU.

    c) AGSSB's failure to insist upon or enforce strict performance of any provision of this TOU or AGSSB’s failure to take immediate action for any breaches of the terms of this TOU shall not be construed as a waiver of any provision or right unless acknowledged and agreed to by AGSSB in writing.

    d) AGSSB may assign its rights and duties under this TOU to any party at any time without notice to you and this TOU shall be binding upon and inure to the benefit of each party's respective permitted successors and assignees.

    e) This TOU contain the entire understanding between the parties hereto with respect to the Home Shopping Platform. Neither the course of conduct between the parties nor trade practice shall act to modify any provision of this TOU.

    f) AGSSB's performance of this TOU is subject to existing laws and legal process, and nothing contained in this TOU is in derogation of AGSSB's right and obligation to comply with governmental, court and law enforcement requests or requirements relating to your use of the Home Shopping Platform or information provided to or gathered by AGSSB with respect to such use.

    g) If any provision of this TOU is held invalid, the remainder of this TOU will continue in full force and effect, and if any provision(s) of the TOU is held by a court of competent jurisdiction to be contrary to law, then such provision(s) shall be construed, as nearly as possible, to reflect the intentions of the parties with the other provisions remaining in full force and effect. This TOU shall not be construed against any party as the principal draftsperson hereof. A printed version of this TOU and any notice given in electronic form shall be admissible in judicial or administrative proceedings.

    h) Notices to you shall not be modified, except by an express modification by AGSSB as described herein and may be made via either email or regular mail or by displaying notices or links to notices to you on the Site.

    i) You may not assert any claim against AGSSB in connection with the Home Shopping Platform unless you have given AGSSB written notice of the claim within fourteen (14) days after you knew or should have known of the facts giving rise to such claim. You agree that any cause of action arising out of or related to the Home Shopping Platform must commence within one (1) year after the cause of action arose; otherwise, such cause of action is permanently barred.

    j) Nothing in this TOU shall be construed to create a joint venture, partnership or agency relationship between you and AGSSB and neither party shall have the right or authority to incur any liability debt or cost or enter into any contracts or other arrangements in the name of or on behalf of the other.

  • 1. UMUM

    a) Penggunaan Platform Pembelian Dari Rumah adalah tertakluk kepada Terma dan Syarat Penggunaan ini (secara kolektif "TOU"). Dengan mengakses, melihat, melayari dan / atau menggunakan Platform Pembelian Dari Rumah, anda bersetuju untuk terikat dengan TOU (di mana terma termasuk garis panduan dan peraturan) yang dipaparkan oleh AGSSB di Laman ini dari masa ke semasa.

    b) AGSSB mempunyai hak untuk menukar, mengubahsuai, menambah atau mengeluarkan mana-mana bahagian dari TOU pada bila-bila masa tanpa notis. Semua perubahan, pengubahsuaian dan pindaan akan berkuatkuasa apabila ianya disiarkan di Laman atau dimaklumkan oleh AGSSB. Penggunaan berterusan Platform Pembelian Dari Rumah selepas perubahan tersebut kepada TOU akan dianggap sebagai penerimaan terhadap perubahan tersebut. Sekiranya anda tidak bersetuju dengan TOU yang dipinda, anda tidak boleh mengakses, melihat, melayari dan / atau menggunakan Platform Pembelian Dari Rumah.

    c) Untuk mengelakkan keraguan, terma dan syarat yang mengawal sesiapa yang telah berdaftar dengan Go Shop sebagai pelanggan akan tertakluk kepada Terma dan Syarat Pelanggan dan Notis Privasi Go Shop (yang boleh didapati di Laman web www.goshop.com.my).

    d) Semua bahan-bahan dan maklumat yang dipaparkan di Platform Pembelian Dari Rumah termasuk tanpa had imej, foto, gambar, rakaman, teks, kenyataan, grafik, data, logo, grafik, bunyi, program, audio, video, pautan atau barangan lain dan lain-lain bahan dan maklumat (secara kolektif "Kandungan") adalah disediakan "seperti seadanya" dan secara "sebagaimana tersedia". Rujukan kepada Kandungan itu termasuk bahan dan maklumat yang disediakan oleh pihak ketiga. Tertakluk kepada undang-undang, AGSSB mempunyai hak untuk menukar, menyusun semula, menambah, memadam atau mengubah suai sebarang Kandungan yang dibentangkan di Platform Pembelian Dari Rumah pada bila-bila masa, dengan atau tanpa notis terdahulu kepada anda, termasuk menukar, menyusun semula atau sebaliknya mengubah suai tetapi tidak terhad kepada program, iklan, jadual yang dibentangkan atau disiarkan pada GO SHOP TV.

    e) Definasi:
    "Akaun " bermakna akaun pendaftaran sekali dicipta untuk Pelanggan yang mengandungi maklumat Pelanggan termasuk tanpa had nama, alamat, nombor kad pengenalan (NRIC/Mykad), nombor telefon dan / atau apa-apa maklumat lain sebagaimana yang diminta dengan AGSSB untuk tujuan pendaftaran dari masa ke semasa.

    "AGSSB" atau "Kami" atau "Go Shop" bermakna Astro GS Shop Sdn Bhd (Nombor Syarikat 1081077-X) sebuah syarikat yang diperbadankan di Malaysia dan mempunyai alamat berdaftarnya di All Asia Broadcast Centre, Technology Park Malaysia 57000 Bukit Jalil, Kuala Lumpur, Malaysia .

    "Astro" bermakna MEASAT Broadcast Network Systems Sdn Bhd (Nombor Syarikat 240064-A), sebuah pengendali perkhidmatan TV kabel dan satelit yang menyediakan maklumat, perkhidmatan format definisi tinggi, perkhidmatan rakaman, bayar-tiap-tontonan, premium / acara-acara khas, dekat video atas permintaan, interaktif dan perkhidmatan khusus yang lain (termasuk pakej berbayar saluran televisyen dan radio).

    "Hari Perniagaan" bermakna hari di mana bank-bank komersil adalah dibuka untuk perniagaan di Selangor (selain daripada hari Sabtu, Ahad dan cuti umum);

    "Rakan Kongsi Perniagaan" bermakna rakan kongsi perniagaan AGSSB yang mana produk dan / atau perkhidmatan adalah dipaparkan, diiklankan, dipromosikan atau ditawarkan untuk dijual di Platform Pembelian Dari Rumah termasuk tanpa terhad pembekal, penjual, peniaga.

    "Pelanggan" atau "Anda" bermakna seorang individu yang membuat Pesanan dan membeli produk melalui GO SHOP TV atau Laman melalui AGSSB atau Rakan Kongsi Perniagaan.

    "GO SHOP TV" bermakna saluran televisyen pembelian yang dikendalikan oleh AGSSB yang kini boleh didapati di Astro Channel 118 dan Channel 303 (tertakluk kepada perubahan dari masa ke semasa oleh AGSSB) yang menawarkan Produk untuk dijual melalui perkhidmatan kabel atau TV satelit untuk membolehkan Pelanggan untuk membuat Pesanan bagi setiap Produk melalui telefon atau cara komunikasi yang lain.

    "Platform Pembelian Dari Rumah" bermakna termasuk GO SHOP TV dan Laman ini dan/atau lain platform pembelian dari rumah, lokasi atau kedai di mana Produk dijual atau ditawarkan untuk dijual oleh AGSSB;

    "Laman" bermakna laman web GO SHOP di www.goshop.com.my, m.goshop.com.my (laman web mudah alih) dan/atau lain-lain aplikasi mudah alih / aplikasi interface mudah alih / aplikasi dan perkhidmatan yang disediakan oleh AGSSB yang menyediakan tempat / platform kepada pengguna Laman dan / atau Pelanggan untuk pembelian Produk yang dipaparkan, dipamerkan / dipaparkan dan / atau ditawarkan untuk dijual di Laman ini.

    "Perkhidmatan" bermakna perkhidmatan yang disediakan oleh AGSSB berhubung dengan mana-mana Produk dan / atau perkhidmatan yang dipaparkan atau ditawarkan untuk dijual di Platform Pembelian Dari Rumah termasuk yang ditawarkan untuk dijual oleh mana-mana Rakan Kongsi Perniagaan.

    "Pesanan" bermakna sebarang pesanan yang diserahkan atau dibuat oleh Pelanggan kepada AGSSB untuk membeli Produk dari Platform Pembelian Dari Rumah.

    "Produk" bermakna sebarang produk/barangan/ perkhidmatan / tawaran / paparan yang dimuat naik / dipamerkan / dipaparkan / disiarkan dan / atau ditawarkan untuk dijual di Laman ini dan / atau GO SHOP TV.

    "Anda" bermakna seorang individu yang menggunakan Platform Pembelian Beli Dari Rumah dan termasuklah Pelanggan dan lain orang yang mengakses, melihat, menyemak imbas dan / atau Platform Pembelian Dari Rumah.

    2. PENERIMAAN TERMA
    a) Anda mesti merupakan seorang individu yang berusia lebih daripada 18 tahun yang mampu memasuki suatu perjanjian yang terikat secara sah di bawah undang-undang Malaysia dan menghubungi AGSSB mengenai maklumat atas mana-mana Produk. Anda bersetuju untuk menghubungi kami dengan segera apabila terdapat perubahan atas maklumat peribadi anda atau maklumat bil (termasuk, contohnya, nama, alamat, kad kredit dan nombor telefon).

    b) Dengan menggunakan Platform Pembelian Dari Rumah, anda dengan jelasnya, menerima dan memberikan persetujuan anda bahawa kami boleh menggunakan dan / atau mendedahkan maklumat mengenai demografi anda dengan cara yang tidak mendedahkan identiti anda bagi tujuan pemasaran, promosi, pembangunan strategik, penyelidikan dan khidmat pelanggan .

    c) Anda bersetuju bahawa GO SHOP TV adalah dikendalikan oleh AGSSB melalui saluran satelit dan televisyen kabel Astro dan di mana Pelanggan adalah seorang pelanggan Astro, Pelanggan hendaklah juga mematuhi terma dan syarat yang dikenakan oleh Astro kepada pelanggannya.

    3. TANGGUNGJAWAB DAN KELAKUAN ANDA
    a) Anda adalah bertanggungjawab secara peribadi atas penggunaan anda terhadap Platform Pembelian Dari Rumah dan anda hendaklah menggunakan atas risiko anda sendiri. Anda hendaklah menggunakan Platform Pembelian Dari Rumah mengikut TOU dan sebarang undang-undang yang berkuatkuasa pada masanya di Malaysia termasuk, tetapi tidak terhad kepada, Akta Multimedia 1998 Komunikasi dan dan Komunikasi dan Kod Kandungan Multimedia. AGSSB berhak untuk meminda sebarang perkara yang dipercayai melanggar Akta di atas, mengikut budi bicara mutlaknya.

    b) Di mana anda bersetuju dan membenarkan untuk memberikan sebarang maklumat atau data peribadi yang dinyatakan di dalam Notis Privasi kami kepada AGSSB, anda tidak boleh memberikan dan / atau menyebabkan supaya maklumat yang diberikan :
    o adalah palsu, tidak tepat atau mengelirukan;
    o melanggar mana-mana undang-undang;
    o memfitnah;
    o mengandungi perkataan-perkataan dan bahan-bahan pornografi atau lucah.
    o mengandungi apa-apa virus komputer dan / atau rutin pengaturcaraan komputer yang boleh merosakkan, menjejaskan kekgangguan, pemintasan secarea rahsia atau merampas mana-mana sistem, data atau maklumat peribadi;
    o memperkenalkan, menyebarkan atau bertujuan untuk memperkenalkan dan / atau menyebarkan kandungan atau propaganda bersifat agama, budaya atau bersifat perkauman; atau
    o lain-lain kandungan yang dilarang sebagaimana yang diperuntukkan di bawah undang-undang.
    "Maklumat" yang dirujukkan di sini termasuk tetapi tidak terhad kepada sebarang maklumat (termasuk data peribadi) yang diberikan oleh anda kepada AGSSB melalui talian tol bebas kepada kakitangan yang diberi kuasa oleh AGSSB, maklumat pada kawasan mesej awam (seperti forum komuniti, kawasan gambar dan kawasan maklum balas) atau melalui mel elektronik dan media sosial.

    c) Platform Pembelian Dari Rumah mungkin tidak tersedia kepada semua peranti yang bersambung ke Internet. Anda telah dianggap untuk menanggung semua tanggungjawab yang berhubung dengan peralatan pengguna akhir dan perisian yang diperlukan untuk mengakses Platform Pembelian Dari Rumah dan telah dianggap untuk menanggung semua risiko yang berkaitan dengannya.


    d) Platform Pembelian Dari Rumah adalah disediakan kepada anda bagi kegunaan dalaman bukan komersial, dan peribadi sahaja. Anda tidak boleh membenarkan sesiapa untuk: (a) menjual semula, perkongsian masa, mengeluarkan lesen kecil, atau memindahkan semua atau mana-mana bahagian Platform Pembelian Dari Rumah di sebaliknya kepada pihak lain; atau (b) menjadikan Platform Pembelian Dari Rumah sebagai kegunaan komersial tanpa kebenaran bertulis nyata daripada AGSSB.

    e) Anda bersetuju untuk menggunakan Platform Pembelian Dari Rumah untuk tujuan yang sah dan untuk kegunaan dalaman, peribadi sahaja.
    f) Anda bersetuju untuk mematuhi semua undang-undang dan peraturan yang berkaitan dengan tempatan, negeri, negara dan antarabangsa dan dengan sepenuhnya bertanggungjawab atas semua tindakan atau peninggalan yang berlaku semasa penggunaan anda, termasuk kandungan komunikasi anda melalui Perkhidmatan AGSSB. Menyedari sifat global internet, anda bersetuju untuk mematuhi semua peraturan tempatan mengenai penggunaan internet. Secara khususnya, anda bersetuju untuk mematuhi semua undang-undang komunikasi atas talian di negara yang anda diami.

    g) Anda tidak akan menggunakan Platform Pembelian Dari Rumah dalam apa-apa cara yang boleh merosakkan, melumpuhkan, membebankan atau menjejaskan Platform Pembelian Dari Rumah (atau rangkaian (s) yang disambungkan ke AGSSB Service) atau mengganggu penggunaan dan kenikmatan mana-mana pihak lain terhadap Perkhidmatan AGSSB. Anda tidak akan mencuba untuk mendapatkan akses yang tidak dibenarkan kepada Platform Pembelian Dari Rumah dan Akaun lain, sistem komputer atau rangkaian yang berhubung dengan Platform Pembelian Dari Rumah, melalui penggodaman, perlombongan kata laluan atau apa-apa cara yang lain. Anda tidak akan mendapatkan atau mencuba untuk mendapatkan sebarang bahan atau maklumat melalui cara tidak sengaja disediakan melalui Platform Pembelian Dari Rumah.

    h) Anda tidak akan menghantar atau menyiarkan melalui Platform Pembelian Beli Dari Rumah sebarang fitnah, memfitnah, mengganggu, berbahaya, lucah, mengancam, pornografi atau bahan yang haram atau bahan yang akan melanggar atau melanggar dalam apa jua keadaan kepada hak-hak kami atau orang lain (termasuk hak harta intelek, hak kerahsiaan, atau hak privasi) atau menyebabkan kesedihan atau kesusahan. Anda tidak boleh meluahkan pendapat yang mentah, perkauman seksis, kesat atau lain yang menjelikkan. Anda hendaklah sentiasa merawat pengguna lain dengan rasa yang berhormat dan tidak akan mengganggu penggunaan atau kenikmatan pengguna lain daripada Platform Pembelian Dari Rumah.

    i) Anda tidak akan mempaparkan atau menyediakan sebarang bahan di Laman ini, yang tidak dimiliki oleh anda tanpa kebenaran yang jelas daripada pemilik bahan.

    j) Anda tidak akan menyiarkan, menyalin, memuat turun, menghasil semula, menerbit semula, menghantar dalam apa-apa cara sekalipun, sebarang bahan di Platform Pembelian Dari Rumah dan sebarang kandungan di GO SHOP TV selain seperti yang diperlukan untuk kegunaan peribadi dan bukan komersial.

    k) Anda tidak akan membuat sebarang perkara yang akan menjejaskan kebolehkendalian atau keselamatan Platform Pembelian Dari Rumah atau menyebabkan kesusahan yang tidak munasabah atau kesalahan atau gangguan kepada kakitangan AGSSB, pekerja atau kakitangan yang diberi kuasa.

    4. PENAMATAN / SEKATAN AKSES
    a) Anda boleh menamatkan dan menutup Akaun anda dengan menghantar e-mel kepada AGSSB dialamat e-mel yang dinyatakan di Laman ini dari alamat e-mel yang diberikan oleh anda semasa pembukaan Akaun anda dan penciptaan alamat e-mel anda. E-mel anda mesti menentukan alamat e-mel anda, dan menyatakan dengan jelas bahawa anda ingin menamatkan Akaun anda. Sebagai alternatif, anda boleh menghubungi talian tol bebas kami dan mendapatkan bantuan dari Personal Go Shopper kami untuk menamatkan dan menutup akaun anda.

    b) Tanpa menghadkan apa-apa yang terkandung di sini, AGSSB berhak mengikut budi bicara mutlaknya untuk menamatkan salah satu Platform Pembelian Dari Rumah dan akses anda terhadap Laman ini dan penggunaan Akaun pada bila-bila masa tanpa notis dan atas sebarang alasan.

    c) Sebagai tambahan kepada sebarang hak penamatan yang AGSSB memegang di bawah TOU ini, AGSSB boleh menggantungkan Akaun dan / atau akses anda ke Laman ini tanpa notis dan mengikut budi bicara mutlaknya jika:
    i) AGSSB, mengikut budi bicaranya berhenti untuk menawarkan sebarang percuma, percubaan, atau promosi untuk Produk, di mana penamatan atau penggantungan itu hendaklah semata-mata berkaitan dengan Produk tersebut.
    ii) Bagi yang tidak aktif, ia bermakna bahawa kegagalan untuk log masuk ke Akaun anda untuk tempoh masa yang panjang, sebagaimana yang dinyatakan dalam Seksyen 2 (b) di atas.
    iii) AGSSB mengesyaki penggunaan palsu (Penggunaan akaun secara menipu adalah termasuk tetapi tidak terhad kepada: (a) membenarkan akses kepada pihak ketiga untuk alamat dan kata laluan e-mel anda, atau (b) memasukkan maklumat pengguna yang tidak sah atau nampaknya tidak sah untuk Akaun anda, atau (c) mencuba untuk mendaftar secara percuma, percubaan, atau tawaran promosi di bawah beberapa nama samaran atau maklumat pengguna yang berbeza untuk mengelakkan batasan
    satu percubaan bagi setiap pengguna (one-trial-per-user) untuk Laman dan / atau Akaun anda.
    iv) Anda dengan secara material melanggar TOU atau mana-mana notis yang dipaparkan dari masa ke semasa di Platform Pembelian Dari Rumah, mana-mana perundangan, kaedah atau peraturan yang berkaitan dengan penggunaan Produk.
    v) Sebarang perundangan, peraturan atau tindakan kerajaan yang menjadikan semua atau mana-mana bahagian Platform Pembelian Dari Rumah (atau penggunaan anda terhadap Produk) telah menyalahi undang-undang atau tidak praktikal.
    vi) Penggunaan anda terhadap Platform Pembelian Dari Rumah telah merosakkan atau mengancam untuk menjejaskan keutuhan atau fungsi rangkaian AGSSB dengan apa-apa cara.
    vii) Jika AGSSB mempercayai bahawa anda telah melanggar atau bertindak tidak selaras dengan surat atau semangat TOU.

    d) Anda bersetuju bahawa AGSSB tidak bertanggungjawab kepada anda atau mana-mana pihak ketiga di atas penamatan dan / atau penggantungan atas penggunaan mana-mana bahagian Platform Pembelian Dari Rumah dan / atau akses kepada Platform Pembelian Dari Rumah akses kepada Laman atau Akaun anda.

    e) Maklumat mengenai Platform Pembelian Dari Rumah mungkin mengandungi ketidaktepatan teknikal atau kesalahan typografi dan boleh diubah atau dikemaskinikan tanpa notis. AGSSB juga boleh membuat penambahbaikan dan / atau perubahan kepada Platform Pembelian Dari Rumah, pada bila-bila masa tanpa notis. Pengaksesan anda kepada Platform Pembelian Dari Rumah mungkin pada kadang kalanya dihadkan bagi membolehkan pembaikan, penyelenggaraan atau pengenalan kemudahan atau perkhidmatan baru ke Laman ini.

    e) Platform Pembelian Dari Rumah mungkin tidak tersedia untuk diakseskan dari semua wilayah dan negara di dunia. AGSSB berhak, mengikut budi bicara mutlaknya, untuk menghadkan atau menamatkan keupayaan anda untuk mengakses Platform Pembelian Dari Rumah dari wilayah atau negara tertentu, dan anda hendaklah menanggung semua risiko yang berkaitan dengan keupayaan untuk mengakses Platform Pembelian Dari Rumah dari mana-mana wilayah atau negara di dunia.

    5. PENAFIAN & HAD LIABILITI
    a) AGSSB tidak membuat sebarang jaminan atau jaminan dalam apa jua bentuk bahawa Platform Pembelian Dari Rumah akan memenuhi keperluan anda atau bahawa Platform Pembelian Dari Rumah adalah selamat, tepat pada masanya, terganggu atau bebas ralat atau bahawa mana-mana imej, foto, gambar, rakaman, teks, kenyataan, grafik, data, logo, bunyi, program, video audio, pautan, kandungan, maklumat dan lain-lain bahan dan maklumat lain yang didapati di Platform Pembelian Dari Rumah, perisian atau lain-lain bahan yang boleh diakses melalui Platform Pembelian Dari Rumah adalah benar, tepat atau bebas dari virus atau komponen berbahaya yang lain. Berhubung dengan Laman ini, anda bertanggungjawab untuk melaksanakan prosedur dan pusat pemeriksaan yang mencukupi untuk memenuhi keperluan tertentu anda untuk ketepatan input dan output data, dan mengekallkan cara yang luaran untuk Laman bagi pembinaan semula untuk sebarang kehilangan data.

    b) Setakat maksimum yang dibenarkan oleh undang-undang, AGSSB menafikan semua jaminan, tersurat atau tersirat, termasuk tetapi tidak terhad kepada jaminan yang tersirat kebolehdagangan, kesesuaian untuk tujuan tertentu, hak milik dan bukan pelanggaran berkenaan dengan Platform Pembelian Dari Rumah penyiaran dan penghantaran GO SHOP TV dan transaksi yang dilaksanakan melalui Produk dan Perkhidmatan secara amnya. AGSSB tidak membuat sebarang perwakilan atau jaminan tentang kualiti panggilan atau sebarang sambungan kepada atau sebarang penghantaran di Platform Pembelian Dari Rumah, ketidakserasian Platform Pembelian Dari Rumah dengan mana-mana pautan peralatan, perisian atau telekomunikasi anda, masalah teknikal termasuk kesilapan atau gangguan daripada Platform Pembelian Dari Rumah, tidak sesuai, tidak boleh dipercayai atau tidak tepat atau kekurangan yang diwujudkan di Platform Pembelian Dari Rumah untuk memenuhi keperluan anda. AGSSB juga tidak membuat sebarang perwakilan atau jaminan tentang kualiti program atau sebarang penghantaran melalui GO SHOP TV.

    c) Setakat yang dibenarkan oleh undang-undang, di bawah keadaan tiada pun, termasuk, tetapi tidak terhad kepada, kecuaian, AGSSB hendaklah bertanggungjawab ke atas sebarang kerosakan langsung, tidak langsung, sampingan, khas atau berbangkit, ganti rugi bagi kehilangan keuntungan (walaupun AGSSB telah dinasihatkan atas kemungkinan kerosakan tersebut atau jika kerosakan tersebut boleh diramal), kerugian simpanan yang dijangka, perbelanjaan sia-sia, kehilangan privasi, kehilangan data, hasil yang daripada penggunaan atau ketidakupayaan untuk menggunakan Platform Pembelian Dari Rumah, sebarang perubahan kepada Platform Pembelian Dari Rumah dan akses tanpa kebenaran atau perubahan dalam penghantaran atau data anda, sebarang komunikasi, penghantaran, bahan atau data yang dihantar atau diterima atau yang tidak dihantar atau diterima,atau mana-mana transaksi yang dibuat melalui Platform Pembelian Dari Rumah atau yang ditimbulkan berhubung dengan penipuan atau menyalahi undang-undang oleh mana-mana pihak ketiga.

    d) Anda dengan secara khususnya bersetuju bahawa AGSSB tidak akan bertanggungjawab ke atas sebarang kandungan yang mengancam, memfitnah, lucah, ganas atau menyalahi undang-undang atau tindakan pihak lain atau sebarang pelanggaran hak orang lain, termasuk hak harta intelek.

    e) Jika anda tidak berpuas hati dengan Platform Pembelian Dari Rumah, bahan yang disediakan di atas melalui Platform Pembelian Beri Dari Rumah atau peruntukan TOU ini, anda bersetuju bahawa remedi tunggal dan eksklusif anda adalah untuk berhenti menggunakan Platform Pembelian Dari Rumah, Akaun dan / atau Produk.

    f) AGSSB akan mengambil langkah-langkah yang munasabah untuk mengekalkan privasi dan keselamatan semua maklumat peribadi yang diberikan oleh anda, tetapi pihak ketiga (seperti penggodam) boleh melanggar atau cuba melanggar langkah keselamatan AGSSB atau mungkin mendapat akses yang tidak dibenarkan kepada pangkalan data AGSSB atau peralatan lain yang mengandungi maklumat anda. Anda bersetuju bahawa AGSSB tidak akan bertanggungjawab ke atas kerosakan apapun, sama ada yang timbul di bawah kontrak, tort, atau sebaliknya, berkenaan dengan apa-apa pelanggaran keselamatan Platform Pembelian Dari Rumah atau mana-mana peralatan syarikat atau maklumat pengguna yang lain.

    g) Maklumat mengenai Platform Pembelian Dari Rumah mungkin mengandungi ketidaktepatan teknikal atau kesalahan typografi dan boleh diubah atau dikemaskinikan tanpa notis. AGSSB juga boleh membuat penambahbaikan dan / atau perubahan kepada Platform Pembelian Dari Rumah, pada bila-bila masa tanpa notis.Pengaksesan anda kepada Platform Pembelian Dari Rumah mungkin pada kadang kala dihadkan bagi membolehkan pembaikan, penyelenggaraan atau pengenalan kemudahan atau perkhidmatan baru ke Laman ini.

    h) Platform Pembelian Dari Rumah mungkin tidak tersedia untuk diakses dari semua wilayah dan negara di dunia. AGSSB berhak, mengikut budi bicara mutlaknya, untuk mengehadkan atau menamatkan keupayaan anda untuk mengakses Platform Pembelian Dari Rumah dari wilayah atau negara tertentu, dan anda akan menanggung semua risiko yang berkaitan dengan keupayaan untuk mengakses Platform Pembelian Dari Rumah dari mana-mana wilayah atau negara di dunia.

    i) AGSSB berhak untuk menghadkan atau melarang kemasukan anda ke dalam Platform Pembelian Dari Rumah mengikut budi bicara mutlaknya dan tidak akan bertanggungjawab ke atas had atau larangan tersebut.

    j) AGSSB tidak akan bertanggungjawab ke atas (1) sebarang kerugian, kerosakan atau kecederaan yang anda mungkin atau akan alami atau tanggung akibat daripada terma dan syarat di mana kontrak yang dimasukkan oleh anda dengan Rakan Kongsi Perniagaan AGSSB yang mana produk dan / atau perkhidmatan yang dipaparkan di Platform Pembelian Dari Rumah; atau (2) bagi sebarang perbuatan, peninggalan, kesilapan atau keingkaran oleh mana-mana Rakan Kongsi Perniagaan yang dirujuk pada terma dan syarat, berkenaan dengan mana-mana produk atau perkhidmatan yang dibeli oleh anda daripada Rakan Kongsi Perniagaan melalui Produk yang ditawarkan oleh AGSSB di Platform Pembelian Dari Rumah. Anda adalah dinasihatkan untuk membuat aduan dan kebimbangan anda dengan secara terus kepada Rakan Kongsi Perniagaan yang berkenaan yang bertanggungjawab untuk pembekalan produk atau perkhidmatan.
    6. PAMPASAN
    Anda bersetuju untuk menanggung rugi, mempertahankan dan memegang AGSSB, sekutu dan anak syarikatnya dan lain-lain penyedia perkhidmatan pihak ketiga kepada Platform Pembelian Dari Rumah tidak berbahaya daripada dan terhadap semua kerugian, liabiliti, perbelanjaan, ganti rugi dan kos, termasuk yuran guaman, akibat daripada sebarang pelanggaran oleh anda dalam TOU atau ditegaskan oleh mana-mana pihak ketiga yang disebabkan oleh atau yang ditimbulkan daripada penggunaan Platform Pembelian Dari Rumah termasuk penggunaan atau pengendalian di Laman ini oleh pihak ketiga melalui kata laluan anda.

    7. PAUTAN KE LAMAN PIHAK KETIGA
    a) Laman ini mungkin mengandungi pautan ke laman web pihak ketiga, sumber dan iklan ("Laman Web Yang Dipautkan" secara kolektif). Anda bersetuju bahawa laman web yang dipautkan adalah diperlukan bagi AGSSB untuk menyediakan Produk. Laman Web Yang Dipautkan adalah disediakan kepada anda hanya sebagai kemudahan. AGSSB tidak akan bertanggungjawab jika mana-mana Laman Web Yang Dipautkan tidak berfungsi dengan sewajarnya. AGSSB tidak mempunyai kawalan ke atas sebarang Laman Web Yang Dipautkan dan tidak akan bertanggungjawab ke atas kandungan, iklan, produk dan / atau perkhidmatan oleh mana-mana Laman Web Yang Dipautkan, termasuk tanpa had kepada sebarang pautan yang terkandung di dalam Laman Web Yang Dipautkan, termasuk yang berkaitan dengan laman rangkaian sosial seperti Facebook dan tidak menyokong sebarang kandungan, iklan, produk, perkhidmatan dan / atau bahan-bahan lain yang disediakan di Laman Web Yang Dipautkan.
    Jika anda membuat keputusan untuk mengakses dan menggunakan mana-mana Laman Web Yang Dipautkan, anda berbuat demikian sepenuhnya di atas risiko anda sendiri.

    b) Anda bersetuju bahawa AGSSB tidak akan bertanggungjawab atau menanggung secara langsung atau tidak langsung, terhadap sebarang kerosakan atau kerugian yang disebabkan atau yang didakwa yang telah disebabkan oleh atau berkaitan dengan penggunaan atau pergantungan ke atas kandungan, iklan, produk dan / atau perkhidmatan yang disediakan di atas melalui Laman Web Yang Dipautkan.     8. PENDEDAHAN DAN KERAHSIAAN
    a) AGSSB berhak untuk mendedahkan sebarang maklumat peribadi mengenai anda atau penggunaan Perkhidmatan AGSSB tanpa kebenaran terdahulu anda dan jika AGSSB dengan suci hatinya mempercayai bahawa tindakan itu adalah perlu untuk: (1) mematuhi undang-undang atau mematuhi proses undang-undang; (2) melindungi dan mempertahankan hak-hak atau harta AGSSB atau syarikat induk atau syarikat sekutu; (3) menguatkuasakan TOU ini; atau (4) bertindak untuk melindungi kepentingan ahli atau orang lain.
    b) Lain-lain maklumat bukan peribadi atau bahan yang dihantar kepada AGSSB oleh anda secara amnya TIDAK akan dianggap sulit. Untuk maklumat lanjut mengenai penggunaan dan pendedahan maklumat peribadi anda sila rujuk Notis Privasi kami yang dipaparkan di Laman ini, yang dimasukkan ke dalam dan menjadi sebahagian daripada TOU ini.

    9. HAK PROPRIETARI
    a) HAK CIPTA
    i) Semua kandungan yang terdapat di Platform Pembelian Dari Rumah adalah dilindungi oleh cap dagang, hak cipta, atau lain-lain undang-undang harta intelek dan perjanjian antarabangsa. Sebarang penggunaan komersil dan Kandungan yang didapati di Platform Pembelian Dari Rumah, termasuk sebarang pengeluaran semula, pengubahsuaian, penyalinan, pengedaran atau penggunaan mana-mana bahan dan kandungan daripada Pembelian Dari Rumah, adalah dilarang, tanpa kebenaran bertulis yang terlebih dahulu oleh AGSSB. Sebarang penghasilan semula atau pengagihan semula Kandungan yang terdapat di Pembelian Beli Dari Rumah adalah dilarang oleh undang-undang, dan boleh membawa kepada penalti sivil dan jenayah yang berat.
    ii) Kandungan yang terdapat pada GO SHOP TV adalah disediakan "seperti seadanya" dan secara "sebagaimana tersedia". Rujukan kepada kandungan yang terkandung di GO SHOP TV termasuk bahan dan maklumat yang disediakan oleh pihak ketiga. Tertakluk kepada undang-undang, AGSSB berhak untuk mengubah, menyusun semula, menambah, memadam atau mengubah sebarang kandungan yang disampaikan di GO SHOP TV pada bila-bila masa, dengan atau tanpa notis terdahulu kepada anda, termasuk menukar, menyusun semula atau sebaliknya mengubah suai tetapi tidak terhad kepada program, iklan, jadual yang dibentangkan atau disiarkan di GO SHOP TV.
    iii) Unsur-unsur Pembelian Beli Dari Rumah, reka bentuk dan susun aturnya adalah dilindungi oleh pakaian perdagangan dan undang-undang lain dan tidak boleh disalin atau ditiru secara keseluruhan atau sebahagian.
    iv) Tiada Kandungan dari Pembelian Dari Rumah boleh disalin atau dihantar semula melainkan dibenarkan dengan jelas secara bertulis oleh AGSSB.

    b) PEMBERIAN LESEN DAN SEKATAN
    i) Anda mengakui dan bersetuju bahawa sebarang harta intelek termasuk Kandungan yang digunakan berkaitan dengan Pembelian Dari Rumah mengandungi maklumat proprietari dan sulit yang dilindungi oleh harta intelek dan undang-undang lain. AGSSB mempunyai semua hak yang tidak diberi secara nyata ini, termasuk tanpa had, hak pemilikan.
    ii) Anda tidak boleh menyalin Kandungan ke mana-mana server atau lokasi lain untuk dihasilkan semula atau diedarkan semula. Anda tidak boleh melakukan pengubahan kejuruteraan, menyusun semula, menyahpasang atau mengubah suai Kandungan, kecuali setakat mana sekatan sedemikian adalah dilarang oleh undang-undang. Sebarang penghasilan semula atau pengagihan semula Kandungan adalah dilarang oleh undang-undang, dan boleh membawa kepada penalti sivil dan jenayah yang berat. Pesalah akan didakwa sehingga ke tahap maksimum.
    iii) AGSSB adalah pemilik atau pemegang lesen untuk hak harta intelek dalam platform Pembelian Dari Rumah, dan dalam Kandungan yang disiarkan, dipamerkan dan / atau diterbitkan di platform Pembelian Dari Rumah. Kandungan adalah dilindungi oleh undang-undang hak cipta dan perjanjian di seluruh dunia. Semua hak-hak tersebut adalah terpelihara. Jika anda mencetak, menyalin atau memuat turun mana-mana bahagian kandungan di platform Pembelian Dari Rumah tanpa kebenaran AGSSB, kami berhak untuk menuntut daripada anda untuk memgembalikan atau memusnahkan sebarang salinan bahan-bahan yang telah dibuat.

    c) TANDA DAGANGAN DAN BAHAN PIHAK KETIGA
    AGSSB mempunyai semua hak dalam nama korporat, tanda perkhidmatan, logo, nama perniagaan, tanda niaga, laman web dan nama domain dan lain-lain hak harta intelek yang berkaitan dengan Go Shop atau sebaliknya (secara kolektif "Tanda") dan tiada kenyataan di dalam TOU ini yang membenarkan anda menggunakan Tanda sedemikian. Selain itu, tanda lain yang muncul di platform Pembelian Dari Rumah mungkin merupakan cap pihak ketiga yang tidak bergabung dengan AGSSB dan anda hendaklah memastikan bahawa hak-hak harta intelek untuk cap pihak ketiga tersebut tidak dilanggar.

    d) Sebarang maklumat yang diserahkan kepada platform Pembelian Dari Rumah dan / atau diberikan kepada kami, termasuk tetapi tidak terhad kepada, soalan, ulasan, komen dan cadangan (secara kolektif, "Penyerahan") akan menjadi hak milik tunggal dan eksklusif kami dan tidak akan dikembalikan kepada anda. Sebagai tambahan kepada hak-hak berkenaan dengan mana-mana Penyerahan, apabila anda memberi komen atau ulasan kepada Laman ini, anda juga memberikan hak kepada kami untuk menggunakan nama yang diserahkan oleh anda, berhubung dengan ulasan, komen, atau kandungan lain. Anda tidak boleh menggunakan alamat e-mel palsu, menyamar sebagai orang lain selain diri sendiri atau sebaliknya mengelirukan kami atau pihak ketiga tentang punca Penyerahan. Kami boleh, tetapi tidak diwajibkan, menghapuskan atau mengubah sebarang Penyerahan.

    10. PERKHIDMATAN MOBILE
    a) Kandungan yang disediakan di Laman ini khususnya laman web mudah alih ("Mobile Services") oleh AGSSB dan / atau pembekal kandungannya termasuk tanpa had mesej, fail, data, imej, gambar, perisian, nada dering, gambar, logo, klip video, streaming video, live feed, maklumat mengenai kandungan permintaan (contohnya maklumat tentang kesihatan, gaya hidup, dan lain-lain) dan permainan atau sebaliknya (secara kolektif dirujuk sebagai "Kandungan Mudah Alih") yang anda boleh memuat turun atau menyalurkan ke peranti mudah alih anda, pemain media peribadi, peranti permainan mudah alih atau komputer peribadi yang dilengkapi dengan fungsi atau aplikasi yang diperlukan untuk menyokong Kandungan Mudah Alih untuk dimuat turun atau disalurkan. Kami menasihatkan supaya anda memeriksa dengan operator telefon bimbit anda masing-masing atau pembekal perkhidmatan Internet sama ada peranti anda boleh menyokong atau serasi untuk memuat turun, melihat dan melayari Kandungan tersebut.
    b) AGSSB tidak akan bertanggungjawab atau dipertanggungjawabkan terhadap sebarang masalah, kehilangan atau kerosakan dalam apa jua jenis yang dialami oleh anda yang disebabkan oleh sebarang kelewatan dan / atau kegagalan dalam menerima dan menghantar SMS / MMS akibat daripada mana-mana rangkaian, komunikasi atau sistem, gangguan dan / atau kegagalan yang dialami oleh operator telefon bimbit yang mengambil bahagian.

    11. COOKIE
    "Cookie" adalah satu elemen data yang boleh dihantar ke penyemak imbas anda. Penyemak imbas anda kemudian boleh menyimpannya di dalam sistem anda berdasarkan pilihan yang telah ditetapkan pada penyemak imbas anda. Cookie mengumpulkan maklumat untuk sistem operasi anda, termasuk tetapi tidak terhad kepada jenis penyemak imbas, dan alamat Protokol Internet (IP).     b) Jika terdapat sebarang percanggahan atau ketidakselarasan antara TOU ini dan Terma dan Syarat Pelanggan ini, percanggahan atau ketidakselarasan itu akan diselesaikan dengan cara yang paling baik bagi AGSSB. Walau bagaimanapun, jika percanggahan atau ketidakselarasan itu tidak boleh diselesaikan, Terma dan Syarat Pelanggan akan digunapakai.

    c) Kegagalan AGSSB untuk menegaskan atau menguatkuasakan pelaksanaan ketat mana-mana peruntukan TOU atau kegagalan AGSSB untuk mengambil tindakan dengan segera bagi mana-mana pelanggaran syarat-syarat TOU ini tidak boleh ditafsirkan sebagai pengecualian mana-mana peruntukan atau hak melainkan diakui dan dipersetujui oleh AGSSB dalam penulisan.

    d) AGSSB boleh menyerahkan hak dan kewajipannya di bawah TOU ini kepada mana-mana pihak pada bila-bila masa tanpa notis kepada anda dan TOU hendaklah mengikat dan menujukkan manfaatnya bagi setiap pihak dan pemegang serah hak.

    e) TOU mengandungi keseluruhan persefahaman di antara pihak berkenaan mengenai Platform Pembelian Dari Rumah. Tiada perlakuan di antara pihak atau amalan perdagangan hendaklah bertindak untuk mengubah suai mana-mana peruntukan TOU.

    f) Prestasi AGSSB pada TOU ini adalah tertakluk kepada undang-undang sedia ada dan proses undang-undang, dan sebarang yang terkandung di dalam TOU ini tidak akan menjejaskan hak dan kewajiban AGSSB untuk mematuhi kerajaan, mahkamah dan penguatkuasaan undang-undang yang diperlukan yang berkaitan dengan penggunaan anda di Platform Pembelian Dari Rumah atau maklumat yang disediakan atau dikumpulkan oleh AGSSB berkenaan dengan penggunaan tersebut.

    g) Jika mana-mana peruntukan di dalam TOU ini adalah tidak sah, baki TOU ini akan terus berkuat kuasa dan berkesan dengan sepenuhnya, dan jika mana-mana peruntukan TOU telah dipegang oleh mahkamah yang mempunyai bidang kuasa berwibawa sebagai bertentangan dengan undang-undang, maka peruntukan tersebut hendaklah ditafsirkan, sejauh yang mungkin, untuk mencerminkan niat pihak masing-masing dengan peruntukan-peruntukan lain yang kekal berkuat kuasa dan berkesan sepenuhnya. TOU ini tidak boleh ditafsirkan terhadap mana-mana pihak sebagai penderaf utamanya. Satu versi bercetak TOU dan sebarang notis yang diberikan dalam bentuk elektronik boleh diterima dalam prosiding kehakiman atau pentadbiran.

    h) Notis kepada anda tidak boleh diubah suai melainkan melalui pengubahsuaian nyata oleh AGSSB seperti yang dinyatakan di dalam ini dan boleh dibuat melalui e-mel atau mel biasa atau dengan memaparkan notis atau pautan kepada notis kepada anda di Laman ini.

    i) Anda tidak boleh membuat sebarang tuntutan terhadap AGSSB berkaitan dengan Platform Pembelian Dari Rumah melainkan anda telah memberikan notis bertulis kepada AGSSB atas tuntutan itu dalam tempoh masa empat belas (14) hari selepas anda mengetahui atau sepatutnya mengetahui mengenai fakta-fakta yang membawa kepada tuntutan itu. Anda bersetuju bahawa sebarang sebab tindakan yang timbul daripada atau yang berkaitan dengan Platform Pembelian Dari Rumah mesti dibuat dalam masa satu (1) tahun selepas timbulnya sebab tindakan; sebaliknya, sebab tindakan tersebut akan dihalang secara kekal.

    j) Tiada kenyataan di dalam TOU ini yang boleh ditafsirkan sebagai mewujudkan hubungan usaha sama, perkongsian atau agensi di antara anda dan AGSSB dan kedua-dua pihak tidak mempunyai hak atau kuasa untuk menanggung sebarang liabiliti atau kos atau membuat lain-lain kontrak atau sususan lain atas nama atau bagi pihak yang lain.

    (A) CONSENT
    (i) Your personal data and other information that identifies you as an individual (such as name, postal address, e-mail address and telephone number) including sensitive personal data as defined in the Act (collectively, “Personal Data”) which you provide or have provided to us, including any additional information which you may subsequently provide, for the access, use or purchase of products and/or services advertised, featured, listed or sold by AGSSB whether or not on our home shopping platforms [collectively referred to as “Home Shopping Platform” that includes without limitation, AGSSB’s home shopping TV channel(s) on Astro, online on Go Shop’s website at www.goshop.com.my, m.goshop.com.my (mobile site/ mobile website) and/or any mobile applications/mobile interfaces applications/apps on social media (the Go Shop website(s), mobile site/mobile website and said mobile applications/mobile interfaces applications/apps may be collectively and/or individually referred to as the “Site”), ] may be processed and used by AGSSB.
    (ii) In order to process and use your Personal Data, your consent is required. If you do not consent to the processing of your Personal Data, we may not be able to process your Personal Data for any of the Purposes defined herein and/or we will not be able to process your access, use or purchase of products and/or services advertised, featured, listed or sold by AGSSB whether or not on the Home Shopping Platform and/or approve your application to be a registered customer of AGSSB. However, where you have provided your Personal Data to us, you shall be deemed to have consented to provide your Personal Data to us.
    (iii) Where a copy of this Privacy Notice is dispatched or notified to you, if we do not hear from you within fourteen (14) days from the date of dispatch or notification of this Privacy Notice to you, we shall presume that you have approved and consented for us to collect, handle and process your Personal Data in accordance with and in the manner as set out in this Privacy Notice, including for us to contact you for purposes of marketing our products and services.     c) to process, assess and/or register (where any registration is required) your use of the Home Shopping Platform;
    d) monitoring, processing and/or tracking your use of the Site in order to provide you with a seamless experience, facilitating or administering your use of the Site, and/or to assist us in improving your experience in using the Site;
    e) carrying out your instructions or responding to any enquiry given by (or purported to be given by) you or on your behalf;
    f) to communicate with you, including to respond to your inquiries and/or requests for the purposes of administering and/or managing your use of the Home Shopping Platform, your account with us or any transactions made by you with us.     i) to process your application, orders and payment transactions, administering, facilitating, processing and/or dealing in any transactions or activities carried out by you on or through the Home Shopping Platform including implementing transactions and the supply of products and/or services to you that you have requested or purchased from Go Shop and/or our Business Partners;
    j) to carry out internal investigations, compliance, audit or security purposes including, without limitation, crime detection, prevention and prosecution;
    k) to conduct market surveys and trend analysis and/or development activities (including but not limited to data analytics, surveys and / or profiling) to improve our services and facilities in order to enhance any continued interaction between yourself and us in relation to the Home Shopping Platform, or to improve any of our products or services;
    l) to provide you with information on products and services of AGSSB, and/or Astro Malaysia Group and/or our Business Partners;
    m) to perform other legitimate business activities of AGSSB;
    n) to plan and implement any corporate transactions or proposals including without limitation, the purchase, sale, lease, merger or amalgamation or any other acquisition, disposal or financing of an organisation or a portion of an organisation or of any of the business or assets of an organisation;
    o) to implement and maintain our information technology systems, including to store and process Personal Data in computer databases and servers located within and outside Malaysia;
    p) to support and/or assist with the operation, administration, development or enhancement of AGSSB’s business, including that which may be contained in any terms and conditions applicable to the Home Shopping Platform;
    q) record-keeping purposes and producing statistics and research for internal and/or statutory reporting and/or record-keeping requirements, of AGSSB or of its affiliates/related corporations;
    r) where AGSSB considers that such use or disclosure of Personal Data is necessary to protect its interests, including to respond to any claims or legal process;
    s) for purposes of compliance with any applicable laws, regulations, court order or order of any regulatory body to which we are subject to comply;
    t) for such other purposes which support and/or assist with the operation, administration, development or enhancement of AGSSB’s business, including that which may be contained in any terms and conditions applicable the Home Shopping Platform;
    u) for AGSSB, Astro Group Companies’ or related corporation’s reporting purposes including but not limited to reporting on AGSSB’s business performance; and
    v) if relevant, for other purposes which are incidental and/or associated with any of the above.

    (C) DISCLOSURE AND TRANSFER
    (i) Disclosure of Personal Data - We may disclose your Personal Data to any one or more of the following classes of third parties:
    a) our related corporations (including the Astro Malaysia Group) and Business Partners;
    b) our licensees, consultants, advisors, contractors and service providers;
    c) persons authorized by you;
    d) any actual or proposed assignee or transferee of the business of AGSSB; and
    e) any other person to whom such disclosure is required by law or regulatory requirement or pursuant to a court order,
    notwithstanding that any such persons may be within or outside Malaysia, for (1) any of the above Purposes; or (2) any other purpose for which your Personal Data was to be disclosed at the time of its collection, or a purpose directly related to any such purpose.
    (ii) Provision of third party Personal Data - Should you provide AGSSB with Personal Data of individual(s) other than yourself, you represent and warrant to AGSSB and you hereby confirm that:
    a) prior to disclosing such Personal Data to us, you would have and had obtained consent from the individuals whose Personal Data are being disclosed to us, to:
    (1) permit you to disclose the individuals’ Personal Data to AGSSB for the Purposes; and
    (2) permit AGSSB to collect, use, disclose and/or process the individuals’ Personal Data for the Purposes, as set out in paragraphs (A) above;
    b) any Personal Data of individuals that you disclose to us is accurate; and
    c) you are validly acting on behalf of such individuals and that you have the authority of such individuals to provide their Personal Data to AGSSB and for AGSSB to collect, use, disclose and process such Personal Data for the Purposes.
    d) Without limiting the generality of the foregoing, should you make a purchase to be delivered to a third party recipient, you consent to us disclosing Personal Data that identifies you, to the said third party recipient (such as but not limited to your name). Further, you acknowledge and agree that delivery of your purchase could involve disclosure of certain Personal Data about you to bring about delivery of the same such as your name and contact details, which may be disclosed on the cover of the parcel, on an envelope or a delivery related document, as the case may be, which could be seen by third parties who view such parcel, envelope or said document.
    (iii) Transfer of Personal Data - Your Personal Data may also be transferred to locations outside Malaysia and stored in any server located in Malaysia or outside Malaysia, for any of the Purposes as stated in this Privacy Notice.

    (D) SECURITY
    We respect your privacy and take seriously the trust you place in us, and we follow strict guidelines for protecting the security of your Personal Data. We utilize appropriate policies and procedures to safeguard the Personal Data collected, to maintain data accuracy, to ensure appropriate use of the Personal Data and to prevent unauthorized access or disclosure of the same.

    (E) RETENTION
    AGSSB maintains your Personal Data in our business records while you remain a customer or user of any of our products and/or services or a user of the Home Shopping Platform. We also maintain your Personal Data for a period of time after you are no longer a customer or user of any of our products and/or services or a user of the Home Shopping Platform if the Personal Data is necessary for any of the Purposes for which the Personal Data was collected and/or to fulfil legal requirements.

    (F) INTEGRITY
    We will take reasonable efforts to ensure that your Personal Data is accurate and complete, if your Personal Data is likely to be used by AGSSB to make a decision that affects you, or disclosed to another organization. However, this means that you must also u pdate us of any changes in your Personal Data that you had initially provided us with. We will not be responsible for relying on inaccurate or incomplete Personal Data arising from you not updating us of any changes in your Personal Data that you had initially provided us with.

    (G) ACCESS, CORRECTIONS, INQUIRIES, COMPLAINTS
    (i) As accorded by the Act, you have the right to request access and correction to the Personal Data which we hold about you. In general, and subject to certain exemptions, you are entitled to request access to your Personal Data, including for copies of the same, for which we may impose upon you the payment of a prescribed fee.
    (ii) You may at any time hereafter make inquiries, complaints and request for access to, or correction of, your Personal Data or limit the processing of your Personal Data by via registered post or email to the address as set out below.

    (b) sending to you via post any advertising or marketing material relating to any product or service of AGSSB or those of our related corporations and/or our business partners;
    (c) sending to you via email or SMS any advertising or marketing material relating to any product or service of AGSSB or those of our related corporations and/or our business partners; or
    (d) communicating to you by whatever means any advertising or marketing material of AGSSB or those of our related corporations and/or our business partners.

    (H) AMENDMENTS AND UPDATES ON PRIVACY NOTICE
    (i) As part of our efforts to ensure that we properly manage, protect and process your Personal Data, we may/will be reviewing our policies, procedures and processes from time to time.
    (ii) This Privacy Notice may be amended at any time from time to time. Any amendment to this Privacy Notice shall be published or posted on the Home Shopping Platform and/or communicated to you by such means as we deem fit. Your continued usage of any of our products and/or services or on the Home Shopping Platform shall be deemed to be your agreement to the said amendment of this Privacy Notice.

    ASTRO GS SHOP SDN BHD - NOTIS PRIVASI

    Akta Perlindungan Data Peribadi 2010 (“Akta”) telah diperkenalkan oleh pihak Kerajaan Malaysia untuk mengawal selia pemprosesan Data Peribadi dalam transaksi komersil. Akta ini, yang tertakluk kepada semua syarikat dan firma yang diperbadankan di Malaysia, memerlukan kami untuk memaklumkan anda mengenai hak anda dari segi pemprosesan data peribadi anda yang sedang diproses (atau mengumpul Data Peribadi anda untuk diproses lanjut) dan juga untuk memaklumkan anda, di antara lain, bagi tujuan pemprosesan data. ASTRO GS SHOP SDN BHD (1081077-X) (“AGSSB” atau “Kami” dan beroperasi sebagai "Go Shop") komited untuk melindungi data peribadi anda. Notis Privasi ini menerangkan bagaimana AGSSB mengumpul dan memproses data peribadi anda mengikut Akta.
    (A) PERSETUJUAN

    (i) Data peribadi anda dan maklumat lain yang mengenali anda sebagai individu (seperti nama, alamat pos, alamat e-mel dan nombor telefon) termasuk data peribadi yang sensitif seperti yang ditakrifkan dalam Akta (secara kolektif, "Data Peribadi") yang anda membekalkan atau dibekalkan kepada kami, termasuk segala informasi tambahan yang anda berikan kepada kami kemudiannya, untuk akses, penggunaan atau pembelian produk dan perkhidmatan yang dipaparkan, disenaraikan atau dijual oleh AGSSB sama ada di platform pembelian dari rumah kami [ secara kolektif dirujuk sebagai "Platform Pembelian Dari Rumah" termasuk tanpa had, saluran TV pembelian dari rumah serta program-program Go Shop di Astro, di atas talian di laman web Go Shop di www.goshop.com.my, m.goshop.com.my (laman web mudah alih) dan/atau lain-lain aplikasi mudah alih/ aplikasi interface mudah alih/ aplikasi di media sosial (laman web mudah alih Go Shop tersebut dan aplikasi mudah alih/applikasi mobil/app dengan secara kolektif dan / atau secara individu dirujuk sebagai "Tapak") yang kemudiannya akan diproses dan digunakan oleh AGSSB.
    (ii) Untuk memproses dan menggunakan Data Peribadi anda, persetujuan anda diperlukan. Sekiranya anda tidak bersetuju dengan pemprosesan Data Peribadi anda, kami tidak dapat memproses Data Peribadi anda untuk mana-mana Tujuan yang ditakrifkan di sini dan/atau kami tidak akan dapat memproses aksess, penggunaan atau pembelian produk dan/atau perkhidmatan yang diiklankan, paparkan, senaraikan atau dijual oleh AGSSB sama ada atau tidak pada Platform Pembelian Dari Rumah anda dan/atau meluluskan permohonan anda sebagai pelanggan berdaftar dengan AGSSB. Bagaimanapun, sekiranya anda telah memberikan Data Peribadi kepada kami, anda akan dianggap telah memberikan persetujuan untuk membekalkan Data Peribadi anda kepada kami.
    (iii) Sekiranya sesalinan Notis Privasi ini telah dihantar atau dikemukakan kepada anda, dan sekiranya kami tidak mendapat maklumbalas daripada anda dalam masa tempoh empat belas (14) hari dari tarikh penghantaran atay pengemukaan Notis Privasi ini kepada anda, kami akan maklum bahawa anda telah meluluskan dan bersetuju kepada kami untuk mengumpul, mengendali dan memproseskan Data Peribadi anda selaras dengan kandungan Notis Privasi ini, termasuk untuk membolehkan kami menghubungi anda bagi tujuan memasarkan produk dan perkhidmatan kami. Walau bagaimanapun, anda boleh pada sebarang waktu memilih untuk mengehadkan atau menarik balik persetujuan anda terhadap pemprosesan Data Peribadi anda pada sebarang waktu dengan menghubungi pusat panggilan kami yang butiran hubungannya seperti yang dinyatakan di bawah.
    (iv) Persetujuan yang diberikan oleh anda menurut Notis Privasi ini adalah tambahan kepada dan tidak menggantikan sebarang persetujuan lain yang telah diberikan oleh anda kepada AGSSB berkaitan dengan pemprosesan Data Peribadi anda.

    (B) NOTIS DAN PILIHAN
    Data Peribadi anda boleh digunakan dan diproses oleh AGSSB bagi tujuan berikut (secara kolektif “Tujuan”)-:
    a) mentabdir, memudahkan, mengakses dan memproses permohonan anda untuk mengakses, mengguna dan/atau membeli produk dan/atau perkhidmatan kami yang diiklankan, dipaparkan,dijual atau disenaraikan oleh Go Shop dan/atau rakan kongsi perniagaan kami (termasuk tanpa terhad pembekal, penjual, pedagang, rakan kongsi, secara kolektifnya "Rakan Kongsi Perniagaan") di Platform Pembelian Dari Rumah ataupun sebaliknya;
    b) mendaftarkan anda sebagai pelanggan AGSSB dan/atau untuk menangani, memproses dan/atau mentadbir akaun yang akan dibukakan oleh anda dengan kami untuk memudahkan transaksi atau aktiviti anda pada Platform Pembelian Dari Rumah;
    c) memproses, mengakses dan/atau mendaftar (di mana pendaftaran diperlukan) penggunaan anda di Platform Pembelian Dari Rumah;
    d) pemantauan, pemprosesan dan/atau menjejaki penggunaan anda di Tapak untuk memberi pengalaman yang lancarkepada anda, memudahkan atau mentadbir penggunaan anda di Tapak ini, dan/atau membantu kami dalam meningkatkan pengalaman anda dalam menggunakan Tapak ini;
    e) melaksanakan arahan anda atau memberi maklum balas kepada sebarang pertanyaan yang diberikan oleh (atau kononnya diberikan oleh) anda atau bagi pihak anda;
    f) berkomunikasi dengan anda, termasuk menjawab pertanyaan dan/atau permintaan untuk tujuan mentadbirkan dan/atau menguruskan penggunaan anda pada Platform Pembelian Dari Rumah, akaun anda dengan kami atau sebarang transaksi yang dibuat oleh anda dengan kami. Anda mengakui dan bersetuju bahawa komunikasi sedemikian yang dibuat oleh kami boleh melalui surat-menyurat, dokumen atau notis kepada anda, yang mungkin melibatkan pendedahan Data Peribadi tertentu yang terlibat di dalam penghantaran sama serta pada penutup luaran sampul/pakej mel;
    g) memberikan perkhidmatan kepada anda sebagai pemegang akaun kami, sebagai pelanggan kami, atau apabila diminta oleh anda;
    h) berkongsi atau mendedahkan (mengikut budi bicara kami) cadangan, komen, maklum balas atau kandungan anda (termasuk audio, video dan sebagainya) (secara kolektif "Maklum Balas") yang anda membekalkan pada Platform Pembelian Dari Rumah, dengan pengguna lain pada Platform Pembelian Dari Rumah atau dengan orang awam. Ini termasuk pendedahan nama anda bersama-sama dengan Maklum Balas anda oleh kami. Jangan membekalkan Maklum Balas jika anda tidak mahu maklum balas tersebut didedahkan kepada orang awam. Sekiranya anda ingin memberikan komen atau Maklum Balas anda tanpa didedahkan kepada orang awam seperti yang tersebut di atas, sila hantar email kepada kumpulan perkhidmatan pelanggan kami di alamat e-mel yang terdapat di Tapak dan ketatkan subjek e-mel anda dengan perkataan "Sulit";
    i) memproses permohonan anda, transaksi tempahan dan pembayaran, mentadbir, memudahkan, memproses dan/atau berurusan di dalam transaksi dan aktiviti yang dijalankan oleh anda pada atau melalui Platform Pembelian Dari Rumah, termasuk melaksanakan transaksi dan membekalkan produk dan/atau perkhidmatan kepada anda seperti diminta oleh anda atau dibeli dari Go Shop atau/dan Rakan Kongsi Perkongsian kami.
    j) penyiasatan dalaman, pematuhan, audit atau tujuan keselamatan termasuk, tanpa limitasi, pengesahan jenayah, pencegahan dan pendakwaan;
    k) tinjauan pemasaran dan analisa trend dan/atau pembangunan (termasuk tetapi tidak terhad kepada analisis data, kaji selidik dan/atau pensyarah) untuk meningkatkan perkhidmatan dan kemudahan kami supaya meningkatkan interaksi yang berterusan antara anda dengan kami berhubung dengan Platform Pembelian Dari Rumah, atau memperbaiki mana-mana produk atau perkhidmatan kami;
    l) memberikan maklumat mengenai produk dan perkhidmatan AGSSB kepada anda dan/atau Kumpulan Astro Malaysia dan/atau Rakan Kongsi Perniagaan kami.
    m) aktiviti perniagaan sah lain yang dijalankan oleh AGSSB;
    n) merancang dan melaksanakan sebarang transaksi atau cadangan korporat termasuk tanpa had pembelian, penjualan, pajakan, penggabungan atau penyatuan atau lain-lain pemerolehan, pelupusan atau pembiayaan sesuatu organisasi atau sebahagian daripada sesuatu organisasi atau mana-mana perniagaan atau aset sesuatu organisasi;
    o) melaksanakan dan mengekalkan sistem teknologi maklumat kami, termasuk untuk menyimpan dan memproses Data Peribadi di dalam pangkalan data komputer dan penghidang fail (‘server’) berlokasi di dalam dan di luar Malaysia;
    p) untuk menyokong dan/atau membantu operasi, pentadbiran, pembangunan atau penambahbaikan perniagaan AGSSB, termasuk yang terkandung di dalam mana-mana terma dan syarat yang berkenaan pada Platform Pembelian Dari Rumah;
    q) tujuan untuk menyimpan rekod dan menerbitkan statistik dan penyelidikan untuk keperluan pelaporan dalaman dan/atau undang-undang dan/atau keperluan rekod, AGSSB atau syarikat sekutu/yang berkaitannya;
    r) di mana AGSSB mempertimbangkan penggunaan atau pendedahan Data Peribadi adalah perlu untuk memelihara kepentingannya, termasuk memberikan maklumbalas terhadap sebarang tuntutan atau proses perundangan;
    s) bagi tujuan pematuhan kepada sebarang undang-undang, peraturan, perintah mahkamah atau perintah dari mana-mana badan kawalselia yang berkenaan di mana kami adalah tertakluk untuk mematuhi ;
    t) bagi tujuan lain yang menyokong/membantu dalam operasi, pentadbiran, pembangunan atau peningkatan periagaan AGSSB, termasuk yang terkandung di dalam terma dan syarat Platform Pembelian Dari Rumah;
    u) AGSSB, syarikat-syarikat kumpulan Astro atau tujuan pelaporan korporat yang berkaitan termasuk tetapi tidak terhad kepada pelaporan atas prestasi perniagaan AGSSB
    v) di mana berkaitan, bagi tujuan lain yang bersampingan dan/atau berkaitan dengan mana-mana perkara di atas.

    (C) PENDEDAHAN DAN PEMINDAHAN
    (i) Pendedahan Data Peribadi - Kami mungkin akan mendedahkan Data Peribadi anda kepada satu atau lebih pihak atau kelas berikut:
    a) Perbadanan berkaitan kami (termasuk kumpulan Astro Malaysia) dan Rakan Kongsi Perniagaan;
    b) Pemegang lesen, konsultan, penasihat, kontraktor dan pemberi perkhidmatan kami;
    c) Individu yang diberikan kuasa oleh anda;
    d) Sebarang pemegang serah hak atau penerima pindahan kepada perniagaan AGSSB; dan
    e) Pihak lain berkaitan di mana pendedahan adalah perlu dari segi undang-undang atau keperluan kawalselia atau berikutan perintah mahkamah,
    walaupun individu berkenaan berada di dalam atau di luar Malaysia, untuk (1) sebarang Tujuan di atas; atau (2) sebarang tujuan lain di mana Data Peribadi anda didedahkan sewaktu pengumpulan, atau tujuan yang secara langsung berkait dengan tujuan tersebut.
    (ii) Peruntukan Data Peribadi Pihak Ketiga - Sekiranya anda membekalkan AGSSB dengan Data Peribadi individu selain diri anda, anda mewakili dan memberi kebenaran kepada AGSSB dan anda mengesahkan bahawa:
    (a) sebelum mendedahkan Data Peribadi berkenaan kepada kami, anda telah mendapatkan kebenaran daripada individu berkenaan di mana Data Peribadi telah didedahkan kepada kami untuk:
    (i) membenarkan anda mendedahkan Data Peribadi individu berkenaan kepada AGSSB untuk Tujuan; dan
    (ii) membenarkan AGSSB untuk mengumpul, menggunakan, mendedahkan dan/atau memproses Data Peribadi individu berkenaan untuk Tujuan, seperti dinyatakan di perenggan (A) di atas;
    (b) sebarang Data Peribadi individu berkenaan yang didedahkan oleh anda kepada kami adalah tepat; dan
    (c) anda dengan sah bertindak mewakili individu berkenaan dan anda berhak ke atas individu berkenaan untuk mengemukakan Data Peribadi mereka kepada AGSSB dan membenarkan AGSSB mengumpul, menggunakan, mendedahkan dan memproses Data Individu berkenaan untuk Tujuan yang dinyatakan di perenggan (A) di atas.
    (d) Tanpa mengehadkan keluasan yang disebut di atas, sekiranya anda membuat pembelian untuk dihantar kepada penerima pihak ketiga, anda bersetuju dengan kami mendedahkan Data Peribadi yang mengenali anda, kepada penerima pihak ketiga tersebut (seperti tetapi tidak terhad kepada nama anda). Selanjutnya, anda mengakui dan bersetuju bahawa penghantaran pembelian anda mungkin melibatkan pendedahan Data Peribadi tertentu yang mengenai anda yang terlibat di dalam penghantaran seperti nama dan butiran hubungan anda, yang boleh didedahkan di sampul bungkusan, pada sampul atau dokumen berkaitan penghantaran, mengikut mana yang berkenaan, yang boleh dilihat oleh pihak ketiga yang melihat bungkusan, sampul surat atau dokumen tersebut;
    (iii) Pemindahan Data Peribadi - Data Peribadi anda boleh juga dipindahkan ke lokasi di luar Malaysia dan disimpan di dalam penghidang fail (‘server’) yang berlokasi di dalam atau di luar Malaysia, bagi sebarang Tujuan yang dinyatakan di dalam Notis Privasi ini.

    (D) KESELAMATAN
    Kami menghormati privasi anda dan mengambil serious akan kepercayaan yang diberikan anda kepada kami, dan kami mematuhi sepenuhnya garispanduan untuk melindungi keselamatan Data Peribadi anda. Kami menggunapakai polisi dan prosedur untuk memelihara keselamatan Data Peribadi yang telah dikumpul, untuk mengekalkan ketepatan data, untuk memastikan penggunaan Data Peribadi dan untuk menghalang akses atau pendedahan maklumat yang tidak dibenarkan.

    (E) PENGEKALAN
    AGSSB mengekalkan Data Peribadi anda dalam rekod perniagaan kami untuk suatu tempoh setelah anda tidak lagi menjadi pelanggan kami atau menggunakan mana-mana produk dan/atau perkhidmatan atau pengguna Platform Pembelian Dari Rumah sekiranya Data Peribadi tersebut diperlukan bagi Tujuan di mana Data Peribadi tersebut dikumpul atau untuk memenuhi keperluan undang-undang.

    (F) INTERGRITI
    Kami akan mengambil langkah yang sewajarnya untuk memastikan Data Peribadi anda adalah tepat dan lengkap, jika Data Peribadi anda mungkin digunakan oleh AGSSB untuk membuat keputusan yang mempengaruhi anda, atau didedahkan kepada organisasi lain. Walau bagaimanapun, anda juga harus mengemaskini sebarang perubahan dalam Data Peribadi anda di mana anda telah membekalkan kepada kami pada mulanya. Kami tidak akan bertanggungjawab kerana bergantung pada Data Peribadi yang tidak tepat atau tidak lengkap yang timbul daripada atas tidak kemaskini oleh anda tentang sebarang perubahan dalam Data Peribadi anda di mana anda telah membekalkan kepada kami pada mulanya.

    (G) AKSES, PEMBETULAN, PERTANYAAN DAN ADUAN
    (i) Sepertimana tersebut di dalam Akta, anda mempunyai hak untuk mendapatkan akses dan membuat pembetulan kepada Data Peribadi yang dipegang oleh kami mengenai anda. Secara am dan tertakluk kepada pengecualian tertentu, anda boleh mengakses Data Peribadi anda, termasuk salinan, yang mana kami boleh mengenakan bayaran yang tertentu untuk tujuan tersebut.

    (ii) Anda boleh pada sebarang waktu membuat pertanyaan, aduan dan memohon untuk akses, atau membuat pembetulan kepada, Data Peribadi anda atau menghadkan pemprosesan Data Peribadi anda melalui pos berdaftar atau e-mel kepada alamat berikut:

    (iii) Anda boleh menghadkan pemprosesan Data Peribadi anda seperti berikut. These general terms and conditions for promotional codes (“General Terms and Conditions for Promo Codes”) applies to promotions (“Promotion” or “Promotions”) organized by Astro GS Shop Sdn Bhd (Company No. 1081077-X) (known as “AGSSB” and operating as “Go Shop”) covering the use of promotional codes, discount codes, voucher codes, and/or such other promotional codes that provide a discount price off (collectively “Promo Codes”) offered on Go Shop’s home shopping platforms (“Go Shop Platforms” including Go Shop TV on Astro Channels 118 and 303, online at www.goshop.com.my and on mobile applications at m.goshop.com.my [both online and mobile applications shall be known as “Site”]) for the purchase of a Go Shop product (“Products) subject to terms and conditions.

    2. The Promotions are only applicable to registered customers of Go Shop (“Customer” or “Customers”). Registration as a Customer can be done by calling Go Shop’s toll free hotline number 1800-82-0088 and getting the assistance of Go Shop’s call center agent (“Personal Go Shopper”) or online at www.goshop.com.my.

    3. Unless otherwise specified herein, the General Terms and Conditions for Promo Codes shall be read together with the conditions applicable for each Promotion and Promo Code during its promotional period organized by Go Shop which are found on Go Shop Platforms from time to time and with Go Shop’s Customer Terms and Conditions (both TV and ECMC), Privacy Notice and all other relevant terms and conditions which can be found on Go Shop’s Site at www.goshop.com.my. In the event of inconsistencies, these General Terms and Conditions for Promo Codes shall prevail over any other terms and conditions unless otherwise stated.

    4. The use of a Promo Code shall be subject to the following:
    a) Customers must notify the Personal Go Shopper prior to placing an order when calling in OR if a Customer is purchasing from the Site, Customer shall follow instructions given therein then s elect and apply the Promo Code at the check-out page prior to payment.
    b) Only one (1) Promo Code may be applied for each Product purchased unless otherwise specified as per single order. Customers cannot accumulate and apply two or more Promo Codes to purchase any one (1) s elected Product and/or single order.
    c) Any use of the same Promo Code made before or after the period of a Promotion and/or any use by any person who is not a registered Customer will be invalid and rejected.
    d) Unless stated otherwise, Promo Codes are not valid in conjunction with other promotions or discounts.
    e) No partial redemption or discount or redemption for any other product items or redemption for other promotions with the Promo Code will be allowed.
    f) Customers shall be bound by and comply with all terms and conditions issued by AGSSB for its customers and the terms and conditions stated herein prior to use of the Promo Code. The Promo Code is to be used by individuals only and cannot be exchanged for cash or transferable.

    5. Customers shall confirm, undertake and agree to comply with the General Terms and Conditions herein and in this connection, AGSSB shall have the absolute discretion to withhold or decide not to provide any discounts or promotions for any Product or Promotion including the Promo Code to any Customer as it deems fit.

    6. AGSSB reserves the right to change, revise or amend these General Terms & Conditions herein and/or cancel, revise or reject any discounts or promotions in relation to the Promo Code at any time without notice and without any liability or compensation whatsoever to any Customer or any person or party. Any decision made by AGSSB in relation thereto shall be final and binding on all persons.

    7. AGSSB shall not be liable to any Customer and/or be liable to offer replacement of any Promo Codes, cash or otherwise compensate any Customer for expired, invalid, discontinued or cancelled Promo Codes; improper use of, or inability to redeem any Promo Code; or the inability to redeem a Promo Code due to technical issues.

    TERMS AND CONDITIONS

    1.
    Definitions


    In these Terms and Conditions, unless the context otherwise requires, the following words and expressions shall have the following meanings:

    Account” means a one-time registration account createdfor a Customer who agrees and registers with AGSSB containing the information including without limitation name, address, identification number (NRIC/Mykad), telephone number, record of accumulated Points and Points balance and/or such other information as may be requested by AGSSB for purposes of registration;

    AGSSB” or “We” or “Us” means Astro GS Shop Sdn Bhd (Company Number 1081077-X) a company incorporated in Malaysia and having its registered address at 3rd Floor, All Asia Broadcast Centre, Technology Park Malaysia Lebuhraya Puchong - Sg. Besi, Bukit Jalil, 57000 Kuala Lumpur, Malaysia and operating as Go Shop;

    Business Day(s)” means a day(s) on which commercial banks are open for business in Selangor (other than Saturdays, Sundays and public holidays);

    Customer” or “Customers” means a person or party who has registered an Account with AGSSB;

    Go Shop Customer T & C” means the terms and conditions relating to the purchase of a Product by a Customer on Go Shop which can be found on www.goshop.com.my;

    Go Shop” means the home shopping business operated by AGSSB on various platforms including without limitation television channels which are currently available on Astro’s TV Channels and the Site which provides a venue/platform to Customers to place an Order for any Product;

    "Order" means any order submitted or placed by a Customer to AGSSB to purchase Product(s) from Go Shop;

    "Product(s)" means any products/merchandise/services/offers/display items that are uploaded /showcased/displayed/sold on Go Shop;

    "Site" means the online shopping platform www.goshop.com.my (site/website), m.goshop.com.my (mobile site/ mobile website) and/or any mobile applications/mobile interfaces applications/ apps and the services provided by AGSSB;

    Existing Customer” means a Customer who places an Order and who purchases s elected Product(s) from Go Shop during the validity of the Programme in accordance with the Terms and Conditions set forth herein;

    Point” or “Points” means the reward points awarded under the Programme to Existing Customers by AGSSB upon purchase of Product(s) from Go Shop which may be subsequently redeemed for future purchases of Products in accordance with the Terms and Conditions set forth herein;

    Programme” means the rewards programme known as “Go Shop Club Rewards” operated by AGSSB;

    Total Invoice Value” means the total amount (inclusive of any applicable tax) invoiced by AGSSB to an Existing Customer for an Order after deduction of any applicable discounts and rebates.


    2. Entitlement

    2.1 This Programme shall subject to the Terms and Conditions herein and is open to Existing Customers of Go Shop. For avoidance of doubt, a Customer who has registered an Account but has yet to place an Order or purchase Product(s) from Go Shop will not be entitled to the privileges of the Programme including receiving the Points herein which shall be at the sole and absolute discretion of AGSSB.

    2.2 No fee will be charged Existing Customer save that AGSSB reserves the right to apply any charges and fees at any time as it deems fit.


    3. Awarding and Redemption of Points

    3.1 Awarding of Points

    a) Subject to AGSSB’s right at its sole discretion to decide on the Points and manner of allocation which may be revised from time to time, the Points will be awarded to an Existing Customer based on the s elected Product(s) purchased from Go Shop as follows:

    (i) For purchases of Products made on the Site, the Points awarded shall be equivalent to Five Percent (5%) of the “Total Invoice Value” (to be rounded to the nearest RM0.01) for each Order.
    (ii) For purchases of Products made by calling Go Shop’s hotline, the Points awarded shall be equivalent to Zero Point Five Percent (0.5%) of the “Total Invoice Value” (to be rounded to the nearest RM0.01) for each Order.


    b) Points will only be awarded upon the successful delivery of the Product to the Existing Customer who receives the Product. No Points will be awarded if:

    (i) the Order was cancelled by the Existing Customer prior to delivery;
    and/or
    (ii) Incomplete information was provided by the Existing Customer for delivery purpose hence the Product was unsuccessfully delivered to the Existing Customer.

    Examples:


    - Sofia who is an Existing Customer buys a home appliance worth RM159 from Go Shop’s website (www.goshop.com.my) under her registered Account. She will be awarded 7.95 Points (RM159 x 5%) after she receives her product(s) at her delivery address. The Points will be automatically credited into Sofia’s registered Account within four (4) Business Days of successful product delivery.


    - Rudie who is an Existing Customer buys a tablet worth RM499 by calling in and placing an Order from Go Shop’s hotline. He will be awarded 2.49 Points (RM499 x 0.5%) after he receives the product(s) at his delivery address. The Points will be automatically credited into Rudie’s registered Account within four(4) Business Days of successful product delivery.


    3.2 Redemption and validity of Points

    a) Points can be redeemed once they are credited into the Existing Customer’s Account. Redeemable Points will be automatically credited into the Existing Customer’s Account within four (4) Business Days from the time
    of the successful delivery of the Product to Existing Customer (“ Date of Automatic Credit”).

    Points that have been successfully credited in an Account may be subsequently redeemed by the Existing Customer to purchase s elected Products from Go Shop.

    b) One (1) Point is equivalent to Ringgit Malaysia One (RM 1.00) only.

    3.3 Points are valid for one (1) year from the Date of Automatic Credit and will expire at the end of the validity period. Existing Customers are encouraged to redeem their accumulated Points before the expiry date failing which the Points will automatically expire on the expiry of each validity period. Any extension will not be given.


    Example 1:

    If a Point is credited on 1 October, they will be valid until midnight on 30 September the following year.


    Example 2:


    If a Point is credited on 29 February (in a leap year), then such Point will be valid until midnight on 28 February the following year.

    3.4 An Existing Customer may redeem his/her Points in full or partially to settle the Total Invoice Value, subject to the compliance with the procedures for redemption above. For a partial redemption, the remaining unpaid Total Invoice Value after redemption of Points is payable by the Existing Customer to AGSSB as per the Go Shop Customer T & C.

    3.5 On confirmation of redemption, Points redeemed by the Existing Customer will be deducted from the Account. Existing Customer All Points that have been accepted for redemption by AGSSB and deducted from the Account of the Existing Customer is non-refundable save and except that AGSSB is entitled at its absolute discretion to refund and re-instate Points into the Account to an Existing Customer if:


    (i) an Order was auto-cancelled due to system error despite the Points being successfully redeemed by the Existing Customer; or
    (ii) if AGSSB is unable to deliver an Order to the Existing Customer, after two (2) attempts of delivery, as a result of the willful default of AGSSB or its delivery provider; or
    (iii) Where AGSSB agreed with the Existing Customer to refund the payment of a Product after successful delivery (subject to the Go Shop Customer T & C) and payment of the same Product was made with Points in full or partial of the Total Invoice Value.

    3.6 No Points will be deducted from the Account save and except that where an Existing Customer has made payment on a Product other than redemption of Points, then in the event that the Existing Customer has requested and AGSSB has agreed on a refund of the payment on the said Product in cash (subject to the Customer T & C), then the Points awarded earlier on the said Product equivalent to the value of the refund amount will be deducted from the Account.

    3.7 Points are not exchangeable for cash, cannot be converted to cash, non-transferable nor credited into another Existing Customer’s or a Customer’s Account.

    3.8 AGSSB reserves the right to suspend a transaction and/or reallocate, recalculate, reverse or adjust the Points or take any necessary action, with or without any notice in the event that AGSSB has a reasonable ground to suspect that the Points were awarded, earned or redeemed fraudulently or in error.

    3.9 An Existing Customer shall frequently review his/her Account to check and verify the correctness and accuracy of current Points balance subject to Section 4.7 herein. Existing Customer may check the Points balance via the Site or call AGSSB’s toll free number for assistance.

    3.10 In the event of failure by a Existing Customer to redeem the Points due to any issue, an Existing Customer may within twenty-four (24) hours from the time of experiencing such issue notify AGSSB via email at [email protected] and provide the Existing Customer’s contact number and date/time of attempted redemption and/or such other information to reflect the failure of redemption. Replies from AGSSB to a Existing Customer in this connection shall be made within Two (2) Business Days provided that the Existing Customer has provided all the said information.


    4.
    Dispute

    4.1 If there is any dispute on any Points transaction, an Existing Customer may within thirty (30) calendar days from the date of automatic credit notify AGSSB and provide all relevant information to AGSSB. Any submission after the thirty (30) calendar days will not be accepted.

    4.2 AGSSB may at its sole and absolute discretion settle the disputes as it deems fit. The decision by AGSSB shall be final and conclusive.


    5. General

    5.1 These Terms and Conditions govern and sets out the agreement between AGSSB and each Existing Customer with regards to the Programme. It shall be read together with a) The Privacy Notice of AGSSB on the use of personal information; b) The Terms of Use for the Site; and c) the Go Shop Customer T & C; and d) Such other information as may be provided to an Existing Customer by AGSSB, save that in the event of any conflict, the Terms and Conditions herein shall prevail to the extent of the Programme. By accepting and using the Points under the Programme, an Existing Customer is deemed to have agreed and accepted the Terms and Conditions herein.

    5.2 The accuracy of personal information shall be verified by the Existing Customers who shall notify AGSSB upon any changes on their personal information.

    5.3 AGSSB reserve the right to request the Existing Customer to produce his/her information/identification (including MyKad or Passport) to facilitate the Points transaction and for verification purposes.

    5.4 AGSSB reserves the rights at its sole and absolute discretion to amend or d elete any of these Terms and Conditions at any time as it deems fits without prior notification to Existing Customers. Continuing participation of the Programme and/or continued use and redemption of Points by any Existing Customer shall constitute acceptance of any variation, addition, or amendments to these Terms and Conditions by the Existing Customer who agrees to be bound by the same.

    5.5 AGSSB reserves the right, at any time to vary, modify, replace, substitute or terminate Programme or any rewards, benefits, features or privileges under the Programme or withdraw Points from use or redemption without prior notification to any party including the Existing Customer and without being liable in any way to Existing Customers to the extent permitted by applicable laws.

    5.6 AGSSB shall have the right, in its sole discretion and without notice, to suspend or terminate the Programme and/or revoke any of the Points if the Existing Customer breaches any of the Terms and Conditions herein and Go Shop Customer T & C, website Terms of Use and the Privacy Notice by giving fourteen (14) calendar days’ written notice to the Existing Customer and/or if any Existing Customer shall no longer be a Customer of Go Shop. Upon any termination of this agreement, the Existing Customer shall immediately cease all access to and use of the Account and AGSSB shall, in addition to any other legal or equitable remedies, immediately cancel the Account and deny access to and use of the Account to the Existing Customer in whole or in part. Any termination of this agreement shall not affect the respective rights and obligations (including without limitation, payment obligations) of the parties arising before the date of termination.

    5.7 Existing Customers are responsible for the security of their Account. AGSSB accepts no liability for the disclosure of the Account by the Existing Customer to a third party, whether intentionally or otherwise. AGSSB reserves the right to protect an Account from being accessed if AGSSB has reasonable grounds to believe that the security of the particular Account has been breached or at the risk of exposure in accordance with applicable laws.

    5.8 Any communication or notice to AGSSB should be in writing to AGSSB’s address stated on AGSSB’s invoice. All correspondence and notices by AGSSB to the Existing Customer will be sent in writing to the most recent mailing address provided by the Existing Customer to AGSSB upon registration or via email to the email address provided by the Existing Customer. Notices will be considered to be received upon hand delivery or upon the fifth business day after posting or upon receipt of the email.

    5.9 AGSSB may further establish rules, procedures and policies in relation to any matter regarding the Programme, all of which shall form part of the Terms and Conditions herein. These Terms and Conditions as set out herein shall prevail in the event of any conflict or inconsistency with any other documents, statements, rules, procedures, policies or communications issued by AGSSB, including without limitation any Frequently Asked Questions (FAQs) and advertising or promotional materials.

    5.10 These Terms and Conditions together with the aforesaid further rules, procedures and policies shall constitute the entire agreement and understanding between AGSSB and the Existing Customers with respect to the Programme and shall not be subject to any other agreement, understanding, warranty or representation not expressly contained or referred to in these Terms and Conditions and the aforesaid further rules, procedures and policies.

    5.11 If any provision of this Agreement is held to be invalid or unenforceable, that provision shall be struck and the remaining provisions shall be enforced.

    5.12 These Terms and Conditions are governed by the laws of Malaysia and parties shall submit to the exclusive jurisdiction of the courts of Malaysia.

  • 1. This promotion known as the STAY BEAUTYful Promotion (“Promotion”) is valid from 12 December 2018 to 11 January 2019 (both dates inclusive and hereinafter referred to as the “Promotion Period”) and applicable to all registered customers of Astro GS Shop Sdn Bhd (“Go Shop”) including new customers that register during the Promotion Period (“Customers” or each, a “Customer”).     2. Customers may receive an e-voucher with a unique discount promo code (“Promo Code”) and a free gift under the Promotion by completing the following actions:

    (i) Register a valid email address under their Go Shop account;

    (ii) Subscribe to Go Shop’s e-newsletter (this can be done on Go Shop’s website by going to the page ‘Account Information’ and ticking the box agreeing to receive shopping news via e-mail OR by calling Go Shop’s toll-free hotline number 1800-82-0088);

    (iii) Purchase any TWO (2) s elected products (“Products”) in a single order (“Order”) from Go Shop via Astro TV Channels 118, 120 and 303; online at http://goshop.my/z/01 during the Promotion Period;

    (iv) The first one thousand (1,000) Customers only who complete (i) – (iii) above shall receive:
    • A Promo Code which will be delivered to the Customer’s email address upon successful delivery of the Product as follows:

     For purchases of the Product made before 31 December 2018, Promo Code will be delivered by 15 January 2019;

     For purchases of the Product made after 31 December 2018, Promo Code will be delivered by 31 January 2019; and

    • A set of FREE beauty products worth RM115.00 (such products shall be s elected by Go Shop at its sole discretion whose decision shall be final and binding) (“Free Gift”), which shall be delivered within fifteen (15) days upon successful delivery of the Products.

    3. The Promo Code entitles a Customer to redeem a RM50.00 instant discount off the purchase of s elected products from Go Shop, subject to the following:

    (i) The Promo Code can only be used with a minimum spend of RM250.00 in a single order via Astro TV Channels 118,120 and 303, online at www.goshop.com.my or via mobile application at m.goshop.com.my;

    (ii) Customers must register the Promo Code first before applying the same at the check-out page prior to payment and follow instructions given therein. Alternatively, Customers may call Go Shop’s toll-free hotline number at 1800-82-0088 and inform Go Shop’s Personal Go Shopper the use of Promo Code prior to placing the Order;

    (iii) The Promo Code can only be used once for each Order and is valid for use until 28th February 2019 (“Redemption Period”) only. Any use or redemption of the Promo Code made before or after the Redemption Period will be invalid and rejected;

    (iv) Unless stated otherwise, each Promo Code under this Promotion is not valid for use with other promotions or discounts. No partial redemption or discount or redemption for any other product items or redemption for other promotions with the Promo Code will be allowed;

    (v) The use of the Promo Code is applicable for non-cash purchases (credit card, debit card, Easy Payment Scheme and bank transfer) and Cash on Delivery (COD) purchases.

    4. Customers who request for exchange or return of the Product shall not be entitled to receive the Free Gift.

    5. The terms and conditions herein shall be read with Go Shop’s General Terms and Conditions on Promo Codes on the use of the Promo Code, Go Shop’s Customer Terms and Conditions for purchase of products from Go Shop and Privacy Notice and all other relevant terms and conditions which can be found on www.goshop.com.my unless otherwise specified. The terms and conditions herein shall prevail over any inconsistencies only to the extent of such inconsistencies relate to the Promotion

    6. Customer shall confirm, undertake and agree to comply with all terms and conditions imposed by Go Shop issued to its customers in relation to any purchase of product(s) from Go Shop and in this connection, Go Shop shall have the absolute discretion to withhold or decide not to provide any free gift or discounts from this Promotion and/or any participant of this Promotion.

    7. Go Shop reserves the right to change, revise or amend the terms & conditions herein and/or cancel the Promotion and/or revise any free gift or discounts of the Promotion at any time without notice and without any liability or compensation whatsoever to any person or party. Any decision made by Go Shop in relation thereto shall be final and binding on all persons.

    8.     2. The Giveaway shall commence from 10 December 2018 and end on 23 December 2018 (“Giveaway Period”).

    3.
